MINUTES
PRESENT: Commissioners Gilligan, Hoard and Kelly.
I. Chair Gilligan called the meeting at order at 1800 hrs.
II. Approval of Minutes:
Moved by Comm. Hoard, seconded by Comm. Kelly and voted
unanimously.
III. Additions /Deletions to the Agenda:
Recognition of Robert Romanowski and Paul Alexander at the Employee
Recognition Picnic on September 18, 2009.
City 2% Checks arrived today
IV. Persons wishing to speak to the Board of Fire Commissioners
Lyman Baker asked for the status of the Town of Ithaca 2008 2% checks.
Jack Gould requested that any business that pertains to Fire /Police be put
on hold because their co- Captain is still on vacation.
V. Correspondence
The Board of Fire Commissioners Donation Fund bank statement from
Tompkins Trust Company showed a balance of $995.57.
VI. Membership Changes:
None
VII. Miscellaneous Reports
Town of Ithaca - Has not met yet. The meeting will be on September 15,
2009 and hopefully pass the resolution to create a Fire Prevention Bureau
Lieutenant position.
City of Ithaca - No report

VIII. Department Reports
A. Chief's Report: (see complete written report in Minute Book). Acting Fire
Chief Tom Dorman was able to locate former Chief Wilber's report format
and will have Chief Reports in the future. For tonight however, it will be a
combined report.
The next Budget Meeting will be held on September 14, 2009 at 11:30 am in
the Controller's Office.
Fire Prevention Bureau is looking to hire a Lieutenant. The Department will
need to hire a fire fighter to back fill the position. The Department will be
saving money by not having a Chief's salary to pay.
Chair Gilligan asked if there is a list to hire from. DC Dorman told him that
there is a list. Chair Gilligan asked if the fire fighter would move into a
position created by a retirement when the new Chief is hired. DC Dorman
explained that that is how the resolution is worded. The Department has met
with Common Council and the Vacancy Review Board. There is also a
spreadsheet to show the savings. For 2009, the savings will be about
$13,000 and for 2010 the savings would be about $40,000.
The Department has been busy changing over to the new Fire House
software. We are looking for feedback from the Board on the new reports.
AC Sheldon provided a Training Report that was included in the meeting
packets.
The new trucks should be here at the end of September. However, that may
be delayed due to another truck needing priority work.
B. Fire Prevention Bureau: (see complete written report in Minute Book). DC
Parsons offered highlights of his report and answered questions as follows:
Complaints were at a normal rate. Inspections were slower, but have started
to pick up now that the students are back.

Cornell and Ithaca College are working on temporary housing in the event of
a flu epidemic.
DC Parsons has been working on improving communication between
Cornell's Police and 911. There have been some problems, ie: sending an
ambulance when one is not needed. The dispatcher is trained to "classify"
Classifying determines which vehicles are dispatched. IFD has been trying to
work with Cornell's EMS. They do not work in the summer or on holidays.
They are also a student volunteer service. As a result, they are considered
"part time ".
Local Development - Despite the economy, there are a lot of projects going
on. i.e.: Wal -Mart expansion, 2 new commercial businesses and the Ithaca
Hotel. We are concerned about traffic and maneuverability. Larger vehicles
have not been addressed in the plan.
Comm. Kelly asked how the fire demonstration at Ithaca College went. DC
Parsons said that it went very well. However, the fire retardant chair slowed
down the fire. There is a YouTube video of the fire on the internet. They will
be doing another one at Cornell soon.
IX. Old Business
Comm. Kelly asked if there is any news on the speed bumps. DC Dorman
stated that Bob Romanowski is working on that and the Charter changes.
It is still being addressed.
The City's 2% checks came in today.
The Town is waiting for the signing of the contracts. The lawyers have
been working on the wording. In the future, there will be a Memorandum
of Understanding so that there will be no confusion.
Recognition - Chair Gilligan will ask the Mayor if they can get on a Council
Agenda to present plaques to Bob Romanowski and Paul Alexander.
Comm. Gilligan asked for suggestions on the wording on the plaques.
DC Dorman announced that Chief Brian Wilbur's retirement party will be
on November 21, 2009 at the Clarion. The Clarion was chosen because it
can accommodate the large number of guests expected to attend.

Chair Gilligan asked who signs for the 2% checks. DC Dorman told him
that any officer could sign for them. Ray Wheaton confirmed.
Ray Wheaton announced that there would be a short remembrance
ceremony on September 11th at 9:15 am at the Fire Fighter Memorial
located at the City Cemetery.
There will be an annual Memorial Service at the same location on October
10, 2009. DC Dorman stated that someone would attend on his behalf
because he will be on vacation.
Hearing no further business, the meeting adjourned at 1832 hrs.

4) Grants and Donations
a) Assistance to Firefighter Grants (AFG): Nothing new to report at this time.

C) Child Safety Seat Program: A grant application for the 2009 -2010 fiscal year was
submitted. We are awaiting notification of results. [Same as last month.]
d) Training Center Project Funding: Next steps include continued research to
determine designation of land where training center is located. Additional work
will be required if this is dedicated as park lands. [Same as last month.]
5) City -Town Fire Contract Negotiation
As of this report, we do not have a new contract with the Town.
6) Resource Recovery Legislation
The proposal remains at the City Attorney's Office for review. [same report as last
month] Commissioner Romanowski continues to work on this project.
7) Foreign Fire Insurance Distribution
It appears contract negotiations have removed the clause addressing foreign fire
insurance from the contract and it will be handled as a separate MOU [Same as last
month.].
8) Fire Department Management Software - Firehouse
We are now using the new management system, Firehouse, for all of incident reports.
Currently, we are using Firehouse and our Day Log system for time accounting and
payroll. Due to the critical nature of time accounting and payroll, the two systems will be
run parallel until we are very comfortable with the Firehouse modules.
9) Board Initiatives Outstanding
Bob Romanowski continues to work on the Traffic Calming issues and the Charter
update

C) The two new Pierce Pumpers were delivered on 10/2/09. Fire Fighters

are happy with the MOU, including respective attorneys. A final version has
been developed which will be reviewed by team representatives at a meeting on
08 SEP 09. This should result in a version ready for final approval and
signatures.

b) SAFER Grant: The 2009 grant period is 11/16/09 - 12/18/09. I will be contacting
the Mayor and Town Supervisor for guidance on applying for this grant.
C) Child Safety Seat Program: We were awarded $1,375.00 for this program

Both the Town and the City have scheduled votes on the contract.

The 2% funds from the City have been distributed. The Town has not distributed their
funds.

The following is the Dire Marshal's report for October 2009.
Code Enforcement Division:
The Codes 13nforcemerit Division received 18 complaints in the month October. Tlicre
were 32 complaints closed out, and 32 complaints remain open for October and previous
111olltbs.
The Code Friforccinent Division performed 80 hire Safety and Property Maintenance
Inspections or Rc- inspections. There were 141 violations cited.
The Code Enforcement Division issued: 21 operating permits for assembly occupancies;
7 certificates of compliance for fire and property maintcnance inspections; l certificate of
compliance for a fire sprinkler system; and 4 certificates of compliance for fire alarm
system installations.
hire Investigation Unit:
Thcrc one fire investigation performed at 1050 Darby Road, "Town of Ithaca, in October.
Public Fducation:
Therc were 5 public education events performed, 1 Child Safety Seat Inspection I, and 6
fire drills witnessed by the department in October.
Parking Tickets
There were 8 parking tickets issued by the Tire Prevention Bureau in October. Thcre
were 3 tickets issued for fire zone violations, and 5 tickets were issued for handicap
parking violations.

Please note that at the November 4, 2009 Common Council meeting, Common
Council approved your appointment by the Mayor to serve on the Board of Fire
Commissioners with a term to expire June 30, 2012. The Board of Fire Commissioners
meets on the second Tuesday of the month at 6:00 p.m. at Central Fire Station, 310
West Green Street.
Please visit the City Clerk's Office before your first meeting to be sworn into
office. The office is located on the first floor of City Hall and is open Monday through

ARTICLE VI Board of Fire Commissioners (§ C -93 — § C -99)
§ C -93 Fire Department
All such persons as are now or shall hereafter be members of any fire company now organized in the City of
Ithaca or which may hereafter be organized by the Board of Fire Commissioners herein provided shall be and
continue a body corporate by the name of the "Ithaca Fire Department," and such corporation, through its Board
of Fire Commissioners, is authorized to purchase, receive by gift or otherwise hold and convey real and personal
property for the use of said corporation; provided, however, that the title of all real property shall be vested in the
name of the City of Ithaca and the purchase or conveyance of any real property shall be subject to the approval of
the Common Council of said City.
§ C -94 Membership, terms and compensation of Board.

There shall be a Board of Fire Commissioners, consisting of five Commissioners appointed by the Mayor and
confirmed by the Common Council. At least three of these Commissioners shall be residents of the City of Ithaca.
The remaining Fire Commissioners may be residents of either the City of Ithaca or the Town of Ithaca in
Tompkins County, New York. The term of office of a Fire Commissioner shall be three years, commencing on the
first day of July, two Commissioners to be appointed in each of two successive years and one Commissioner to
be appointed in the third year. Such appointments shall be made at a meeting of the Common Council held in
June of each year. A Commissioner shall hold office until the Commissioner's successor shall have been chosen
and qualified. A vacancy for an unexpired term may be filled in the manner provided in this Charter. Permanent
removal from the municipality of appointment, or other cause to be determined by the Common Council, rendering
impossible the proper discharge of the Commissioner's duties as a Commissioner shall create a vacancy.
§ C -95 Organization and meetings of Board

At their first meeting in July, the Fire Commissioners shall organize as a Board by electing one of their number as
Chairperson and another as Vice Chairperson, and by the appointment of a Clerk and such other officers and
employees as authorized for the ensuing year. The Board shall hold such stated and special meetings at such
times as the Board may determine, but at least once in each month. Three members of the Board shall constitute
a quorum.
§ C -96 Powers and duties of Board.
It shall be its duty and said Board of Fire Commissioners shall have power:
A.
To assume control and management of all apparatus, fire alarm systems, equipment, appliances, supplies,
buildings and employees exclusively in the Fire Department service.

B.
To organize new companies and to disband any Department company, subject to the approval of the Common
Council; to admit new members and to transfer members, upon application and certification of company officers,
from one company to another; and to try, reprimand, suspend or expel any member or officer of any company for
cause.

C.
To authorize and direct the payment of bills and accounts incurred by it and to make such rules and regulations in
regards to the auditing and payment of such bills and accounts and for the payment of all amounts payable out of
the moneys appropriated to the use of the Board as it may deem necessary and proper, and the same shall be
paid by the City Chamberlain. The Board shall file monthly with the Common Council a detailed statement of all

bills and expenses paid, together with the original vouchers therefor, and shall render to the Common Council at
such other times as may be required either by the Mayor or by the Common Council an itemized statement of all
its receipts and disbursements properly classified and showing the balance on hand at the beginning and at the
close of the period covered; and at the close of each fiscal year, it shall submit an annual statement showing by
suitable summaries the expenses and income of the Department. Whenever requested by either the Mayor or the
Common Council, the Board shall also furnish any additional information in regard to its work or the cost thereof.
D.
To submit to the Common Council, on or before the first day of May in each year, an estimate of the amount of
money necessary to cover the expenses of maintenance of the Department, including all salaries and wages,
equipment and supplies and for the maintenance, heating, lighting and ordinary repairs of buildings.
E.
To make and promulgate from time to time such rules, regulations and bylaws as it may deem necessary and
expedient for the government and discipline of the Department not inconsistent with this Charter or the ordinances
of the City of Ithaca or of the laws or Constitution of this state or of the United States.
F.
To be trustees of all moneys now constituting the Active Firemen's Relief Fund, together with 1/2 of all moneys
that may hereafter be received by the City of Ithaca as a Fire Department tax on premiums on policies of foreign
and alien fire insurance companies pursuant to §§ 9104 and 9105 of the Insurance Law (except the amount
payable under the provisions of such law to the Firemen's Association of the State of New York), together with
any other moneys, gifts or property whatsoever acquired for relief or benefit purposes, to be accumulated as a
relief fund for sick, indigent or disabled fire fighters, with power to draw upon such fund for temporary relief and
benefits only, as said Board shall determine. Said moneys shall not be used for any other purposes, except that
the Board may, at any time, distribute such Fire Department tax moneys so received equally among each of the
volunteer fire companies of the City for the use and benefit of the Ithaca Fire Department and the company or
companies comprising the same so long as the balance of said relief fund shall be at least the sum of $90,000.
Said Board shall have full power and authority to invest such funds in any investments legal for trust funds under
the laws of the State of New York. At the close of each fiscal year and at such other times as the Common
Council shall require, said Board of Fire Commissioners, as such trustees, shall submit to the Common Council a
detailed accounting of such fund.

G.
To be trustees of all moneys now constituting the Veteran Volunteer Firemen's Relief Fund and to pay the interest
thereon to the Veteran Volunteer Firemen's Association of Ithaca annually.
Said Board is further authorized to pay from the principal of such fund from time to time such amounts as it may
deem necessary or desirable for the relief of any sick, indigent or disabled member of the Veteran Volunteer
Firemen's Association of Ithaca, but the total amount so paid to any one member shall not exceed the sum of
$200. Such expenditures from principal shall be made, however, only upon the written recommendation of the
Board of Trustees and President of said Association. Said Veteran Volunteer Firemen's Association of Ithaca is
hereby authorized to adopt any further regulation or restriction relating to the expenditure of the principal of such
fund not inconsistent herewith as it may deem desirable for the preservation of the fund and for the purpose of
limiting properly the amount to be withdrawn and the use thereof.

Said Board of Fire Commissioners shall also pay to the Veteran Volunteer Firemen's Association of Ithaca on
March 1 and September 1 of each year 1/2 of all moneys received by the City of Ithaca pursuant to the provisions
of § 9104 of the Insurance Law of the State of New York as a Fire Department Tax on premiums on policies on
foreign and alien fire insurance companies, except the amount payable under the provisions of such law to the
Firemen's Association of the State of New York. Said Board shall have full power and authority to invest such
funds in any investments legal for trust funds under the laws of the State of New York.

To divide the employees of the Fire Department into platoons and prescribe the tours of duty for said employees.
Such tours of duty shall be in accordance with § 1015 of the Unconsolidated Laws, except that, in the event of
conflagrations or riots or other emergencies, said employees shall remain on duty, subject to the orders of their
superiors, and shall receive an extra allowance based on their salary if they are required to perform their duties
during such period of emergency at a time when they usually would be off duty or receive compensatory time off
as provided in § 1015 of the Unconsolidated Laws.

§ C-97 Limitation of expenditures.
Said Board of Fire Commissioners shall in no year expend a sum or incur any indebtedness in excess of the
amounts appropriated by the Common Council for the use of said Fire Department and the amounts made
available pursuant to the Local Finance Law, and such Commissioners shall be personally liable for any
expenditure or indebtedness incurred In excess of such appropriations.
§ C -98 Fire Chief and other personnel
[Amended 7 -10 -1985 by L.L. No. 1 -1985]
The head of the Ithaca Fire Department shall be the Fire Chief. The Fire Chief shall be appointed and removable
in the manner provided in § C -26 of this Charter. The Board of Fire Commissioners shall prescribe the duties of
the Fire Chief. There shall be within the Department such deputy, assistant and other employee positions as, in
the judgment of the Board, are necessary and authorized by the Common Council. The Fire Chief shall appoint all
deputies, assistants and other employees of the Department for indefinite terms, subject to discipline and
dismissal in accordance with the Civil Service Law. The Fire Chief shall fix the compensation and prescribe the
duties of such deputies, assistants and other employees, subject to the approval of the Board and in accordance
with any compensation plan and related rules established by the Common Council. Any member of the Ithaca Fire
Department who is appointed Fire Chief, Deputy Chief or Assistant Chief shall cease to be an active member of
any company of the Department.
§ C -99 Student bunkers: workers' compensation
[Amended 8 -5 -1992 by L.L. No. 3 -1992]
The Board of Fire Commissioners of the City of Ithaca is hereby authorized to contract with student bunkers at the
various fire stations so that said bunkers will be covered by Workers' Compensation pursuant to § 3, Article 1,
Subdivision 1, Group 19, and § 50 of the Workers' Compensation Law of the State of New York, and such
Workers' Compensation coverage is hereby extended to said student bunkers.

Dear Board Members:
The following is the Fire Marshal's report for October 2009.
Code F,nforcement Division:
The Codes l nforcement Division received 18 complaints in the month October. Tbcre
were 32 complaints closed out, and 32 complaints remain open for October and previous
n1011tbs.
The Code Fnforcement Division performed 80 Fire Safety and Property Maintenance
Inspections or Re- inspections. There were 141 violations cited.
The Code Fnforcement Division issued: 21 operating permits for assembly occupancies;
7 certificates of compliance for fire and property maintenance inspections; I certificate of'
compliance for a fire sprinkler system; and 4 certificates ofcompliance for fire alarm
system installations.
Fire Investigation Unit:
There one fire investigation performed at 1050 Danby Road, "Down of Ithaca, in October.
Public Education:
There were 5 public education events performed, 1 Child Safcty Seat Inspection 1, and 6
fire drills witnessed by the department in October.
Parking "pickets
There were 8 parking tickets issued by the Fire Prevention Bureau in October. Tbcre
were 3 tickets issued for fire zone violations, and 5 tickets were issued for handicap
parking violations.

REGULAR MEETING OF THE ITHACA TOWN BOARD
MONDAY, OCTOBER 19, 2009
TB RESOLUTION NO. 2009 -175: Recommendation of Appointment to Board of Fire
Commissioners.
WHEREAS, Robert Romanowski's term on the Ithaca Board of Fire Commissioners as a
Town of Ithaca representative expired on June 30, 2009; and
WHEREAS, the appointment to the said position is made by the City of Ithaca Common
Council based upon a resolution recommending appointment by the Town of Ithaca Town
Board; now, therefore, be it
RESOLVED, that the governing Town Board hereby requests and recommends that the
City of Ithaca Common Council appoint Harry E. Ellsworth as a Town of Ithaca representative
on the Board of Fire Commissioners for a three -year term commencing October 19, 2009
through June 30, 2012.
