JANUARY 13, 2009
MINUTES
PRESENT: Commissioners Romanowski, Alexander, Gilligan and Hoard.
Chair Romanowski called the meeting to order at 1800 hrs.
II. Approval of Minutes: Chair Romanowski made motion to approve the
minutes of the December 9, 2008 meeting with one typo. Seconded by
Comm. Gilligan. Voted unanimously.
III. Additions /Deletions to the Agenda: None
IV. Persons wishing to speak to the Board of Fire Commissioners:
Lyman Baker presented a letter to the Board.
David Cornelius asked if the Department has received the form that is
supposed to be received from the State.
Chief Wilbur responded that the forms go to the Chamberlain's office first and
then they are forwarded to us. As of today, we have not received any forms.
We can check in with the Chamberlain's office to see if they have received the
form.
V. Correspondence:
Chair Romanowski gave an overview of a letter from the Central New York
Firemen's Association, Inc. A copy of the letter is in the Minute Book.
Chair Romanowski also read a letter from Lyman Baker in regard to 2%
money distribution. A copy of the letter is in the Minute Book.
The Board of Fire Commissioners Donation Fund bank statement from
Tompkins County Trust Company showed a balance of $1,055.57. The
Rescue Squad account showed a balance of $1,328.62.

VII. Miscellaneous Reports:
Town of Ithaca — Given to Clerk Randy Flynn to be filed in Minute Book
Audit — None this month
Tompkins County Fire Advisory Board — In the process of reorganization. No
report.
VIII. Department Reports:
A. Chief s Report (see complete written report in Minute Book). Chief
Wilbur offered highlights of his report and answered questions as follows:
Office Hiring — Civil Service exams have been conducted for all positions.
Further action will be taken when the exam scores are received.
800 MHz System — Up and running. The inadequate volume issue is
being addressed.
Communications MOU between Tompkins County and the City of Ithaca -
Outstanding issues:
CAD upgrade
Status button function with 800 MHz system
Restore mobile data terminals
Grants and Donations:
SAFER — Unsuccessful in receiving grant
Strategic Fundraising for Firefighters — Nothing to report
City -Town Fire Contract Negotiation - We are waiting to hear from our
respective attorneys the results of their conference on the contract.

B. Fire Prevention Bureau (see complete written report in Minute Book).
DC Parsons stepped out and was unable to comment on his report.
AC Sheldon has been going through training records to ensure all training
has been done and recorded.
C. Deputy Chief s Report (see complete written report in Minute Book). DC
Dorman offered highlights of his report and answered questions as
follows:
Lt. Deis has completed his tour in Afghanistan and will return later in
February. When he returns, he will return to Lt. status and Lt. Jim
Crowley will return to fire fighter status.
Selected Calls — No report
Still working on repairing 933. Waiting on the repair to the bucket railing.
IX. Old Business:
Chair Romanowski asked Comm. Hoard to do the report for the City by taking
the Chief s and DC reports and giving Common Council a summary.
X. New Business:
Resource Recovery Proposal — Chair Romanowski has been working on the
draft. He handed out copies and asked that everyone review it and get back to
him with comments.
Comm. Gilligan asked about reports and was told that Dianne McGrady was
working on it.
Comm. Alexander asked Chair Romanowski if he sends out reminders to
companies to submit rosters, minutes of meetings, etc. if they aren't
submitted.
DCPrman didn't think they are required. Chair Romanowski agreed.

LIFE SAFETY DIVISION
Administration
1) Career Personnel Report
a) See Deputy Chief Dorman's report.
b) Office Hiring
Financial Management Assistant, full time: As of Saturday, 10 JAN 09, Civil
Service examinations for all office positions have been given. Further action on
office positions will occur when exam scores are received. [No change from last
month]
2) Operating Budget Status
a) Please see the updated account balances sheet for 2009.
3) County Communications and 911 Program
a) 800 MHz System: We are still waiting for mobile radios to be installed in engines
and aerials. At this point, the installation process is tied to the development of a
software application to take the status button data provided by the mobile radio
system and adapt it to the data input needs of the current CAD system. If this will
be done soon, the radios will be installed using the new 800 MHz radio status
buttons. If not, DOER has a plan B that involves using the 450 MHz radio status
buttons, and relocating the 450 MHz radio control heads to allow installation of
the 800 MHz radios.
b) Communications MOU between Tompkins County and the City of Ithaca: The
last meeting was held 21 JAN 09. Action steps from the last meeting included
drafting a successor MOU for consideration by the parties. The next meeting will
be held at 1100 hrs, 18 JAN 09.
Beyond performance measurements, the following items remain outstanding:

3) American LaFrance Preservation Proposal
At last month's meeting, FF Chris Hamilton proposed to acquire and preserve the 1985
American LaFrance (904) for use as a ceremonial piece by the Ithaca Fire Department.
Mayor Peterson and I discussed the concept and she was guardedly supportive, asking for
more information about current value and costs to the city. This was shared with FF
Hamilton who is continuing to research the project and its feasibility. [same report as last
month]
Training

2) AC /MTO Sheldon is currently reviewing training records along with service hours for
compliance with mandates and policies. Those in arrears have been notified. He is
working with each to consider current status and /or corrective action.

Dear Board Members:
The following is the Fire Marshal's report for .1anuary 2009.
Code Enforcement Division:
The Codes Enforcement Division received 35 complaints in the month .Ianuary. There
were 29 complaints closed out, and 19 complaints remain open for .Ianuary and previous
months.
The Code Enforcement Division performed 152 inspections or re- inspections. There were
231 violations cited.
The Code Enforcement Division issued: 5 operating permits for assembly occupancies;
16 certificates of compliance for Fire and property maintenance inspections; 1 Sprinkler
System Certificate of Compliance; and 1 Fire Alarm Certificates of Compliance.
Fire Investigation Unit:
There was one investigation performed by the Fire Investigation Unit of a lire that
occurred at 171 E State Street. The cause of the fire was incendiary and is being further
investigated by the Ithaca Police Department.
Chris I- Iamilton has completed a summary report for the Fire Investigation Unit's
Activities in 2008.

Appointed by Mayor & confirmed by Council — December 2008
Ms. Maureen Kelly was also appointed in December.
Maureen and I replace Steven Williams and Thomas Farlow as Fire Commissioners. The BFC
now has a full roster.
Appointed by BFC Chair Bob Romanowski to make reports @ Council Meetings
Was Ithaca Building Commissioner from 1976 to 1988 — twenty years ago.
Am now with HOLT Architects as their codes analyst.
Have had a long interest in the well -being of the Ithaca Fire Department.
Son -in -law is a firefighter in Saugus, Massachusetts.
Personnel:
Lieutenant Tom Deis has returned from a tour in Afghanistan as a sergeant in the Army Reserves.
There are currently no open positions at IFD.
City -Town Fire Contract Negotiation:
Last negotiating session was on November 25'n,

The latest draft of various pieces of this legislation has been distributed to Council Member

Commissioners.
Emergency Management Exercise:
The City of Ithaca Emergency Management Tabletop Exercise will be held on February 121n
from 0830 to 1600, at the Holiday Inn.
SAFER Grant.
In December Chief Wilbur received notice from C. Gary Rogers, Department of Homeland
Security's Federal Emergency Management Agency (FEMA) that the IFD did not receive a
SAFER Grant for FY 2008. This is the third year in a row that the IFD did not receive a SAFER
Grant. Given the economy, this grant may be in its last year.

Assuming the successful adoption of the Proposed MOU.extending the current Fire protection
contract between the City of Ithaca and the Town of Ithaca to December 31,2009 or an earlier
completion and adoption of a new contract date,there is still the matter of already received 2% funds
being held by the Town for this years distribution.
I am respectfully asking the Town Supervisor and Board to distribute these monies under the terms of
the extended current contract,based on the valuation of the protected area percentage.Upon
consultation with Chief Brian Wilbur,he has stated that he has been in consultation with the Chief of the
Cayuga Heights Fire Department to reach agreement on the terms as put forth by the Town
attorney,Susan Brock,ESQ.for insertion in the new contract, whenever all the remaining issues are
resolved.

Again this year the Town of Ithaca's 2% money is being
held in limbo. One would assume that this is a violation of
the agreement between the City and Town.
While we understand the ongoing discussions about this
money, we must encourage the Ithaca BFC to ask the Town
of Ithaca to immediately distribute any and all 2% money
and any interest earned on said money as per the
agreement that was in place at the time the money was
received in 2008.

MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding, executed on April 17, 2008, and extended
on September 8, 2008 sets forth the understanding of the parties as follows:
A. On March 10, 2003, the City of Ithaca and Town of Ithaca entered into a
renewed fire protection contract, for the provision of fire and emergency medical
services for a portion of the Town of Ithaca; and
B. The fire protection contract entered into between the parties on March 10, 2003
was by its terms set to expire on December 31, 2007 and was extended by the parties
until September 30, 2008; and
C. The terms and conditions of the contract entered into between the parties on
March 10, 2003, shall be extended and continue in full force and effect (including
payments at the 2007 level) through December 31, 2008, unless the parties mutually
agree to different terms prior to such date; and
D. In addition to the foregoing, the Town of Ithaca will make payments to the City of
Ithaca, as described in section 5 of said agreement, as a portion of the total share due
under the terms of the fire protection agreement in 2007.
