ADJOURN ITHACA BOARD OF FIRE COMMISSIONERS FEBRUARY 13, 2007 MINUTES PRESENT: Commissioners Romanowski, Williams, Gilligan, and Alexander; one vacancy; Common Council Liaison Robin Korherr. I. Chair Romanowski called the meeting to order at 1810 hrs. II. Comm. Williams made a motion to approve the minutes of the December 2006 and January 2007 meetings as written. Seconded by Comm. Gilligan. Carried unanimously. III. Additions /Deletions to the Agenda: - Add to Old Business: Fire Police - Comm. Williams will notify companies of upcoming training; Eligibility requirements will also be discussed; - Add to Old Business: Discussion of volunteer membership - eligibility status and insurance coverage. - Add to Old Business: Board vacancy - any new info.? - Chief Wilbur will report on the status of the Stakeholder's Group - and Comm. Williams was appointed as the Board representative. IV. Persons wishing to speak to Board of Fire Commissioners: - Lyman Baker addressed the Board to inquire about the status of fire police training. Training is offered to those department members who are eligible. V. Correspondence: - Chair Romanowski read a letter he received from Co. 1 expressing their opposition to the use of 2% funds for training for volunteer or bunker programs; - A $50 donation from a grateful citizen has been deposited to the donation account; - The Board received a copy of a letter from Lt. Membership Changes: - Chair Romanowski made a motion to accept the removal of Bunker Ophir Degany who has graduated from IC and leaving the area. He will remain a social member of Co. 5. Seconded by Comm. Gilligan. Carried unanimously. VII. Miscellaneous Reports: - Town of Ithaca - see written report from Chair Romanowski in the Minute Book; - Audit - the audit was reviewed and approved; - Tompkins county Fire Advisory Board - no report. VIII. Department Reports: A. Chief's Report (see complete written report in the Minute Book). Chief Wilbur offered highlights of his report and answered questions as follows: - Operating budget status - Chief Wilbur reported that the City Controller has commented on IFD's excellent record keeping and financial reports - one of the most organized in the City and the Chief recognized the hard work of the staff. - County Communications - the 800 MHz trunking, talk groups scheme has finally come to workable design that meets the needs of county services. A sub - committee is working to formulate a structured approach to purchase user equipment - not all agencies are prepared financially or have set aside monies for purchase. - Grants and donations - no news yet on 2006 applications; - Strategic Planning - A stakeholder's group has been formed by ITHACA BOARD OF FIRE COMMISSIONERS FEBRUARY 13, 2007 - MINUTES PAGE 3 Common Council person J.R. Clairborne that is comprised of the Mayor, Town Supervisor, BFC Rep. (Comm. Williams), Union representation, Chief, and other Council members (from the Communications and Emergency Services Committee) and will have their first meeting on March 1st at Noon. The Chief will report back to the Board at the March meeting. Comm. Gilligan will serve as an alternate Board rep. this group, and Comm. Alexander would like to be involved when the facilities part of strategic planning begins. Right now the focus is on staffing plan. - Emergency Management - ICS 300 courses are now being scheduled for city employees. to n B. Deputy Chief's Report (see complete written report in Minute Book). Deputy Chief Dorman offered highlights of his report and answered questions as follows: - New 945 (Chevy Impala) is received and in service; 962 is ordered (Ford Hybrid Escape); specs for 942 are in the works - a draft copy is ready; and the apparatus committee was scheduled to meet tomorrow to work on pumper bids but is now cancelled due to bad weather. - The front room is going to be remodeled, new carpeting upstairs and down (at Central), and the EOC Ops. room (old Dispatch) is almost complete. C. Fire Prevention Bureau Report (see complete written report in Minute Book). IX. Old Business: - In response to an inquiry from Lyman Baker, Chief Wilbur provided the following information describing volunteer "active" membership and how it relates to insurance coverage: (see the following items in the Minute Book): - Memo from Chief Wilbur answering specific questions posed; ITHACA BOARD OF FIRE COMMISSIONERS FEBRUARY 13, 2007 - MINUTES PAGE 4 - IFD policy #770.1003.01 re: Standby Duty and Training Requirements; - Excerpts from the IFD Volunteer Handbook that describes active status; and - the NYS Volunteer Firefighters' Benefit Law (VFBL) section 5 - Coverage. Discussion items were as follows: - The BFC established the rules and regulations and approved all the documents regarding volunteer membership; the defining documents are the minutes of the Board of Fire Commissioner's meetings where membership changes are approved - membership changes require Board action. - In order to reconcile, Board minutes need to be researched and compared against the IFD computer data base, and company rosters. IFD data base only covers members of the department (active, inactive, removed, etc.) not social members that may be on volunteer company rosters. Any member who is not listed as an active department member, is not covered by VFBL. - Comm. Gilligan suggests the roster "cleanup" begin and definitions of "active" be defined, with input from the City Attorney's office included; he will draft a letter requesting assistance and send it by e- mail; - Comm. Gilligan - if we don't have volunteers then what's the point? If we do, then what do we want them to do? Posing these questions could also go to Common Council - once answered, then question goes to how to fund training. - Fire Police Training - Comm. Williams reported on Fire Police Training at the Cortlandville Fire Station - he will notify the others who were interested. Deputy Chief Dorman asked, if the Fire Police become a viable group, who will buy the necessary equipment? Chair Romanowski indicated that companies who have members participate will provide the equipment. Discussion continued regarding active status and the process for becoming active - application, company recommendation, OSHA physical, criminal background check, and Board of Fire ITHACA BOARD OF FIRE COMMISSIONERS FEBRUARY 13, 2007 - MINUTES PAGE 5 Commission acceptance. There would be further internal training ie OSHA training, or any other in- service training that the department offers that would be appropriate to the fire police group. - Board vacancy - Chief Wilbur spoke to the Mayor - she is still soliciting suggestions, but has clearly stated she would like to appoint a woman. Comm. Gilligan suggested having an article or letter in the newspaper soliciting interest. Chair Romanowski indicated he would craft a news release, or public service announcement, and work with the Mayor's office. X. New Business: - Comm. Gilligan reported he had an inquiry about use of the "Active Firemen's Relief Fund" - not limited to volunteers (can be a career firefighter) and no restriction on amount that can be requested. - Chief Wilbur provided a list of the 2007 Common Council committees noting that the Ithaca Fire Department now falls under a newly established committee - Communications and Emergency Services Committee - J.R. Clairborne is the Chair. This committee will consider the "work plan" of the now defunct Community and Neighborhood Issues Committee, which includes the IFD staffing proposal. XI. LIFE SAFETY DIVISION Administration 1) Career Personnel Report See report from Deputy Chief Dorman. 2) Operating Budget Status a) Funds for program purchasing responsibility have been summarized and distributed to appropriate staff. Meetings to organize purchasing activities have been held to facilitate an early start to projects and activities funded for this year. b) Operating budget account distribution and balances, and the extraordinary incident cost summary will be distributed at the meeting. 3) County Communications and 911 Program a) 800 MHz Trunking, Talk Groups: It appears a workable talk -group design has been developed that will meet the needs of county emergency services. The next step in the operational design is the development of policies and procedures regarding the use of the radio system and the talk group scheme in particular. b) Equipment specification and purchase: A sub - committee is working on a proposal to present to the Emergency Communications Review and Oversight Committee ( ECROC) regarding the user or subscriber equipment to be purchased and the distribution of costs associated with that purchase. Once ECROC has reviewed and acted on the proposal, it will be sent on to the Public Safety Committee of the County Legislature for consideration and action. 4) Grants and Donations a) Assistance to Firefighters Grants (AFG): Awards for the 2006 version of the AFG and SAFER grants continue, with regular announcements coming out about what departments have received grants. To date we have received no word of any award. Fire Prevention Bureau 1) See Assistant Fire Chief Parson's report of Fire Prevention Bureau activities for the month of January. Safety Section 1) Safety Stand Down: The final report still has not been completed. OPERATIONS DIVISION Response 1) Monthly Call Report See distributed reports for 2006. 2) Emergency Management 1) Efforts continue City -wide to insure compliance with National Incident Management System (NIMS) requirements. ICS 300 courses are being scheduled via the NYS Emergency Management Office (SEMO). A design team has been selected and a meeting will be held to plan a public works oriented tabletop exercise for city departments. 2) Pre - Disaster Mitigation Grant: Starting in 2002, the City of Ithaca engaged in a project to develop a pre- disaster mitigation plan. This plan is required to insure eligibility for future mitigation grants. As of 04 JAN 07, we have been advised the grant application has been submitted to FEMA for final review and action. This is the last step for this grant and we are still waiting to hear what the decision will be. SUPPORT 37 Vehicle work orders were written and 29 were closed. The new 945, a 2007 Chevy Impala, is in service. The replacement vehicle for 962, a Ford Escape is on order. Codes Division: The Codes Division received 20 complaints in the month January. There were 14 complaints closed out, and 6 complaints that still remain open. The Codes Division issued 32 parking violations during January. The Codes Division performed 40 Operating Permit Inspections, witnessed 2 sprinkler hydro test /inspections, 8 fire alarm tests, 2 kitchen hood system tests, and 1 fire pump test. The division issued 27 operating permits for occupancies, 9 fire alarm system certificates, I fire pump certificate, 3 kitchen hood suppression certificates, and 3 sprinkler system certificates. Fire Investigation Unit: There were no fire investigation conducted in the month of January Juvenile Fire Setters Program: There were no referrals to the program in the month January. Public Education: There were 3 Public Education Details, 1 Fire Drill witnessed, and 11 Child Car Seat Inspections in the month of January. Wilbur Re: "Active" Members ip — Question Date: 13 FEB 07 With regard to your request for comment on the questions posed by Lyman Baker, I have addressed each of them below. Please do not consider these "legal" opinions — I am not a lawyer. Question 1: "Are the volunteer firefighters who joined and are still members of the Ithaca Fire Department in the 1960's, 70's, 80's and the 1990's still considered active ?" As an active volunteer becomes an employee of the municipality at the time he or she goes on duty, the municipality has ultimate say over what constitutes an active member of a fire department or company. As Lyman points out, § C -96 of the City Charter assigns the responsibility for defining active membership to the Board of Fire Commissioners. The membership changes that are a part of each month's Board agenda is the action that defines whether or not someone is active. The Board can adopt rules and regulations to establish what does or does not constitute active service, and thus the ability to remain an active member. To that end, please see attached an excerpt from the Ithaca Fire Department Volunteer Handbook, and a copy of IFD policy 770.1003.01. Failure to meet the minimum requirements established by these documents has been the basis for removal of members from active membership, either to a non - active status (e.g., veteran or inactive), or removal from departmental membership altogether. One of the most critical aspects of active membership is the coverage of a volunteer by the Volunteer Firefighter's Benefit Law (VFBL). Think of the VFBL as Worker's Compensation coverage for volunteer fire fighters. As an aside and by charter, if not a member of a volunteer company, IFD bunkers are covered by regular Worker's Compensation coverage. To be covered by VFBL, a volunteer must be active. The VFBL includes specific language defining what activities are covered; it is attached for your reference. "Active volunteer firefighter" means a person who has been approved by the authorities in control of a duly organized volunteer fire company or volunteer fire department as an active volunteer firefighter of such fire company or department and who is faithfully and actually performing service in the protection of life and property from fire or other emergency, accident or calamity in connection with which the services of such fire company or fire department are required. To be sure, this definition is provided for a specific purpose, which is to define what constitutes active service as it relates to service award programs for volunteer fire fighters in New York State. Be that as it may, it appears instructive as to legislative intent. To get to the root of the question, correlating the department roster maintained by the Fire Chief s Office with Board records to verify that each are accurate is a necessary first step. Next, doing the same thing with Company rosters would be very helpful in correcting discrepancies that may appear. Finally, the Board must consider what definition of "active" it wants to use, and then apply that to the rosters. Requirements for new members During their first year after entry, new members are provisional members of the department and one of the volunteer companies. To proceed to full membership, they must meet all department membership requirements during the probationary period. (Also see the section on Training that follows -- Item C., TRAINEES.) During training, the probationary member must * Maintain satisfactory performance levels and appropriate conduct Attend all New Member Training sessions and all other training sessions scheduled by the Platoon Leader during New Member Training (such as in- service). After completing New Member Training, the probationary member must attend: * All monthly platoon meetings * All OSHA training sessions (one session on same topic) * All company training sessions * One in- service training session per month * One New York State Office of Fire Prevention and Control "field" or "academy" course during the probationary period. The probationary member must also * Perform scheduled standby at Central'Fire Station for a minimum of 20 hours each month, scheduled in minimum blocks of at least four hours. For some Class II and all Class III probationary members, the member must * Fulfill requirements of a mutually agreed upon proba- tionary contract, established by the Municipal Training Officer, Deputy Chief of Operations and the member. For those provisional members who are students, the probationary 12.1 period will automatically be extended for the number of full months the member is absent. Violation of the terms of probation will lead to suspension of the provisional member by the Platoon Leader or MTO and dismissal from the department by the Deputy Chief of Operations. Loss of active status Any member who does not maintain active status is required to return all department property. Failure to do so carries the risk of legal action by the City. An inactive member may not respond to or participate in any emergency operations. Unless dismissed by the department for failing to meet probationary requirements or by the volunteer company, the individual will automatically become a "Class IV" member and may participate in all other department and Company activities as essentially a "social" member. Reactivation procedures ( ** NOTE CHANGES FOR 1995 * *) Any full volunteer member (not probationary) who fails to meet the requirements for active status during the previous year will be notified by letter and directed to return all department property (including protective gear, uniform, SCBA facepiece, pagers and monitors). The full member may seek to return to active status at that time. To return to active status: * ** Submit a written request to the Fire Chief for extension of your active status. * ** Fire Chief reviews request and forwards to Company Captains Group for review and recommendation. * ** If recommended by Company Captains, active status will be continued for a 3 month trial period. * ** During the 3 month extension, you must respond to at least 30 calls (or perform equivalent standby) and attend at least 2 in- service training sessions. * ** The 3 month time period begins as of the date of Captains Group recommendation for return to active status. 12.2 To return to active status if you have been inactive for more than one year: * ** Submit a written request to the Fire Chief for a return to active status. * ** Fire Chief reviews request and forwards to Company Captains Group for review and recommendation. * ** If recommended by Company Captains for a 3 month trial return to active status, your level of training will be reviewed by the Municipal Training Officer and, if needed, brought up to current standard. * ** During the 3 month extension, you must respond to at least 25 calls and attend at least 2 in- service training sessions. * ** The 3 month time period begins when any required retraining is completed. This reactivation option is not available for provisional members who fail to meet their probationary requirements. Benefits for active volunteers Volunteers who earn active status are entitled to certain benefits from the department, such as minitors, blue light permits and turnout gear, and are entitled to receive a City of Ithaca parking permit. As an active member, you are also eligible to qualify for the Volunteer Incentive Program. Meeting or exceeding the volunteer response and training requirements is essential to qualify for this program. While, within the state and pursuant to orders or authorization, working in connection with the construction, testing, inspection, repair or maintenance of the fire alarm system, water supply system, fire well, fire cistern or fire suction pool, used by the fire department or fire company, including necessary travel directly connected therewith, as well as necessary travel to and necessary travel from such activity. i. While, within this country or in Canada and pursuant to orders or authorization, practicing for, or participating as a contestant or an official in, any competitive tournament, contest or public exhibition conducted for firefighters which is intended to promote the efficiency of the fire department, fire company or any unit thereof, including necessary travel directly connected therewith other than travel to and returning from such practice. The actual rendition of fire or other emergency service shall not be deemed "practicing" within the meaning of this paragraph. Benefits shall not be paid and provided pursuant to this chapter in the following instances: a. Work or service rendered by a volunteer firefighter while on a leave of absence pursuant to either section two hundred -b or section two hundred -c of the general municipal law, unless such work or service is performed pursuant to subdivision one -a of section two hundred -b or subdivision one -a of section two hundred -c of the general municipal law, or pursuant to any other general, special or local law, charter or ordinance or pursuant to the constitution, by -laws, rules or regulations applicable to the fire company or fire department of which he is a member. b. Practice for and participation in any recreational, social, or fund raising activity other than a fund raising activity for which coverage is provided under paragraph m of subdivision one of this section. In addition to firefighting, IFD trains in such areas as emergency medical services, specialty rescue and hazardous materials. Also, outside agencies use our facilities to conduct such trainings as Community CPR. The television will be used to display videos and PowerPoint presentations. During large -scale emergencies, the training room becomes part of IFD's Emergency Operations Center. The ability to display maps and other information on a large screen helps to share information quickly to the various emergency service agencies. In reviewing the Application for funds form, it appears that the request would need to go through the volunteer company and then be submitted to the BFC for action- unless because the person is now a career firefighter the volunteer company is no longer required. Based on the information, in the City Charter on the Active Firemen's relief fund it does not appear that there is a limit on the amount that can be reimbursed to an individual. The amount of assistance from this fund is to be set by the Board of Fire Commissioners. (As I understand it the donation fund has a $150 limit, and the Vet Relief fund is a $200 limit per individual -which is specified in the City Charter and the Vets can further restrict this amount). Are either of you aware of any issue that would preclude the individual from applying for assistance from this fund and what is the process for a career firefighter making a request? Related to the above and also the email from Bill Baker, as President of the Vet Fireman's Association regarding the interest payment on interest earned on the Relief funds. I have some questions or items for clarification regarding the Relief funds. The reconciliation of the Firemen's Relief funds for 2005 was with the 2% distribution information that was with the October 2006 minutes. I'm attaching this 2005 reconciliation. Based on this report, the balance in the fund is $90,408.26. Based on the City Charter, it appears that there should be 2 separate funds. The Active Firemen's Relief Fund and the Veteran Volunteer Firemen's Relief Fund. According to the City Charter- the Active relief fund must be maintained at a balance of at least $90,000 and the Board can distribute any amount over the 90K to the 8 volunteer companies. This appears to have happened with the last 2% distribution which included interest of $512 in addition to the 2% funds from the state. ($512 is about 1/2% rate of interest - according to the City Charter its- up to the BFC to determine where these funds should be invested) There was also $66 in interest added to the 2% money paid to the Vets Association. That was identified as the interest from the Vet Relief fund and presumably is the funding that Bill Baker was asking for from Debra Parsons. I didn't see a separate report on the Vet Relief fund is there one? We can discuss this at tomorrow's meeting, but wanted to give you all a heads up regarding this issue.
