Uniform bid resolution XI. EXECUTIVE SESSION XII. ADJOURN BOARD OF FIRE COMMISSIONERS DECEMBER 14, 2010 MINUTES Present: Commissioners Gilligan, Hoard, Zeey and Ellsworth I. Chair Gilligan called the meeting to order at 1805 hrs. II. Approval of Minutes: A motion was made by Comm. Hoard to approve the minutes of the November 9, 2010 Board of Fire Commissioners meeting. Seconded by Comm. Ellsworth and approved unanimously. III. Additions /Deletions to the Agenda: None IV. Persons wishing to speak to the Board of Fire Commissioners: None V. Correspondence: Statement from Tompkins Trust Donation Fund showed a balance of $462.82. A.thank you from Lakeview Cemetery was received for the $25 donation for cemetery maintenance in memory of the Ithaca fire fighter buried there and who was killed in the 1906 Chi Psi fire. VI. Membership: None VII. Miscellaneous Reports: Town — None City — Submitted Audit — In progress VIII. Department Reports: A. Acting Chief /Deputy Chief Report: (see complete written report in the Minute Book). Acting Chief Tom Dorman offered highlights of his report and answered questions as follows: BOARD OF FIRE COMMISSIONERS DECEMBER 14, 2010 PAGE 2 Personnel Staffing Levels: The Fire Chief Civil Service exam will take place on January 8, 2011. Lt. Dave Burbank retired. 2 firefighters will retire by the end of the year. Firefighter Lenore McGarry was granted disability. The City will pay one half and the State will pay one half 1 firefighter will be on leave of absence for 1 year. Acting Chief Dorman and Deputy Chief Parsons met with the Vacancy Review Board. They have not heard back but Acting Chief Dorman is very optimistic to get the approval for two new firefighters. The plan is to get them into the Fire Academy at the end of February. There are also five transfer candidates. Human Resources has been asked to canvass the list. They will be canvassing the individuals that received 100's and 95's. Those individuals who have already received 229 hours of required training prior to being hired would go right to shift training and skip the Fire Academy. At this time, the Department is dangerously close to tapping a lot of over time. Budget Status: Over time for 2010 is holding well at 75 %of the budget. Chair Gilligan asked if the Department will be rolling any of the 2010 funds forward. Acting Chief Dorman responded that the Department can encumber some of the funds. He also stated that that the Department should come in under budget. County Communication and 911: CAD system went online on December 6th. There are still difficulties on the fire side. There has been slow but incremental progress. The Department feels that the issues are major, but Dispatch feels they are minor. BOARD OF FIRE COMMISSIONERS DECEMBER 14, 2010 PAGE 3 1820 hrs. - At this time, Liaison J.R. Clairborne arrived. The new system allows properties that have major hazard to be flagged as "outside" attacks only. Other information on specific buildings can be maintained in the system and accessible while responding to an incident. Chair Gilligan asked if there are GPS units in the equipment. DC Parsons responded that there are. Chair Gilligan asked how long it would take to get the system operational and will be useful in 6 months. DC Parsons responded that it will be useful right away. Comm. Ellsworth asked if there is a computer on each truck. Acting Chief Dorman responded that there is and access is via a Verizon Air Card on each truck. Assistance to Fire Fighter Grant: To be used for in- vehicle repeaters. The initial grant was for $10,000. One of the Lt.'s said that there are funds available that haven't been used and could be used. Otherwise we would lose $80,000. Training Center: Is in front of the Planning Board. There will be a meeting this week on the status of the center being on land designated as park land. Operations: There were 2 fires this month: 12 John St. — Chimney wall fire due to an improperly installed gas fire place. C Shift responded. Madison St. — 1St floor completely involved fire. A Shift responded. DC Parsons stated that there was a smoke detector from a County program installed in the house. Comm. Hoard asked if there were people in the house. Acting Chief Dorman responded that yes, there were and they were alerted. BOARD OF FIRE COMMISSIONERS DECEMBER 14, 2010 PAGE 4 B. Fire Prevention Bureau Reports: (see complete written report in the Minute Book). Deputy Chief Tom Parsons offered highlights of his report and answered questions as follows: It was a busy month with inspections and fire alarm work. There were 2 fire investigations and 4 Pub Ed's in November. Child safety seat installations have been slow which is normal in the winter months. The box alarm project is taking longer than anticipated. The deadline has been moved to January 20, 2010 for users of the old system. County Fire Advisory Board — The Chiefs Association passed a resolution to revisit the Charter to re- establish the Board. There is an interest to keep it the way it was intended. Chair Gilligan stated that he would like to gather additional information and also have the BOFC provide input on this to the County. C. Fire Police Report: No formal report. Training is scheduled for next week. Dave Cornelius asked if there are radios available. Acting Chief Dorman stated that as of this meeting, AC Dan Tier is gathering 6 radios and they should be ready by tomorrow morning. IX. Old Business: Traffic Calming Devices — Acting Chief Dorman asked what the response of BPW was. Chair Gilligan stated that there has not been a response yet. Old Alarm Bell at Thompson Park on Cayuga St.: Acting Chief Dorman stated that it is on park land and that perhaps they could maintain it. But, if the Vets are looking for something different, he can go to the Parks Commission and present a proposal. He asked Ray Wheaton to let him know what the Vets would like to do. BOARD OF FIRE COMMISSIONERS DECEMBER 14, 2010 PAGE 5 City Charter: Chair Gilligan stated that the BOFC could initiate the role of the Board. The Mayor supersedes the responsibility of the Board. There needs to be a comprehensive look at the roles. Acting Chief Dorman stated that this could be the time to look at the Boards role in this day and time. Liaison Clairborne stated that Common Council member Maria Coles may be some one to contact on this and that if there are any specific issues that he could bring them to Council and the Charter Review Committee headed by Alderperson Dan Cogan. Guidelines for use of the Donation Fund: Acting Chief Dorman thinks that the guidelines may be in writing some where. But, he was not sure where to find them. X. We also are working with IPD, the Attorney's Office and the Mayor on continuing problems with the 911 Center. 4) Grants and Donations a) Assistance to Firefighter Grants (AFG): All of the paperwork to receive this grant for in- vehicle repeaters is filed. We are awaiting transfer of the money. We will be preparing a specification for bid.. Thomas Dorman, Acting Fire Chief Ithaca Board of Fire Commissioners 5 January 2011 Report to Common Council 1. Fire Department Staffing: As reported before, 1 Lieutenant has retired, 2 Fire Fighters retired in December, 1 Fire Fighter was granted a Performance of Duty Retirements, and the Chief position remains vacant (it is funded for '/z of 2011; Chief Donnan will retire in November). Chief Dorman advised the Board of Fire Commissioners that the Department is getting close to having overtime issues. b. Department Staff met with the Vacancy Review Committee on December 13 to request the hiring of 2 Fire Fighters. Chief Dorman expressed optimism that the Department will be permitted to hire 2 Fire Fighters in February for training. c. There are 5 transfer candidates from other municipalities for the Fire Fighter positions. Human Resources will be canvassing this list as well as the list from the exam given last year. 2. 2010 Budget Status. Chief Dorman reported that, as of the end of November, the account balances for the Department looked "pretty good ". Wood and South Street Traffic Calming Devices. Ithaca, NY 14850 -8745 607 - 272 -2560 1/11/11 Board of Fire Commissioners 310W Green St Ithaca, NY 14850 Dear Board members, With the recent vandalism and on going deterioration of and to the old fire bell located in Thompson Park, I'd like to ask the Board to consider the following proposal. The Vet's would like to see the bell moved to our facility on Elmira Rd. We are in the process of constructing a small area around the flag poles to be a memorial area. The bell would add greatly to it. The Vet's would arrange for and take care of transportation of the bell. With the bell at our facility it would still be on display for all to see. Maintenance would be a lot easier and provided by us. Please let me know what the process is to be able to make this happen. Thank you for your consideration in this matter. The department presented 1,226 hours of In- Service Training. The officers and MTO of the department presented over 583 training sessions in over 128 topics in house. All full time line personnel except one that was on administrative leave met the 100 hour standard required by municipal law. Training from outside of our organization offers new knowledge and networking experiences. We continued a strong commitment to this in 2010. Our members attended 2,307 hours of training outside of their in- service 100 hours. These sessions where held at the NYS Fire Academy, National Fire Academy, and other trade conferences around the country. Current practice:A detailed accounting of the distribution of 2% funds,a report of the Active Firemen's relief Fund and the Veteran Volunteer Firemen's Relief Fund is submitted to the Board by the Chamberlain's Office.The Chamberlain controls the disposition and disbursement of these relief funds upon the recommendation of the Board.lt was assumed by the Board that this report was also made available to both the Mayor's Office as well as Common Council.it may well be that a memo to the Chamberlains office directing copies of this report be made available to both the Mayor and Common Council as well as the Board be sufficient to satisfy the Charters intent. (4)- Article VI- BFC - §96- paragraph G(section (2) Para.G (section 2) -Said Board of Fire Commissioners shall also pay to the Veteran Volunteer Firemen's Association of Ithaca on March 1 and September 1 of each year % of all monies received by the City of Ithaca pursuant to the provisions of §9104 of the Insurance law of the State of New York (2% funds].... Current practice:Funds are distributed by the Board as soon as received from the Chamberlains office all at once.The exact date of disbursement is dictated by the issuance of the funds by the Chamberlain and have varied between the months of July to as late as Septmber.The Chamberlains office in turn is dependent on release by the State of MY and the Town of Ithaca.Any delay from any of the entities mean's that the Board cannot meet any statuatory date.(For example -The Town of Ithaca's 2007 2% disbursement did not take place until January 2008 due to a contract dispute). (5)- Article VI- BFC - §96- paragraph H Para, H -To divide the employees of the Department into platoons and proscribe the tours of duty.... Current practice:The Ithaca Fire Department is a Combination Department and career personnel are governed by Civil Service law,union contract and Department Regulations.The Board has very limited authority(if any) as to management ofpersonnel.The Board can make recommendations. All such persons as are now or shall hereafter-be members.of any fire company now organized An the City of Ithaca or which may hereafter be organized by the Board of Fire Commissioners herein provided shall be -and continue a body corporate by the name of the "Ithaca Fire Department," and such corporation, through its Board of Fire Commissioners is authorized t purchase, receive by gift or.otherwpe hold 'and convey real and personal property for the use of said corporation, provided, however, that the title of all real property shall be vested in the name of the City of Ithaca and the purchase or conveyance of any real property shall be subject to the approval of the Common Council of said° city. § C -94. Membership, terms and compensation of Board. [Amended 12 -7 -1987 by L.L. No. 6- 1987EN(1)] There shall be a Board of Fire Commissioners, consisting of five Commissioners appointed by the Mayor and confirmed by the Common Council. At least three of these Commissioners shall be residents of the City Of Ithaca. The remaining Fire Commissioners may be residents of either the City of Ithaca or the Town of Ithaca in Tompkins County, New York. The term of office of a Fire Commissioner shall be three years, commencing on the first day of July, two commissioners to be appointed in each of two successive years and one commissioner to be appointed in the third year. Such appointments shall be made at a meeting of the Common Council held in June of each year. A Commissioner shall hold office until the Commissioner's successor shall have been chosen and qualified, A vacancy for an unexpired term maybe filled in the manner provided in this Charter. Permanent removal from the municipality of appointment, or other cause to be determined by the Common Council, rendering impossible the proper discharge of the Commissioner's duties as a Commissioner shall create a vacancy. The Commissioners now in office shall.continue until the expiration of the term for which they were respectively appointed. C -95. Organization and meetings of Board. [Amended 12 -7 -1987 by L.L. No. 6 -1987] At their first meeting in July, the Fire Commissioners shall organize as a Board by electing one of their number as Chairperson and another as Vice Chairperson, and by the appointment of a Clerk and such other officers and employees as authorized for the ensuing year. The Board shall hold such stated and special meetings at such times as the Board may determine, but at least once in each month. Three members of the Board shall constitute a quorum. § C-96. To assume control and management of all apparatus, fire alarm systems, equipment, appliances, supplies, buildings and employees exclusively in the Fire Department service.EN(2) B. To organize new companies and to disband any Department company, subject to the approval of the Common Council; to admit new members and to transfer members, upon application and certification of company officers, from one company to another, and to.try, reprimand, suspend or expel any member or officer of any company for cause. [Amended 7 -10 -1985 by L.L. No. 1 -19851 C. To authorize and direct the payment of bills and accounts incurred by it and to make such rules and regulations in regards to the auditing and payment of such bills and accounts and for the payment of all amounts payable out of the 'moneys appropriated to the use of the Board as it may deem necessary and proper, and the same shall be paid by the City j Chamberlain. The Board shall file monthly with'the Common Council a detailed statement of all bills and expenses paid, toge"r with the original vouchers therefor, and shall render to the Common Council at such-other times as may be required either by the Mayor or by the Common Council an itemized statement of all its receipts and disbursements properly classified and showing the balance on hand at the beginning and at the close of the period covered; and at the close of each fiscal year, it shall submit an annual statement showing by suitable summaries the expenses and income of the Department. Whenever requested by either the Mayor or the Common Council, the Board shall also furnish any additional information in regard to its work or the cost thereof. D. To submit to the Common Council, on or before the first day of M in each year, an. estimate of the amount of money necessary to cover the expenses of- maintenance of the Department, including all salaries and wages, equipment and supplies and for the maintenance, heating, lighting and ordinary repairs of buildings. E. To make and promulgate from time to time such rules, regulations and bylaws as it may deem necessary and expedient for the government and discipline of the Department not inconsistent with this Charter or the ordinances of the City of Ithaca or of the laws or Constitution of this state or of the United States. F. To be trustees of all moneys now constituting the Active Firemen's Relief Fund, together with 1/2 of all moneys that may hereafter be received by the City of Ithaca as a Fire Department tax on premiums on policies of foreign and alien fire insurance companies pursuant to §§ 9104 and 9105 of the Insurance Law (except the amount payable under the provisions of such law to the Firemen's Association of the State..of New York), together with any other moneys, gifts or property whatsoever acquired for relief or benefit purposes, to be accumulated as a relief fund for sick, indigent or disabled fire fighters, with power to draw upon such fund for temporary relief and benefits only, as said Board shall determine. Said moneys shall not be used for any other purposes, except that the Board may, at any time, distribute such Fire Department tax moneys so received equally among each of the volunteer fire companies of the city for the use and benefit of the Ithaca Fire Department and the . company or companies comprising the same.so long as the balance of said relief fund shall be at least the sum of $90,000. Said Board shall have full power and authority to invest such funds in any investments legal for trust funds under the laws of the State of New York. To be trustees of all moneys now constituting the Veteran Volunteer Firemen's Relief Fund and to pay the interest thereon- to the Veteran Volunteer Firemen's Association of Ithaca annually. (1), Said Board is further authorized to pay from the principal of such fund from time to time such amounts as it may deem necessary or desirable for the relief of any sick, indigent or disabled member cif the Veteran Volunteer Firemen's Association of Ithaca, but the total amount so paid to any one. member shall not exceed the sum of $200. Such expenditures from principal shall be made, however, only upon the written recommendation of the Board of Trustees and President of`said Association. Said Veteran Volunteer Firemen's Association of Ithaca is hereby authorized to adopt any further regulation or restriction relating to the expenditure of the principal of such fund not inconsistent herewith as if may deem desirable for the preservation of the fund and for the purpose of limiting properly the amount to be withdrawn and the use thereof. (2) Said Board of Fire Commissioners shall also pay to the Veteran Volunteer Firemen's -Association of Ithaca on March 1 and September 1 of each year 1/2 of all moneys received by the City of Ithaca pursuant to the provisions of § 9104 of the Insurance Law of the State of New York as a Fire Department Tax on premiums on policies on foreign and alien fire insurance companies, except the amount payable under the provisions of such law to the Firemen's Association of the State of New York. H. To divide the employees of the Fire Department into platoons and prescribe the tours of duty for said employees. Stich tours of duty shall be in accordance with § 1015 of the Unconsolidated Laws, except that, in the event of conflagrations or riots or. other emergencies, said employees shall remain on.duty, subject to the orders of their superiors, and shall receive an extra allowance based on their salary if they are required to perform their-duties during such period of emergency at a time when they usually would be off duty or receive compensatory time off as provided in § 1015 of the Unconsolidated Laws.EN(5) § C -97. Limitation of expenditures. Said Board -of Fire Commissioners shall in no year expend a sum or incur any indebtedness in excess of -the amounts appropriated by the Common Council for the use of said Fire Department and the amounts made available pursuant to the Local Finance Law, and such Commissioners shall b.e personally liable for any expenditure or indebtedness incurred In excess of such appropriations. 3 a, I Cztyt o Ithaca P�fCodeb�Qlr, for LTrindo�s § C -98. Fire Chief and other personnel. [Amended 7 -10 -1985 by L.L. No. 1 -1985] The head of the Ithaca Fire Department shall be the Fire Chief. The Fire Chief shall be appointed and removable in the manner. provided in § C -26 of this Charter. The Board of Fire Commissioners shall prescribe the duties of the Fire Chief There shall be within the Department such deputy, assistant and other employee positions as, in the judgment of the Board, are, necessary and. authorized by the Common Council. The Fire Chief shall appoint all deputies, assistants and other employees of the Department for indefinite terms, subject to discipline and dismissal in accordance with the Civil Service Law. The Fire Chief shall fix the compensation and prescribe the duties of such deputies, assistants and other employees, subject to the approval of -the Board and in accordance with any compensation plan and related rules established by the Common Council. Any member of the Ithaca Fire Department who is appointed Fire Chief, Deputy Chief or Assistant Chief shall case to be an active member of any company of the Department. § C -99. Hello Willis Sheldon,Training Officer at Ithaca Fire, 310 W. Green St. Raymond Wheaton and myself. Lyman Baker, work 100 hours each, a year maintaining the Firemen's Memorial in the Ithaca City cemetery. We have been doing this for the last 12 years, plus. Using our own equipment, gasoline & oil, and making repairs when necessary at no cost to the Ithaca Fire Department. Fire Chief Brian Wilbur approved the work for Ray & I and the 100 each per year. Ray and I would like the Ithaca Board of Fire Commissioners to know of our volunteer hours, like the newly formed Fire Police each month. Also you can track the hours for budget purposes maybe ? Thanks, October 13, 2010 Lyman Baker IFD Badge #3258 74 Mary St. Ithaca, NY 14850 -5100 607 -272 -6274 Boarrd of Fire Commissioners Report to Ithaca Town Board January 10, 2011 The following is a summary of the Board of Fire Commissioners quarterly report to the Ithaca Town Board: • Included with this report are: the Fire Chief's Report for the December 14, 2010 BFC meeting, Fire Marshal's Report, and the IFD Revenue /Expense Report for November (YTD). The department call activity reports for 2010 were distributed separately. • Fire Department Staffing (December 2010) a. 1 Lieutenant retired in November, 2 Fire Fighters retired in December, 1 Fire Fighter was granted a Performance of Duty Retirement, and the Chief position remains vacant (it is funded for %2 of 2011; Chief Dorman will retire in November). There is a national search to fill the Chief's position — the applications will be reviewed in January to determine the eligible pool of candidates for the search committee to review for a recommendation to the Mayor. It is expected that an additional fire fighter will be on a leave of absence for at least a year, beginning in February or March of 2011. Chief Dorman advised the Board of Fire Commissioners that the Department is getting close to having overtime issues. b. Department Staff met with the Vacancy Review Committee on December 13 to request the hiring of 2 Fire Fighters. Chief Dorman expressed optimism that the Department will be permitted to hire 2 Fire Fighters in February in time for them to receive training at the Fire Academy. c. There are 5 transfer candidates from other municipalities for the Fire Fighter positions. Human Resources will be canvassing this group as well as the list from the exam given last year. • Budget Status 2010 — Chief Dorman reported that the Budget Expenditures for 2010 were in "pretty good shape" and on track for the year ending December 31, 2010 (see YTD Revenue /Expense Report). • Fire Police Activity: The volunteer Fire Police unit continues to develop and meets monthly for training They are available for traffic control at the scene of fire or traffic incidents. Members of this unit are interested in recruiting new volunteers to serve. Items in progress: • Traffic calming device remediation. — The Board of Fire Commissioners has written to the BPW requesting they review and hopefully modify the traffic calming devices located on Wood and South Street. A formal response has not been received to this request. • Charter Review- the Board is working on meeting with the City's Charter review committee to discuss issues with the current city charter's description of the Board of Fire Commissioners duties and responsibilities. • Resource recovery — no action.
