IV. Additions to or Deletions From the Agenda: There were no additions to or deletions from the agenda. V. Persons Wishing to Speak to the Board of Fire Commissioners: Commissioner Lyman asked Chief Parsons and the rest of the Board a question regarding the creation of an office at the fire department in 1998 that included a computer, fire gear, etc. for the fireman's association. Chair Gilligan responded that question would be answered during the discussion of "old business" later in today's meeting. Dave Cornelius requested permission to address the Board later in the meeting in follow -up to the Board's special meeting on June 21, 2012. Commissioner McGonigal arrived at the meeting at 1610 hours. VI. Correspondence: Chair Gilligan reported that as of June 30, 2012 the rescue squad donation fund balance was $1,840.32, with a deposit of .50 bringing the total balance to $1,840.83. Chair Gilligan reported that the bank statement from the Tompkins Trust Company Donation Fund dated June 30, 2012 had a beginning balance of $958.51 and an ending balance of $958.51 reflecting no activity. Board of Fire Commissioners Meeting July 10, 2012 Page 3 Chair Gilligan noted that he received the roster from Company 4 that shows current company membership. He will distribute that information to other Board members, and incorporate the listing into the active volunteer members listing. VII. Membership Changes: There have been no changes in membership. VIII. Miscellaneous Reports: A. Town of Ithaca: Chair Gilligan stated that he would provide a quarterly report to the Town of Ithaca on August 13, 2012. B. City of Ithaca: Commissioner Hoard had no report. C. Audit: Commissioner Ellsworth completed the audit. IX. DEPARTMENT REPORTS: Chief Parsons reported that he would provide a copy of his written report to Board members. He reported that the three new recruits completed their firefighter training and has now been assigned to shifts. They will need to return to the training academy, in the future, for codes training. Interviews for the Deputy Fire Chief Position are taking place with a decision to be made in August. The Administrative Coordinator position was offered to June Overslaugh - Hodge, who currently works at GIAC. She has accepted the position and will start late July. The draft 2013 Fire Department budget was submitted on July 1St that showed a 10% reduction in personnel lines and 1% reduction in non - personnel lines. Chief Parsons is waiting for feedback from the Mayor and Common Council. He will need to have a special meeting with the Board — maybe the last week of July to review the department's final budget prior to its submission due date of August 1St The 2013 proposed budget does not include any requests for capital projects. The replacement heavy rescue vehicle and heavy pumper vehicle are ordered and should arrive in 2014. The new pumper aerial vehicle has been ordered and should be delivered in June 2013. Tompkins County hired a consultant to examine the operations of the county's 9 -1 -1 Center, and a final report is due to Tompkins County at the end of the summer. The Board has been provided with statistics for the first six months of 2012. The call volume is down, may be made up in the Fall, but probably will be somewhere less than 500,000 calls for 2012 (25% Town of Ithaca /75% City of Ithaca). Board of Fire Commissioners Meeting July 10, 2012 Page 4 The mutual aid training report was provided to the Board as well as the listing of volunteer hours. X. OLD BUSINESS: Follow -up Discussion from June 21, 2012 Special Meeting: Chair Gilligan explained that the Board needs to determine the organization of the current volunteer structure and issues related to the 2% money. He explained that a chart had been distributed prior to the special meeting on June 21 St to Board members regarding the distribution of the 2% money, and the timing in which it needs to be distributed. He has not heard back from the City Chamberlain to clarify the status of the funding from the §9104 money to the veteran firemen. He noted that the distribution of the money under State Insurance Law §9104 and §9105 states that one half of the money from §9104 should be distributed to the firemen's association on March 1St and September 1St, and the other half to the sick and indigent fund. Half the money from §9105 fund should go to the sick and indigent funds, and it does not specify how the other half of the fund should be distributed — although in the past it has gone to the firemen's fund. He noted that the Board's focus should be what the organization of the volunteer fire companies will look like in the future. He is not sure what the timing is as far as how rapid a decision needs to be made regarding the status of the volunteer companies, and the distribution of the 2% funds. It is the intent of the Board to pass the money on to the veteran companies as soon as possible. They should get one -half of the §9104 money as soon as possible, which is different than what has been done in the past. He further noted that the City Attorney's office provided a flow chart for the Board for today's meeting showing how the funds should be distributed, which will be made available to those who want a copy after the meeting. Dave Cornelius noted that the City of Ithaca Charter does not talk about the §9104 and §9105 monies —just that the Board of Fire Commissioners is responsible for the distribution of the funds to the volunteer companies. Discussion followed on the floor regarding how and when the money from both the §9104 and §9105 funds needs to be distributed. There was also discussion on the former VanOrman /Slade lawsuit, and the fact that in 1988, the former city attorney did not pick up on a problem with the distribution of the funds, and now there is a problem. City Attorney Lavine made it clear to the Board and those present that "there is no hidden agenda" here. He'd be happy to check back into that issue further and confirm for the Board. He reminded the Board of the fact that they need to work on the organization of the volunteer companies going forward. Concern was voiced about the reduction of 25% in distribution of funds to the veteran companies, which would result in their not being able to keep their doors open. They would no longer have the funds to pay rent, taxes, water and sewer bills, and utilities, and the volunteer companies contribute a great service to the City of Ithaca, and their community. Board of Fire Commissioners Meeting July 10, 2012 Page 5 Chair Gilligan asked what the legal issues are surrounding the distribution of the funds as the Board will need to make a decision by August /September as to how the funds will be distributed. He outlined the following options to consider regarding the volunteer companies: Leave the current companies as they are 2. Look at all the companies and their structure — dissolve those not providing active service 3. Dissolve all the companies and create one active company The Board needs to make a decision, and would be hard pressed if nothing were done, given the intent of the funds to provide support to those providing active fire service to the community. What is active service? Who are active members, and the fact that there are 16 -20 individuals distributed amongst eight volunteer companies? The Board needs to come up with a proposal, which will be reviewed by Common Council, as the Board cannot dissolve the companies without Common Council approval. In these difficult financial times, the Fire Chief would like to increase the volunteer structure in the companies; however, he has a real concern regarding dissolving companies, determining who would be members of the new company, and who would handle the administrative work to set up the companies. Previously, there had been a volunteer coordinator at the fire department, but that position was eliminated. In addition, the organization of the companies pre -dates the establishment of the Board of Fire Commissioners. Dave Cornelius stated that the volunteer companies saw a concerted effort on the part of the prior administration at IFD, and by the Mayor, and Common Council to force volunteer companies out of existence. He explained how volunteers were turned away in the past. Chief Parsons noted that it is not his intent to repeat history. He then provided a brief history of volunteer companies starting in the 1980's where most volunteers were in the fire department's bunker program, with no requirements to join a company. That history is done, and today there is real concern, and there was a question earlier this year, of who are the members of the volunteer fire companies — legally? There was no membership listing, some volunteers were social members in one company, and active members in other companies, the question arose as to what is a member? What if no service is provided by the company? It used to be that it took 20 years to become a member of the volunteer veteran company, now it's down to 5 years. The State insurance money is allocated for active members, and should be used by active members. We need to separate what we have versus what we had, and realize that the City needs the support of these volunteers during emergencies. He noted that the City Attorney took a look, in a practical way, of the current structure of the volunteer Board of Fire Commissioners Meeting July 10, 2012 Page 6 companies, and provided a recommendation for the future. The question now is, where is the cut -off to decide what company survives? It would be in the best interests of the fire department, the City of Ithaca, and the Town of Ithaca to come together as one active volunteer force. The current volunteer members will be the ones to organize the new company, administer it, and the State insurance 2% money. There is a need for an efficient company, and it is too difficult to pick and choose what company survives. He would like to start over, and build something that will last. He praised the work of all the current volunteers for their work, dedication, loyalty, and efforts to preserve the important history of each company. He stressed that the City needs all the current volunteers, as well as new, young, active members, and the way to attract those new members is by utilizing all our current members in that effort. Commissioner McGonigal stated that the volunteer companies need more new volunteers, and young volunteers. He also noted that there is no clear evidence that the current structure of the volunteer companies wouldn't be able to work, if the Ithaca Fire Department actively recruited and provided training to new members of those companies. He is reluctant to let go of all the history of the individual companies, and would like to see how encouraging recruitment of new, young members into current companies would work. Dave Cornelius stated that he is not sure about the effectiveness of reorganizing the current companies. He is more inclined to look at the creation of one active company. However, he is not sure where the divide would be or if there would need to be one between fire /police volunteers, interior fire fighting volunteers, etc. The mix of the history of the various companies by those members into one company would help to maintain it as well. He is not sure if companies will be able to recruit the volunteers, and noted that it is very difficult for the Ithaca Fire Department to cut 10% in personnel lines as well since it answers so many calls, and the addition of new volunteers would provide support for the fire department, as needed. Chief Parsons responded that the fire department is working on a plan for its continued operation, with the proposed budget cuts 2013 in mind. He stated that it is just incidental that the discussion regarding the 2% monies and the volunteer fire companies is occurring at the same time. The budget issue is a separate, city - government issue, where there will be smaller resources available to respond to greater demands for service. There needs to be a change in the structure of the department to make it as efficient as possible as a result of the proposed budget cuts. There is a strong desire, and need, by the City to make current volunteer companies into one active and successful company. Dave Cornelius had a question about the proposed disbanding of current companies, who would no longer be affiliated as a company with the Ithaca Fire Department, and whether or not a company could still function, socially, as a recognized volunteer fire company under the New York State Tax law. Board of Fire Commissioners Meeting July 10, 2012 Page 7 City Attorney Lavine reiterated the Chief's comment that the city's budget operates independently to this decision. The Board should focus on the volunteer fire company issues, and the potential to reorganize them into one active company. He stated that proposal makes good sense functionally and has real legal impacts. There has been no information provided to show that the current companies are operating legally, and with active members. There has been no information that the eight companies have any active members either. The Board needs to choose an option that is in compliance with the law, as well as meeting the needs of the Fire Department and the services it provides to the City and Town of Ithaca. In addition, 55% of the active members need to reside within the City or Town of Ithaca, and there has been no information provided to show compliance in that regard. A question was raised as to whether the 55% figure means either working or living in the Town or City of Ithaca or just residency. City Attorney Lavine responded that the wording in the law is 55% residency, not working in either municipality. All the volunteer companies are located in the City, and when they were incorporated they were all made part of the Ithaca Fire Department, which does have authority to disband a company. Jack Bordoni noted that the Board should also consider that not all volunteer members would be able to leave work to respond to a call. Also, does the department have money for training and equipment for volunteers, as the proposed budget documents do not seem to allocate funds for that? Commissioner Ellsworth noted that in the 2013 proposed budget, professional fire fighters are being laid off, so bringing in volunteer fire fighters that will need training and equipment will affect an already strained budget. Chief Parsons responded that career fire fighters in the department will not be replaced by volunteers, but volunteers would be used to supplement fire fighters that remain. He noted that current training at the county level has improved, and that county resources can be used to train volunteer members, and provide gear and equipment for them. He stated that if five to ten new members could be recruited that it would probably work well for the money and training in place currently. Chief Parsons stated that he is interested in recruiting high school students into "apprenticeships" who may have a longer interest in the community rather than college students in a bunker program. The City probably can't afford a bunker program right now, but it could an apprenticeship program. He would also like to see educational scholarship incentives offered to high school students as well. He noted that training could be provided evenings and weekends to accommodate student schedules. Ray Wheaton stated that companies disbanding piecemeal would be a poor way to do it. There are very real legal issues now with companies not being in compliance with the law, and members of the volunteer companies need to accept that. He would like current members of the volunteer companies to look at other ways to meet the social aspect of the company, if they disband. He noted that most members of the Ithaca Fire Board of Fire Commissioners Meeting July 10, 2012 Page 8 Department are already volunteer company members. He encouraged the Board to consider letting the volunteer companies keep what money they have to use for whatever purpose it may be needed for. Commissioner Ellsworth questioned — legally, if the volunteer companies have 2% money left over, what can it be used for? City Attorney Lavine responded that he would need to review that, and then would provide information to the Board. Commissioner Hoard questioned those present whether they felt there is a willingness to disband and form one active, single company? He stated that it is sort of like the military where everyone is on the same team, so to speak. Would members be willing to disband, form one company and go on from there? Would that work or not? Dave Cornelius responded that every member works as a unit in the field even though they may be from more than one company. Some members who are not active do play supporting roles as far as treasurer, secretary, cook, and performing administrative type work. He stated that as long as the social aspect of a company can be met with the consolidation into one company it should work fine. They could do fund raisers for the purchase of equipment. He questioned that if the companies were no longer part of the Ithaca Fire Department would there be liability problems? Chair Gilligan responded that the City Attorney will look into whether the funds already distributed or raised by a company can be retained. John Pirko stated that he is 87 years old, and spent 67 years in the fire company. He explained how volunteers responded in the past to situations with limited equipment, but that it worked, and company members got along. He would like to see the history of the companies preserved. He also understands the City's budget pressures, volunteers' loyalty to the fire department and to their community. He noted that the companies do not have a lot of funds, but somehow they have made it work. Commissioner McGonigal stated that he is impressed with everyone here trying to do the best for the City and the many volunteer companies. He wondered whether it would be possible to combine the 8 companies into one rather than disband them all, and call it company 36. Ray Wheaton stated that combining the eight companies into one company is a grand idea; however, there are inactive or social members to deal with. If the companies are not consolidated into one, can they remain independent, and do fund raising events to maintain the social aspect of the company? Marcia Lynch, the former volunteer coordinator at the fire department, stated that she knows first hand how much work goes into recruitment efforts and training. Setting up one super company won't automatically trigger a rush of young volunteers. There has to be a clear decision made that there will be money, and personnel time dedicated to provide support for the volunteer fire company. Board of Fire Commissioners Meeting July 10, 2012 Page 9 Chair Gilligan stated that there will be a significant amount of administrative effort, not related to fire fighting, needed. He is not sure, with the proposed budget reduction at the Ithaca Fire Department, whether there will be staff to provide the requirement support for the recruitment and administrative oversight of new volunteer members. He wants to have something in place on the other side of any decision to disband a company or companies to make the new plan /program work. City Attorney Lavine stated that there is no reason the resolution written to disband the companies couldn't also include the creation of one new company as well. He will also look into what happens to the money that the different companies may have in their accounts, should a company disband. Chair Gilligan stated that the next regular meeting of the Board of Fire Commissioners will be Tuesday, August 14, 2012 at 4:00 p.m. at Central Fire Station. He further confirmed that the Board will need to consider various scenarios regarding the volunteers companies, as outlined above, including slow versus fast transition of companies into one large company. He is not sure if Board members have made a decision yet, and noted that this discussion will need to continue before the next regular meeting, including discussion of the 2% money rules. He noted that there may be a need for a special meeting. Fire /Police Report: Dave Cornelius reported that there was training in June. There have been a couple of calls in the last couple of weeks. They assisted with traffic control at Buttermilk Falls during a gorge rescue. They also provided traffic control during the fire works on July 2nd for 6 hours. They have now been assigned to shift. d) Vacancies: • Deputy Fire Chief. I will be interviewing Deputy Fire Chief Candidates later this month. After interviews, a decision on appointment will be made in August. • Administrative Coordinator: I have offered the Administrative Coordinator Position to June Overslaugh who currently is an Administrative Coordinator at GIAC. June will be starting with the Fire Department on or about July 23`d, 2012 2) Budget Status a) A budget Status Report: A draft of the Budget was submitted to the Mayor on July 2nd, 2012. I'm waiting feedback on the draft, before I begin work in finalizing the budget. We will need to schedule a Special Meeting of the Board of Fire Commissioners to review the Budget Submittal. As requested by the Mayor drafted a budget that cuts 10% of personnel costs and 1% non - personnel costs from the approved 2012 budget. The preliminary estimates are that our personnel lines in the budget will be cut nearly $500,000, with additional increases of $300,000, due to raises and step increases, that will also need to be absorbed into the budget reductions. b) Capital Budget — The new Pumper /Aerial Truck has been ordered. We are expecting delivery in June of 2013. 3) County Communications and 911 Program: a) The consultant hired by Tompkins County who is reviewing the 911 Center Operations, is developing his final report and will be submitting it to Tompkins County later this summer. 4) Grants and Donations a) Training Center Project Funding: No Report 5) Resource Recovery Legislation No New Report - The City and Administration Committee of Common Council has voted to send this proposal to the Budget Review committee. There were 9 complaints forwarded to the City of Ithaca Building Department. There were 23 complaints closed out, and 30 complaints remain open since January 1St 2012. The Code Enforcement Division performed 195 fire safety and property maintenance inspections or re- inspections. The Code Enforcement Division issued: 30 Operating Permits for Assembly Occupancies; 15 Fire Alarm Certificates of Compliance; 3 Fire Sprinkler System Certificate of Compliance; 1 Fire Pump Certificate of Compliance; 3 Operating Permit for Hazardous Occupancy; and 29 Certificates of Compliance for Fire and Property Maintenance Inspections for May and June of 2012. Fire Investigation Unit: There were two fire investigations performed in June for a structure fires at 323 Elmira Rd, and 301 Eddy St. in the City of Ithaca.
