CALL TO ORDER:
Chair Gilligan called to meeting to order at 1608 hours.
APPROVAL OF MINUTES:
A. Approval of the September 18, 2012 Board of Fire Commissioners Meeting
Minutes — Resolution
By Commissioner Baker: Seconded by Commissioner Hoard
RESOLVED, That the minutes of the September 18, 2012 Board of Fire Commissioners
Meeting be approved with noted corrections.
Carried Unanimously
ADDITIONS TO OR DELETIONS FROM THE AGENDA:
Chair Gilligan requested the addition of the following items to the agenda:
A. Discussion of a possible special meeting of the Board to discuss the fire
department's proposed 2013 budget, prior to department presentation of the budget to
Common Council and the Mayor on October 16`"
B. Possible Executive Session to Discuss a Personnel Issue Regarding
Membership Changes.
C. Discussion of possible presentation of certificates to volunteers no longer in the
fire department for the many years of dedicated service to the community.
No Board Member objected.

PERSONS WISHING TO SPEAK TO THE BOARD OF FIRE COMMISSIONERS:
Commissioner Baker read the following statement for the record:
I have received several calls to my home regarding exempt and /or honorably
discharge status.
The folks calling were upset the way volunteer company members are being
swept under the table (so to speak) by the Ithaca Board of Fire Commissioners and the
Fire Chief.
New York General Municipal Law — Article 19, Section 200 "Defining
Qualifications of Exempt Volunteer Firemen and New York General Municipal Law
Section 202 Certificate to be issued to exempt volunteer firemen."
It is up to the volunteer companies to issue exempt certificates, and be signed by
the volunteer company president, captain, foremen, or secretary. Then the certificate
needs to be attested to by a Notary Public.
If your volunteer company does not have enough members to have officers, then
you need to transfer to another volunteer company right away, so that an exempt
certificate and /or honorably discharge can be signed.
I hope this has helped in a very difficult situation.

Bob Romanowski, addressed the Board with a question as to if the volunteer fire
company is dissolved, what happens to the uniforms of its members with the company's
insignia on them?
Chair Gilligan responded that he would ask the City Attorney that question. He stated, in
his opinion, nothing happens. The uniforms can be worn as they are not the official
uniform of the fire department.
Jack Gould requested that the Board consider presenting certificates of thanks to former
members of the volunteer companies that will not be members of the new active
company for their years of service (some have volunteered for 40 -60 years).
Chair Gilligan asked if the certificates would be in addition to the honorable discharge
certificates, and Mr. Gould responded yes.
V. Correspondence:
Chair Gilligan reported that the bank statement from the Tompkins Trust Company
Donation Fund dated September 1, 2012 had a beginning balance of $1,058.51 and an
ending balance of $1,058.51 reflecting no activity as of September 30, 2012.
Chair Gilligan further reported that the Rescue Squad Donation fund's quarterly bank
statement dated July 1, 2012 had a beginning balance of $1,840.83, it earned .44
interest, which brought the balance as of September 30, 2012 to $1841.27.

Chair Gilligan reported that Ray Wheaton and Lyman Baker each donated 6 hours to
the maintenance of the Ithaca Fire Department Cemetery Plot in September 2012.
He further reported that Ray Canzler submitted his report for hours donated to assist in
the Ithaca 5 and 10K Race.
MEMBERSHIP CHANGES:
Chair Gilligan reported, to follow -up on the September 18th resolution that the Board
approved, that transfer requests were received for all 14 eligible members for
membership in Neriton Company #9. Dan Maas was already a member of Neriton
Company #9. The following members requested transfer to Neriton Company #9:

Motion to Approve Transfer Requests as a Group — Resolution

members as requested to Neriton Company #9.

DEPARTMENT REPORTS:
A. Fire Police Unit Report:
Dave Cornelius provided the following report:
The Fire Police Unit and 2 of the 4 active interior /fire ground support volunteer
firefighters met on September 25th. All twelve members, present, signed requests to
transfer from their current companies to Company 9.
After the meeting John Powers worked with the Fire Police Unit to assure all of
our two way radios were working properly and that our pagers were set up correctly.
John also reviewed the operations of the 800 mhz radios.
B. Fire Chief's Report: Attached.
Chair Gilligan explained that the Mayor and Common Council will review the fire
department's budget on Tuesday, October 16, 2012 at 4:00 p.m. in Common Council
Chambers. He encouraged Board members to plan to attend that meeting. He further
stated that in the proposed 2013 fire department budget two fire fighters would be laid
off, and the fire prevention /codes division of the department would be transferred to the
Building Department.
Commissioner McGonigal stated that in the chief's budget information the cost for
workers' compensation has doubled in the past two years, which seems excessive —
even for New York State. He would like Chief Parsons to double check the total and
confirm with the Board that information.
OLD BUSINESS:
A. Update on 2013 IFD Budget Proposal:
Chair Gilligan proposed a special meeting of the Board to review the fire department's
proposed 2013 budget prior to the meeting with the Mayor and Common Council on
October 16th. Discussion followed on the floor regarding the date and time for a special
meeting. The Board determined that there would be a Special Meeting on Monday,
October 15th at 4:30 p.m. at Central Fire Station.
B. Resolution on Status of Volunteer Companies with No Active Members
Resolution — To Inactivate and dissociate Ithaca Volunteer Fire Companies with
no active members from the Ithaca Fire Department
WHEREAS, there currently are 8 volunteer Fire Companies, authorized by the City
Charter to operate under the oversight of the Ithaca Board of Fire Commissioners in
providing fire services as part of the Ithaca Fire Department, and

WHEREAS, per the City Charter — Section C -96. Powers and duties of Board, it is
the duty and responsibility of the Board of Fire Commissioners to organize new
companies and to disband any Department company, subject to the approval of the
Common Council...., and
WHEREAS, the Board of Fire Commissioners has acted to transfer all active volunteer
members of the Ithaca Fire Department, who are not already members of Neriton
Company #9 into said company, now, therefore be it
RESOLVED, That the following 7 volunteer companies, who no longer have active
members volunteering with the Ithaca Fire Department: Company 1 — Cayuga Hose
Company, Company 2 — Rescue Steamer & Chem, Company 3 — Tornado Hook and
Ladder, Company 4 — Eureka Patrol, Company 5 — Torrent Hose, Company 6 —
Sprague Steamer and Hose, and Company 7 — Cataract Hose will, upon approval of the
Common Council of the City of Ithaca, be inactivated and dissociated from the Ithaca
Fire Department as Volunteer Fire Companies, and are no longer to be considered part
of the Ithaca Fire Department; as such, these companies shall no longer be approved
by the Board of Fire Commissioners to recruit individuals to be active members of the
Ithaca Fire Department or to engage in the prevention and extinguishment of fires, and
be it further
RESOLVED, That any issues regarding 2% funds that were distributed previously to
these 7 Volunteer Companies, will be handled per law and regulation, as specified by
the N.Y. State Comptroller's Office if timely so specified, and be it further
RESOLVED, That the Board wishes to recognize the debt owed to those who are
currently members of these companies for their current and past service to their
Companies and to the Community, and it is with a profound sense of humility and
reluctance that the Board takes these actions, but it does so with the belief that these
changes will provide the greatest opportunity for enhancing and continuing the long
tradition of volunteer fire service to the community.
This resolution was moved By Commissioner Hoard: Seconded by Commissioner
McGonigal
Discussion of Resolution:
Chair Gilligan reported that once the Board approves the resolution, it would go to the
October City Administration Committee for review and recommendation to Common
Council at their November 7t" meeting.

Commission Baker noted that this is a very sad and emotional day for everyone
concerned.

Chair Gilligan noted that this action will not be effective until it is approved by Common
Council.
NEW BUSINESS:
A. Resolution authorizing the distribution of Foreign Fire Insurance Funds —
2% Funds - to the Ithaca Veteran Volunteer Firemen's Association
WHEREAS, the Board of Fire Commissioner is, per the Ithaca City Charter, responsible
for overseeing the distribution of the tax on premiums of foreign and alien fire insurance
companies (2% Funds) received annually by the City, and
WHEREAS, a portion of these funds are designated to be paid to the Veteran Volunteer
Firemen's Association of Ithaca ( IVVFA), and
WHEREAS, the Board has delayed the normal distribution of all 2% funds received by
the City in 2012 pending the reorganization of the volunteer company component of the
Ithaca Fire Department, and
WHEREAS, the portion of the funds due to the Ithaca Veteran Volunteer Firemen's
Association can be calculated and distributed separately from the remaining portion of
the 2% funds, now therefore be it,
RESOLVED, That the City Chamberlain is requested to calculate per City Charter and
applicable state regulations and laws, the portion of foreign fire insurance premium tax
(2% Funds), received by the Chamberlain's Office in 2012, that are owed to the IVVFA
and to disburse this amount to the IVVFA.
This resolution was moved By Commissioner Hoard: Seconded by Commissioner
Ellsworth
Bob Romanowski questioned with the resolution includes monies from the relief fund
because interest from that fund should be paid to the veteran volunteer association.
Chair Gilligan responded that he would ask the City Chamberlain to review the figures.
If there needs to be any adjustment the Board will take a second vote on a new
resolution.

B. Recognition of Volunteers Who Will Not Become Members of Neriton
Company #9
Discussion followed on the floor by the Board regarding the best way to recognize these
very worthy and special volunteers for their many years of service to the community.
Suggestions include certificates of honorable discharge, certificates of thanks, and an
ad in the Ithaca Journal.
Commissioner Baker noted that there have been 5,397 volunteer fire fighters in the City
of Ithaca and Town of Ithaca who have served their communities faithfully for the past
189 years.
Commissioner McGonigal noted that by taking a special ad out in the Ithaca Journal the
recognition of these very dedicated volunteers would be memorialized in history, even
though many past members may no longer live in the area. He also feels that individual
certificates are nice as well.
Other possibilities of recognizing the volunteers include the city website, and an article
in the City's newsletter. The Board would like to make a decision as to how to proceed
with this recognition by their November meeting.
C. Motion to Enter Into Executive Session to Discuss a Personnel Issue

On a motion the Board adjourned into executive session to discuss a personnel issue
regarding membership changes.
The Board reconvened at 1724 hours with no formal action taken.

Budget Status
October 8th, 2012
a) A budget Status Report: On October 3rd, 2012, the Mayor Myrick presented is
proposed budget to Common Council. The proposed budget eliminates 1
administrative assistant, and 4 fire fighter positions. Two of the four fire fighter
positions eliminated are through retirements, and the other two fire fighter
positions are through layoffs. The fire prevention bureau is eliminated and fire
inspection responsibilities are transferred to the Planning and Building
Department. The Mayor's budget also reduces funding by $21,000 in
administrative and program accounts. As a point of information, the Mayor also
proposes to add two new positions to the Planning and Building Department: a
Grant Writer, and a Housing Inspector.
b) Capital Budget — No Report.
County Communications and 911 Program:
a) The consultant hired by Tompkins County to review the 911 Center Operations
has sent his written report to the County. It is expected to be released to the
public very soon.

LIFE SAFETY DIVISION
Fire Prevention Bureau
1) Code Enforcement Division:
October 8th, 2012
The Codes Enforcement Division received 17 complaints for the month of September.
There were 12 complaints forwarded to the City of Ithaca Building Department and 2
complaints forwarded to the Town of Ithaca. There were 25 complaints closed out, and
39 complaints remain open since January 1St 2012. All of the complaints that remain
open are complaints referred to other agencies or departments.
The Code Enforcement Division performed 78 fire safety and property maintenance
inspections or re- inspections, witnessed 4 alternative fire protection system test,
witnessed 3 fire alarm test, and witnessed 4 fire sprinkler system tests
The Code Enforcement Division issued: 18 Operating Permits for Assembly
Occupancies; 1 Operating Permit for Hazardous Occupancy; 1 Operating Permit for
Fireworks, 3 Alternative Fire Protection Certificate of Compliance; 1 Fire Alarm
Certificate of Compliance; 1 Fire Sprinkler System Certificates of Compliance; and 11
Certificates of Compliance for Fire and Property Maintenance Inspections for September
2012.
2) Fire Investigation Unit:
The fire investigation team performed 2 fire investigations in September: Both
investigations were at Ithaca College. The first was for a fire in a student lounge at
Talcott Hall. The cause of the fire was incendiary. The second was for a fire in a
stairway at Terrace 10. The cause of the fire is undetermined at this time.
3) Public Education and Special Events:
There were 2 public education events, 1 special event, and 2 child car seat inspections
performed by the department in September.
