Buffalo Street I have reviewed the proposal to improve an existing parking space in the rear yard of 504 E. Buffalo Street and have determined that the work will not require an area variance. The proposed improvements are for one of two separate spaces located within the rear yard of the property. The Zoning Ordinance’s regulation that prohibits parking in the rear yard applies to new or enlarged parking areas of three or more cars and does not apply to a residential property with only two off-street parking spaces. Furthermore, this regulation was enacted in 2012, and the parking space in question has existed since at least 2002, as evidenced by aerial photography. The proposed work will bring the parking space back into compliance with §325-20D(2)(b), which requires that all parking spaces be clearly delineated from lawns, walkways, and other non-parking areas. On-site parking at 504 E. Buffalo Street must remain limited to two vehicles. If the applicant wishes to expand the parking area in the future to provide three or more spaces, site plan review and area variances will be required.
