Access Oversight Committee (AOC)

Present: chair Rich DePaolo, secretary Wayles Browne, vice chair Wies van Leuken, member Paul
Smith. Excused: City of Ithaca Common Council liaison Margherita Fabrizio. On Zoom: Sean Ryan
(Supervisor of Public Access, Charter Communications), Glenn Foster (studio manager), Lauren Kelly
(Director of Government Affairs – Fingerlakes Region, Charter Communications), member of the public
Martha Taranto.
01. Call to Order by DePaolo 5:02.
02. Agenda Additions and/or Deletions: Smith wishes to present a concept for a website (added as
07j).
03. Public Comments. M. Taranto is interested in Smith's website.
04. Comments by AOC members. Van Leuken: Ithaca College was going to contribute funds for the 2025
PEG award trophies, but hasn't; total expenses were $265; AOC previously approved $250 (Resolution
#93, 11/12/24) to be paid from the Usage Fee fund (non-resident PEG payments); I wish to claim this, and
will cover the remaining $15 myself. AOC: approves this payment. She was asked to submit the receipts
to Foster, who will process the payment.
05. Approval of Minutes of the April 7, 2025 Meeting. Moved by DePaolo, seconded by van Leuken,
approved without change 4-0.
06. Access Studio Coordinator Report: attached.
Van Leuken asks about the proposed list of volunteers who want to assist producers with their
productions. Foster: some people have come in and expressed interest in helping. DePaolo: suggests
writing to all producers and posting a notice in the studio. Taranto: notes that AOC might want to add a
question on forms for producers, asking about willingness to help. Van Leuken: will send Foster her
own list of producers.
a. 2025 Budget Equipment Purchases - Report. Purchasing in progress. See attached.
07. Member Reports
a. Municipal Approvals of 2026 Budget - Report. DePaolo: the Town of Ithaca approved the budget
recommendations on April 14. Van Leuken: the Village of Cayuga Heights has put it on their May 21
agenda. DePaolo: will follow up with Fabrizio on City of Ithaca approval.
b. AOC Sales Tax Exemption and Letterhead - Report. No report. DePaolo will check with Fabrizio.
c. Common Council meetings on Government Channel 15 - Report. DePaolo: hasn't heard back from
the City Clerk; will follow up.
d. Communications with City Attorney - Report. DePaolo: nothing new. Confirms that PEG channels
13, 15, 16 are now listed on Charter's app, as AOC has long called for; will check quality of video.
DePaolo: there was a question on what the term "facilities" in the franchise agreement included; will
follow up.
e. Quality of Channel 15 cablecasts. Kelly: checked channel 15 today. Same issue as before, low
sound coming in from County. Van Leuken: Robert Henry didn't think it was County's problem.
DePaolo: has requested a meeting with Henry and Henry's supervisor; will follow up.
f. Curtain - Resolution. DePaolo: has looked through the B&H catalog that Charter provided; does not
find hardware necessary for hanging the curtain in the main studio; what do we do now? Does Kelly
have a vendor for hardware, e.g. hooks and chains? Kelly: will look into it this week and send info.
DePaolo: we'll hold the resolution for the next meeting.
g. Educational and Government Outreach. Van Leuken: it's a question whether we need a separate
committee for E and G under New York State law. DePaolo: if we can get programming on channels 15
and 16 without forming a new committee, let's try it first.
h. Amendment PEGASYS Policies and Procedures Manual - Resolution. Browne moves and
DePaolo seconds a resolution to approve the Release and Acknowledgement of Liability and
Parental/Guardian Consent Forms as submitted by Charter, revised by the City Attorney and
the AOC and with said revisions approved by Charter.
DePaolo: Where it says "must be 18 or older", does the parent sign this instead of the minor?
Kelly: correct.
Smith: does it give a minimum age on the form? It should say "and is at least 14 years of age"
(AOC adopts this language.)
Van Leuken: is the consent form redundant? DePaolo: no, the parent/guardian need not be a
producer.
AOC removes the sentence from the Manual/1.5-e that said "Exceptions can be
made...reached with staff" and adds "immediately" after "to take effect" on the last line of the
resolution.
WHEREAS, the current Policies and Procedures Manual (“the Manual") for the PEGASYS Community
Media Center (“PEGASYS”) was approved by the Access Oversight Committee (“AOC”) on November
12, 2024 with Resolution #94 and amended on March 11, 2025 with Resolution #96; and
WHEREAS, Charter Communications ("Charter") submitted recommendations for revising the Manual
and include a Release and Acknowledgement of Liability Form and a Parental/Guardian Consent
Form; and
WHEREAS, in response, the AOC wishes to amend Sections 1 and 8 of the Manual; and now
therefore be it
RESOLVED, that the following changes shall be made to the Manual:
1. Section 1.5-c will now read: "To use PEGASYS’ production facilities, you must fulfill the
requirements of Section 1.5-a above, complete PEGASYS training, be certified by Staff for all
PEGASYS equipment you plan to use and sign the PEGASYS Producer Responsibility Agreement
(Section 8.2, page 17) and Release and Acknowledgement of Liability Form (Section 8.12, page 29).";
and
2. Section 1.5-e will now read: "Minors between the ages of 14 and 18 are permitted to assist with
video productions when an adult takes legal responsibility for the minor's use of PEGASYS’ equipment
and facilities and has signed the Parental/Guardian Consent Form (Section 8.13, page 30)"; and
3. A new Section 8.12 will be added to Section 8, "Appendix", called "Release and Acknowledgement
of Liability Form", the text of which is attached to this resolution; and
4. A new Section 8.13 will be added to Section 8, "Appendix", called "Parental /Guardian Consent
Form", the text of which is attached to this resolution; and now be it further
RESOLVED that the AOC approves the above listed amendments to the current PEGASYS Policies
and Procedures Manual, to take effect immediately.

RELEASE AND ACKNOWLEDGMENT OF LIABILITY FORM

and Charter Communications has accepted, to perform services as a non-compensated volunteer, to perform various
services concerning program origination and program production.
I accept full responsibility and liability, to the extent permissible by law, for any damages suffered by Charter
Communications caused by my actions or omissions in my capacity as a volunteer.
While working in conjunction with Charter Communications, I hereby release the company from any and all liabilities to
me for injury or harm to me which could result from my performance in volunteer services for the company, except to
the extent that such injuries are the result of the sole negligence, gross negligence, recklessness, or intentional actions
or omissions of Charter Communications.
I do realize that I am not bound under any contractual obligation with Charter Communications and, as a result, I am
thereby responsible for my own actions. I do have the right to accept or reject the performance of any services, whether
offered by me or requested by Charter Communications, which could result in liability or risk of injury to me.

Parental/Guardian Consent Form
I, _______________________________________________, the undersigned, am the parent or legally-authorized
guardian for _______________, (“Minor”) who was born on _______and is at least 14 years of age. I hereby authorize
and consent to Minor’s participation in programming and production services provided at or by the PEGASYS
Community Media Center, which produces programming to be aired on the cable television system of Charter
Communication Inc. (“the Company”), subject to the following conditions.
Company assumes no responsibility for the supervision of Minor. Such supervision shall at all times be the responsibility
of a PEGASYS Community Media Center volunteer. I hereby release the Company from any and all damages, liabilities,
or harm suffered by Minor during Minor’s activities for or on behalf of PEGASYS Community Media Center, except to the
extent that such injuries are the result of the sole negligence, gross negligence, recklessness, or intentional actions or
omissions of the Company. I understand that this release is a prerequisite to Minor being able to participate as a
volunteer at the PEGASYS Community Media Center.

Adopted 3-1-0. Van Leuken will Email the corrected resolution to Foster.
i. PEG Fee. This refers to the 15-cent surcharge on subscribers' monthly bills. This amount has not
changed since 2003. An increase would free up more funding for equipment.
DePaolo: The City of Ithaca had a discussion scheduled with Charter for April 23 about renewing the
franchise; I haven't heard back about the discussion.
j. Smith screenshares a new website that is based on a design by Lauren Stefanelli and adaptation by
Alex Wiers. He is working on a "PEGASYS online video library" which is intended to index all videos that
producers have uploaded to YouTube (and Vimeo and other platforms), that are now not easy to find. He
hopes to have it on the Internet by next meeting. He is using a domain he owns and will continue to
administer. He shows how it will work and how producers would access it. DePaolo: it is awesome that
you are doing this. AOC is happy with Smith's creation. These plans do not affect the present PEGASYS
website.
