Approval of Meeting Minutes: February 15, 2023 (Exhibit 2023-139) Resolution: 9355 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees approves February 15, 2023, Board Meeting Minutes as presented. Report of Fire Superintendent Tamborelle: Submitted Report (Exhibit 2023-140) •Fire Superintendent Tamborelle states that the fire station is running smoothly. The recruits are all enrolled in an EMT class. •Fire Superintendent Tamborelle states that they will host an EMT Class this fall which is something that has not happened in several years. •Fire Superintendent Tamborelle states that the annual fire department banquet will be held on April 22, 2023, at Lakewatch. •Fire Superintendent Tamborelle states that the Village received three bids for the Cayuga Heights Fire Station roof. Once the Board accepts the bids and issues an award, Village Clerk Walker will contact the contractor and ask them to draw up the contract for the Village Attorney, R. Marcus to review. 3 •Mayor Woodard asks if there has been a decision on the extra cost of adding an Ice/Water shield to the whole surface. •Trustee Salton suggested that the Board hold off on deciding how much Ice/Water to install until the contractor gets to take a closer look at the roof. •B. Cross states that the Ice/Water shield would give the roof an extra layer of protection, especially in areas where ductwork comes through the roof. 4 •Fire Superintendent Tamborelle states that the only addition to this project is to get a price for the installation of the gutter tie-backs that were never installed. 5 Resolution: 9356 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees accepts the RFP Bids for the CHFD roof replacement project from Hale Contracting Inc, Dave Marion Carpentry Inc., and Quick Construction Inc. 6 Motion: Trustee Robinson Second: Trustee Marshall Ayes: Mayor Woodard; Trustees: Biloski, Hubbell, Marshall, Rennekamp, Robinson, and Salton Nays: none Abstentions: none Motion Carried Resolution: 9357 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves the bid submitted by Quick Construction Inc. in the amount of $125,000 for the replacement of the Village of Cayuga Heights Fire Station roof and $3500 for the Ice/Water Shield throughout and authorizes Mayor Woodard to sign the contract once approved by Village Attorney R. Report of Treasurer Dolch: Submitted Report (Exhibit 2023-141) •Village Treasurer Dolch states that the February bank-to-book reconciliation is complete. •Village Treasurer Dolch states that The 2023-2024 Budget Worksheets for all funds have been shared with the Trustees and to please review these before our upcoming budget workshop. The budget workshop will be on Saturday, March 25th from 9-12 pm. Approval of Abstract 10: Resolution: 9358 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Abstract #10 for FYE2023 consisting of TA 75-82 vouchers in the amount of $13,923.28 and Consolidated Fund vouchers 691-771 in the amount of $663,237.53 and the Treasurer is instructed to make payments thereon. Report of Mayor Woodard: a. VCH Annual Court Report: Village Justice G. Galbreath presents his Annual Village Court Report to the Board of Trustees. •Village Justice G. Galbreath states that Village Justice David Klien has retired, and Mayor Woodard will be appointing Kathleen Bergin at the Annual Village Organizational Meeting. •Village Justice G. Galbreath states that this past year there was an increasing number of cases and fines but had a decrease in the overall running balance of money owed to the court. •Village Justice G. Galbreath states that one area of interest for the Board is the amount of time he has to spend on Centralized Arraignment Parts (CAP) for the county. •Village Justice G. Galbreath states that currently arraignments are held either at 8:00 a.m. or 8:00 p.m. but the number of judges that cover CAP is less resulting in 40-50 cases a year for him to hear. •Trustee Biloski asks how long an arraignment usually takes under this new format. •Village Justice G. Galbreath states that he usually will be there for a couple of hours but it all depends on the case or number of cases that come in. •In closing Village Justice G. Galbreath states that he was surprised to learn that the new auditors were able to complete the audit when they did the Village Audit. •Clerk Walker states that he expects to receive the Village and Court Audit soon since the actuarial report is almost completed. •Trustee Salton states that he asked this last year but what are your thoughts on CAP a year later? •Village Justice G. Galbreath states that he is pretty happy with it. This method ensures that a defendant has an attorney, and that the police officers are back out on the streets almost immediately. Resolution: 9359 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves the 2022 Village of Cayuga Heights Annual Court Report by Village Justice Galbreath as written. VCH Annual Historians Report: Village Historian Bea Szekely presents her Annual Village Historians Report to the Board of Trustees. •Village Historian B.Szekely shares a boundary survey map of the “old” Village. •Village Historian B.Szekely states that she appreciates the fact Village records were so well kept that it is a luxury for a historian. •Village Historian B.Szekely states that if there are no questions from the Board then she will read the following information on the publication of her manuscript called: University Suburb, the Founding of Cayuga Heights in Ithaca, New York. that is at last all but completed. I am currently writing the endnotes for the last of six chapters (there is also an afterword and a preface). My initial hope was that the Three Hills imprint of the Cornell University Press would be interested, but the director turned me down saying that, although it is "well written" and "very informative," it wouldn't sell enough copies to recover the $15,000 investment the press would need to make. Then, a few weeks ago I proposed to the mayor that the village publish it. I don't intend to make any money-not a penny from the project. My thought was that if the village were to pay production and printing costs of, say $5,000, maybe a bit more, for several hundred copies, it might be sold at cost and all proceeds used to pay for publication. However, after inquiring of NYCOM, the Mayor has learned that a municipality can't do that. So I have decided to publish it myself using the service of a professional book designer and copy editor. (As an as de, former village resident Carol Kammen, who is retiring as Tompkins County Historian this spring, wrote the mayor why she thinks University Suburb deserves publication, but I have let her know my decision.) •Village Historian B.Szekely states that the publication will have many maps, and photos of homes in the Village. •In closing Village Historian B.Szekely states that she would love to host the Association of Public Historians' September meeting at Marcham Hall. •Clerk Walker stated that he will mark the Village Calander for that event. c. Schedule the Annual Village Organizational Meeting: Under New York State Village Law, the first Monday in April after the Village Elections is when we set the organization of the Village Government. •Mayor Woodard states that she would like a resolution setting the Annual Village Organizational Meeting for April 3, 2023, at 7:00 p.m. Resolution: 9360 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees hereby schedules the Annual Village Organizational Meeting to be held on April 3, 2023, at 7:00 p.m. Motion: Trustee Robinson 9 Second: Trustee Marshall Ayes: Mayor Woodard; Trustees: Biloski, Hubbell, Marshall, Rennekamp, Robinson, and Salton Nays: none Abstentions: none Motion Carried d. Proposed FYE 2023-2024 Budget: The Village Budget Workshop will be held on Saturday, March 25, 2023, from 9:00 a.m. to Noon. •Mayor Woodard states that all the department heads have met with their committees and submitted their requests to Village Treasurer Dolch through the shared Budget Worksheet. •Mayor Woodard states that she and Trustee Robinson have met with the Village Police PBA on contract negotiations and will meet with the DPW on Monday, March 20, 2023. e. Schedule a Public Hearing on Proposed FYE 2023-2024 Annual Budget: •Mayor Woodard states that she needs a resolution to schedule the Public Hearing at the Village Organizational Meeting on April 3, 2023, at 7:10 p.m. Resolution: 9361 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees hereby schedules a Public Hearing on the Proposed FYE 2023-2024 Annual Budget for April 3, 2023, at 7:10 p.m. Motion: Trustee Robinson Second: Trustee Hubbell Ayes: Mayor Woodard; Trustees: Biloski, Hubbell, Marshall, Rennekamp, Robinson, and Salton Nays: none Abstentions: none Motion Carried f. VCH and Town of Ithaca Court Coverage Agreement: The Village police department provides the Town of Ithaca security support for the Town of Ithaca Court. This agreement is up for renewal and has been approved by the Town of Ithaca. Resolution: 9362 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Mayor Woodard to sign the Village of Cayuga Heights and Town of Ithaca Court Agreement as presented. Appointment of Devin Dilts as the Village Labor Attorney: The Village has been looking for a labor attorney for the upcoming employee contracts. •Mayor Woodard states that she would like to appoint Devin Dilts from Caughlin & Gerhart LLP as the Villages Labor Attorney. Resolution: 9363 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Mayor Woodard’s appointment of Devin Dilts as the Village Labor Attorney and will he be re-appointed at the Village Annual Organizational Meeting on April 3, 2023. Report of Superintendent of Public Works Cross: Submitted Report (Exhibit 2023-145) •B. Cross states that During the construction progress meeting yesterday, we discussed details about some electrical issues that have been discovered through the construction process. 3 items have been clarified and subsequently priced out by Matco: 1. Add a new light switch (and associated circuitry) in the lab as requested by the Village ($1,300) 2. Replace two existing motor starters on the existing sludge scraper drives, including an upgrade of circuit wires. This is needed because although the current circuitry is 480v wiring, the existing motor starters were previously converted from the original 240v configuration to allow them to be run as 480v power input. Although this has been working (for a long time), this conversion is not code compliant and is required to be updated to meet the current code ($22,000) 3. The wiring from the main power feed (50-year-old wiring) has no dedicated ground conductor. The original wiring was installed in a metal conduit that could serve as a dedicated ground (allowed by previous codes), but when the new diesel generator was installed in 1999, the supply- side cable was extended using newer PVC conduit which does not complete the dedicated grounding. Therefore new 3/0 conductors need to be installed in an underground duct bank ($62,944) 11 •B. Cross states that the combined total for Change Order E-002 comes to $86,244 and the budgeting of the project included a 5% contingency that started at the beginning of the combined phase 1 & 2 at $469,280.00 The Previous combined change orders have reduced the available contingency to $306,709.00. Therefore, the new contingency allowance would be reduced to $229,465.00. •B. Cross states that we will need a resolution authorizing the Mayor to sign the GHD E-002 Change Order for Matco Electric Company. Resolution: 9364 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Mayor Woodard to sign the change order in the amount of $86,244.00 for additional electrical work to be performed by Matco Electric Company as part of Contract #2 of Phase 2 for the Village WWTP. Cross states that there are a few other changes that are anticipated including specifically a “remobilization” reimbursement to Blue Heron for a “shut-down" caused by the 9-month delayed delivery of the main electrical control panels as part of Matco's contract. Blue Heron has agreed to charge us only for their actual cost to demobilize and remobilize and not for the value of lost time. •B. Cross states that we are also anticipating a significant credit from Blue Heron because we have negotiated a deal to dispose of the sludge “on-hand” at Steuben County Landfill at $40/ton instead of the $77/ton that they thought it was going to cost at Seneca Meadows Landfill. •B. Cross states that the NYSDEC conducted its annual inspection of the WWTP. The results of that inspection were rated as satisfactory. •B. Cross states that two action items need to be addressed. One is an explanation as to why the sludge blanket in the primary settling tank is off-gassing. Two, the trickling filter masks are leaking, which means the bearing seals need to be replaced. •B. Cross states that Fisher and Associates have submitted a revised report to NYSDOT. Once that is approved then the report will go to the Office of the State Comptrollers. Another area of progress made on this project was a physical walk-through of the project site and the individual concerns of each of the property owners with the consultants using Google Earth. •B. Cross states that once those items have been addressed by Fisher and Associates then he will update the residents as to what our responses are to their concerns. 12 •Mayor Woodard asks if this project will be completed before the beginning of the next school year. •B. Cross states that believes that information will come through in the bids. He hopes there will be enough time in this construction season. •B. Cross states that advertisements for the bids will be in early April with an understanding that the Board could award the bids at the June Board Meeting. 8. Report of the Trustees: a. Sunset Park Update: •Trustee Marshall states that the Sunset Park Project is in phase two, which is the public outreach portion. A letter has been sent to neighbors of the park asking for feedback a survey has been created for us to promote in the Village Eblast and Website as well as a general information session is scheduled for May 7, 2023, from 2-4 p.m. at Marcham Hall. •Trustee Marshall states the action item needed tonight is a Board Resolution allowing Michele Palmer from Templeton Landscaping to create the Consolidated Funding Grant Application for Sunset Park. •Trustee Salton states that he is against any use of concrete curbing for this project. •Trustee Marshall states the details of safety are complicated when accommodating aesthetics and proper engineering. He will share more details with Trustee Salton if needed. Resolution: 9365 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Mayor Woodard to sign the Templeton Landscape Proposal as presented in Exhibit 2023-146 for a grant submission for Sunset park. Report of Police Chief Wright: Submitted Report (Exhibit 2023-146) •Police Seargent Manning was present in Chief Wright’s absence. 13 •Trustee Salton inquires about the criminal mischief and trespassing complaint. •Police Seargent Manning states that there were two complaints, Once at the Carriage House Apartments, the damage was done to a vehicle overnight and the second one was a trespassing Village Greene. 10. Report of Director of DPW Wiese: Submitted Report (Exhibit 2023-137) •Director Wiese states that the guys found a breach in a culvert line on Cayuga Heights Road that led to water entering the sewer line. •Director Wiese has contacted Skanex who can sleeve that section for $4,000.00 the week of March 20, 2023. •Trustee Salton asks if Director Wiese has isolated the problem or examined the condition of the line area around this break. •Director Wiese states that they did camera the line upstream and found no issues. He is confident that this is the only break. •Mayor Woodard states that the Village Public Works Committee did discuss this topic and recommended we hire Skanex to sleeve this break. Resolution: 9366 BE IT RESOLVED THAT: the Village of Cayuga Heights Board of Trustees authorizes and approves Mayor Woodard to sign the Skanex Proposal in the amount not to exceed $4000 to sleeve a section of a sewer line on Cayuga Heights Road to be paid from Sewer Contingency. Motion: Trustee Robinson Second: Trustee Marshall Ayes: Mayor Woodard; Trustees: Biloski, Hubbell, Marshall, Rennekamp, Robinson, and Salton Nays: none Abstentions: none Motion Carried •Director Wiese states that the I Trackers have been installed for a week and this Friday he will upload the data to see if sewer flows have changed enough to suspect we have groundwater entering the sewer line. •Director Wiese states that they have installed two on North Sunset, One on Cayuga Park Road, one on Comstock, and one other section he cannot remember right now. 14 11. Report of Clerk Walker: •Clerk Walker states that the only action item that he needs Board approval for is the Board of Trustees supporting a grant application to Tompkins County for improvements to Sunset Park. Clerk Walker states that the Village was awarded this grant several years ago. At that time David O'Brien worked on repointing some of the stonework at Sunset Park. The idea would be to have him continue that work and if the Sunset Park Taskforce had any other ideas money could go to that. Resolution: 9367 TOWNS AND VILLAGES PARKS AND TRAILS GRANT RESOLUTION OF SUPPORT WHEREAS, the Village of Cayuga Heights owns the property knowns as Sunset Park, which is a municipal park wholly located within the Village; and WHEREAS, the Village desires to improve the infrastructure of Sunset Park by repairing and repointing the existing stone structures within the park; and WHEREAS, the cost of such repair is estimated to be $5,000; and WHEREAS, the Tompkins County Department of Planning and Sustainability is making funding available for the improvement of municipal parks and trails through the Towns and Villages Parks and Trails Grant Program; NOW, THEREFORE, BE IT RESOLVED that the Cayuga Heights Board of Trustees supports and authorizes the submission of a grant application for up to $5,000 to the Tompkins County Towns and Villages Parks and Trails Grant Program. BE IT FURTHER RESOLVED that if the grant application is successful, the Cayuga Heights Board of Trustees authorizes the Village Mayor to execute the contract with Tompkins County to implement the project. Oath of Office: The following officials who were elected on March 21, 2023, affirmed their Oath of Office; Trustees: Jennifer Biloski, Kent Hubbell, Richard Robinson, and Peter Salton 2. Proposed Annual Budget FYE 2023-2024 Mayor Woodard opens the Public Hearing at 7:03 p.m. Mayor Woodard states that the final proposed budget for FYE 2023-2024 is not complete. The union contracts are still being negotiated but will be finalized by the April 19, 2023 Board meeting. Mayor Woodard states that this Public Hearing will be continued at the April 19,2023 Board Meeting. 3. Appointments and Approvals (Exhibit 2024-001) Mayor Woodard appoints Trustee Richard Robinson as Deputy Mayor for the 2023-2024 Official Year. III. QUORUM: A quorum of the Board of Trustees must be physically present to conduct business. Although a quorum is required to conduct a meeting, a majority vote of the total legally authorized membership of the body is still required to pass most measures. IV. EXECUTIVE SESSIONS: Executive sessions must be held in accordance with NYS Public Officers Law § 105. All executive sessions must be entered by a motion made from a properly noticed and conducted open meeting. V. AGENDAS: The agenda is to be prepared by the Clerk at the direction of the Mayor. The Mayor or any Trustee may have an item placed on the agenda. When possible, items for the agenda must be provided to the Clerk in writing or via email at least 48 hours before the meeting’s start time. The agenda must be prepared by noon on the day of the meeting. However, items may be placed on the agenda at any time. If necessary, a supplemental agenda may be distributed at the beginning of the meeting. VI. VOTING: Pursuant to the New York State Village Law and General Construction Law, each member of the Board has one vote. The Mayor may vote on any matter but must vote in case of a tie. A majority of the totally authorized voting power is necessary to pass a matter unless otherwise specified by State law. A vote upon any question must be taken by ayes and nays, and the names of the members present, and their votes must be entered in the minutes. VII. GENERAL RULES: a. The Mayor presides at the meeting. In the Mayor’s absence, the Deputy Mayor presides at meetings of the Board. The presiding officer may debate, move, and take any action that may be taken by other members of the Board. Board members are not required to rise but must be recognized by the presiding officer before making motions and speaking. b. Every motion must be seconded before being put to a vote: all motions must be recorded in their entirety in the Board’s minutes. c. Once recognized, a member may not be interrupted when speaking unless it is to call him/her to order. If a member is called to order, they must stop speaking until the question of order is determined, and, if in order, they must be permitted to proceed. There is no limit to the number of times a member may speak on a question. Motions to close or limit debate may be entertained and require a two- thirds vote to pass. d. Videoconferencing: 37 In compliance with Public Officers Law (POL) § 103-a(2)(a), the Board of Trustees/Planning Board/Zoning Board of Appeals (the “Board”), following a public hearing, authorized by resolution on [insert date] the use of videoconferencing as described in POL § 103-a. The following procedures are hereby established to satisfy the requirement of POL § 103- a(2)(b) that any public body which in its discretion wishes to permit its members to participate in meetings by videoconferencing from private locations – under extraordinary circumstances – must establish written procedures governing member and public attendance. 1. Board members shall be physically present at any meeting of the Board unless such member is unable to be physically present at one of the designated public meeting locations due to extraordinary circumstances. 2. For purposes of these procedures, the term “extraordinary circumstances” includes disability, illness, caregiving responsibilities, or any other significant or unexpected factor or event which precludes the member’s physical attendance at such meeting. 3. If a member is unable to be physically present at one of the designated public meeting locations and wishes to participate by videoconferencing from a private location due to extraordinary circumstances, the member must notify the Mayor/Chairperson of the Planning Board/Chairperson of the Zoning Board of Appeals no later than four business days prior to the scheduled meeting in order for proper notice to the public to be given. 4. If there is a quorum of members participating at a physical location(s) open to the public, the Board may properly convene a meeting. A member who is participating from a remote location that is not open to in-person physical attendance by the public shall not count toward a quorum of the Board but may participate and vote if there is a quorum of members at a physical location(s) open to the public. 5. Except in the case of executive sessions conducted pursuant to POL § 105, the Board shall ensure that its members can be heard, seen, and identified while the meeting is being conducted, including but not limited to any motions, proposals, resolutions, and any other matter formally discussed or voted upon. This requirement shall include the use of first and last name placards physically placed in front of the members or, for members participating by videoconferencing from private locations due to extraordinary circumstances, such members must ensure that their full first and last name appears on their videoconferencing screen. 6. The minutes of the meetings involving videoconferencing based on extraordinary circumstances pursuant to POL § 103-a shall include which, if any, members participated by videoconferencing from a private location due to such extraordinary circumstances. 38 7. The public notice for the meeting shall inform the public: (i) that extraordinary circumstances videoconferencing will (or may) be used, (ii) where the public can view and/or participate in such meeting, (iii) where required documents and records will be posted or available, and (iv) the physical location(s) for the meeting where the public can attend. 8. The Board shall provide that each open portion of any meeting conducted using extraordinary circumstances videoconferencing shall be recorded and such recordings posted or linked on the Board’s website (https://cayuga-heights.ny.us) within five business days following the meeting and shall remain so available for a minimum of five years thereafter. Such recordings shall be transcribed upon request. 9. If members of the Board are authorized to participate by videoconferencing from a private location due to extraordinary circumstances, the Board shall provide the opportunity for members of the public to view such meeting by video, and to participate in proceedings by videoconference in real time where public comment or participation is authorized. The Board shall ensure that where extraordinary circumstances videoconferencing is used, it authorizes the same public participation or testimony as in person participation or testimony. 10. Open meetings of the Board conducted using extraordinary circumstances videoconferencing pursuant to the provisions of POL § 103-a shall be broadcast pursuant to the requirements of POL § 103(f) and shall utilize technology to permit access by members of the public with disabilities consistent with the 1990 Americans with Disabilities Act (ADA), as amended, and corresponding guidelines. For the purposes of this guideline, “disability” shall have the meaning defined in Executive Law § 292. 11. The in-person participation requirements of POL § 103-a(2)(c) shall not apply during a state disaster emergency declared by the governor pursuant to Executive Law § 28 if the Board determines that the circumstances necessitating the emergency declaration would affect or impair the ability of the Board to hold an in-person meeting. 12. These procedures shall be conspicuously posted on the Board’s website (cayuga-heights.ny.us). VIII GUIDELINES FOR PUBLIC COMMENT: Privilege of the Floor guidelines are as established at January 9, 2012 Board of Trustee meeting as follows. Meetings of the Board of Trustees of the Village of Cayuga Heights take place in accordance with New York State law, for the purpose of Village governance. Meetings are convened by the Mayor or by an appointed deputy. Discussion takes place among the members of the Board with the Village professional staff. Minutes are recorded by the Clerk. As provided in the New York State Open Meetings Law, all Board meetings are open to the public, and members of the public are welcome to attend. 39 Although not required by law, the Mayor and the Trustees of Cayuga Heights offer Privilege of the Floor in order to provide individuals in the audience with the opportunity to voice their opinion on Village affairs. In the interest of expediting the flow of Village business during its lengthy meetings, Privilege of the Floor is open for 30 minutes only, ordinarily following any scheduled Public Hearings. Fifteen (15) minutes prior to the commencement of any regularly scheduled Board of Trustee’s meeting, a sign-in sheet will be placed on a table inside the meeting room. Upon arrival, all attendees are requested to sign in, indicating if they wish to speak. The speakers may give their name and address if they choose. If a speaker does not want to provide their name, they must sign in as “Anonymous Speaker” and then they are responsible for remembering the number associated with their place on the list. Attendees will be called to speak in the order shown on the sign-in sheet on a first come, first to speak basis. Speakers are asked to stand unless prevented by a disability, to give their name and address if they so choose and must limit their remarks to two minutes of time. Please note that a speaker’s time may not be yielded to other speakers. Speakers are requested to observe standards of courtesy and good taste and may be asked to terminate remarks at any time by the Mayor or another presiding officer. Audience members are asked not to engage with the speaker, or with each other. The Village Clerk keeps time and gives notice when 30 seconds are remaining. We had 42 calls in the Village of Cayuga Heights, 18 calls in the Town of Ithaca and 5 mutual aid requests. There were 49 EMS calls and 16 fire responses. The calls were fairly spread out during the month but there were days when we would get multiple requests for service. Unfortunately for the bunkers there were many EMS calls that happened overnight. The bunkers are the ones who handle most overnight EMS calls since they are in the station and are able to respond quickly. With the probationary members finally through their checklists we were able to focus on department-wide training for the month. Early in the month we did an Emergency Vehicle Operators Update training. Several of our members took a class from our insurance carrier and can teach EVOC. This training was a refresher for many and an original class for some. None of our members are allowed to drive any vehicle in the department without first taking EVOC and being evaluated on driving skills. If a member is cleared to drive in emergency mode, they must make their first several responses as a driver with an officer to ensure that safe practices are being followed. Late in the month we did a training on low angle rope rescue skills. Rope rescue is an extremely technical skill and requires specialized equipment. We can, with our equipment, provide safe low angle rescues. If there is an incident that is considered a high angle rescue, then all departments in the county rely on the Ithaca Fire Department for assistance. Our EMS training for the month was on cardiac arrest management. The cardiac arrest is the toughest of all EMS calls to manage. There are many skills that need to be done at the same time by many providers. Airway management, intravenous access, CPR, cardiac rhythm recognition and management, medication administration, defibrillation, extrication and scene management. During the management of a cardiac arrest patient there are many providers working together as a team to provide the best possible care. Without training and careful management these scenes can quickly turn chaotic. We have had several EMS calls over the past months for patients in cardiac arrest and our management of the patient and scene have always been smooth. The roof project bid has been awarded and we are now waiting for the contracts to be reviewed and signed. The contractor said that he would plan to start the work in early June and be done by August. The HVAC work at the station is now complete. During the cold spell in March HSC came and ran all of the line sets and did all of the interior work. The first week in April they came and placed the AC units on the roof and hooked everything up. The project is now complete. We contacted the Ford dealer about our replacement F150 and they are saying that the truck will not be delivered before June 1st. We will need to carry that money over into FY 23/24. 46 We held department elections at the end of March. We again have an amazing group of officers for the next year. Asst. Chief Brendan Bloodnick is stepping down this year. He and his wife are purchasing a farm in Lodi, and he will be leaving the department in late summer. Brendan will be greatly missed. He joined the department as a freshman at Cornell and has served for 10 years. Lt. Sophie Janowsky is moving up to the position of Assistant Chief. Sophie will be the first female Chief Officer in the department’s history. Sophie joined the department 7 years ago as a probie and has since moved to exterior then interior firefighter, has served as a bunker and moved up through the ranks to 281 (first lieutenant). Sophie recently was hired by the Ithaca Fire Department and is a career firefighter. The current plan is that Sophie will move into 825 Hanshaw Road when Brendan leaves. Our banquet is planned for the evening of April 22nd. This will be our first gathering since the beginning of Covid and we are excited for our members and guests. We will be at The Lake Watch Inn for the evening. The original plan to have a shuttle bus for the evening has fallen through although we are looking at other vendors for this. It should be a wonderful evening of recognition and fun. We are very thankful to our DPW for their work hanging the movie screen in the truck bays at the fire station. It is a large screen with an electric motor to lower and raise it. This was our phase two with this project. Phase one was getting the equipment with the Triad grant. Phase three hard mounting the projector and speakers in the truck bay. Asst. Chief Mike Garrett teaches AV at Ithaca College and will be the lead on this phase of the project. All is well at the station, and we are looking forward to spring and summer. W I T N E S S E T H: WHEREAS, the Owner is a municipality located in the County of Tompkins and State of New York; and WHEREAS, the Owner is desirous of engaging the Builder to replace the existing roof on the Owner’s building located and known as 194 Pleasant Grove Road, Ithaca, New York, and used to house the Owner’s fire department (the “Construction Job”) under the terms and conditions set out herein; NOW THEREFORE, in consideration of the mutual promises contained herein, and other good and valuable consideration the parties hereto agree as follows: 1. CONSTRUCTION. The Builder agrees to perform the following work to complete the Construction Job: a. Remove existing roofing material down to original decking on entire roof. b. Clear all removed roofing material from the premises and properly dispose of same in accordance with applicable environmental laws and regulations. c. Install synthetic underlayment to meet NYS building code. d. Install 6’ ice and water shield. e. Install appropriate 30-year shingles as approved by the Owner. f. Install 50 Mil white Duro-Last roof system according to the manufacturer’s specifications. 48 g. Install ODE edges on all eaves and rakes. h. Install ridge ventilation. i. Replace all pipe flanges and wall flashing, Reline all existing gutters with rubber roofing material. j. Additional work, considered standard replacement roofing practice, to complete the Construction Job, may be necessary (for example, rotten wood replacement). Such work shall be billed by the Builder at its usual and ordinary pricing schedule, and shall be paid by the Owner within ten days of invoice receipt. 2. CONTRACT PRICE. Subject to the above provision for additional work, the Builder shall provide the labor and supply the materials necessary to complete the Construction Job for the sum of One Hundred Twenty Five Thousand Dollars ($125,000.00) (the “Contract Price”), which the Owner agrees to pay. 3. SCHEDULE OF PROGRESS PAYMENTS. The Contract Price shall be paid as follows: Upon submission to and approval by the Board of the Village of Cayuga Heights of an invoice for the cost of materials necessary to begin the Construction Job, and provided that the materials are on site at the fire station before June 16, 2023, that invoice will be paid by the Board on June 22, 2023, the day after the meeting of the Board of the Village of Cayuga Heights, and thereafter, the Builder shall invoice the Owner monthly as additional labor and materials are supplied before the second Friday of the month. The final payment will be made when the Construction Job is fully inspected and complete. All invoices shall be paid upon acceptance by the Board of the Village of Cayuga Heights at their monthly Board meeting held during the third week of each month within ten days of receipt. Any unpaid invoices shall accrue a service charge of 1.5% per month. 4. WORK AND MATERIALS DESCRIPTION. The Builder will perform the Construction Job in a good and workmanlike manner. The Builder agrees that all material incorporated into the job shall be installed according to manufacturer's specifications and will be of the quality represented in those specifications. 49 5. PERIOD OF CONSTRUCTION. Construction shall commence on or about June 1, 2023, and, subject to conditions beyond the reasonable control of the Builder, shall be completed on or about August 1, 2023. 6. PERMITS AND OTHER CLOSING DOCUMENTS. The Builder shall be responsible for obtaining, at its cost and expense, a building permit for the Construction Job. 7. ASSIGNMENT. It is understood and agreed that neither party may assign this Contract without the prior written consent of the other. 8. WHOLE AGREEMENT. It is understood that there are no agreements and/or representations other than those provided in this Construction Contract. 9. CHANGE ORDERS. Any changes and/or additional agreements shall be binding on the parties only if reduced to writing and signed by the Owner and the Builder. 10. INSURANCE COVERAGE. During the course of the Construction Job the Builder shall maintain coverage by liability insurance in an amount reasonably required by the Owner. The Builder will also, at all times, have its workers covered by a policy of worker’s compensation insurance in compliance with New York State law. Budget: At our budget workshop last month, the Trustees reviewed the General, Water, and Sewer accounts and a tentative budget was created. Some changes have been made to the budget since then – most of the changes are due to the 5% salary increase for DPW and Police which affects salary accounts, payroll, and contingency accounts. All of these changes were minor. Additionally, 50,000 for a Fire vehicle (F-150) was not budgeted for correctly in the 2022-2023 year. This truck will not be delivered and paid for until after June 2023 so we need to budget for it in the Fire Equipment line in the 2023-2024 year. To summarize, the BOT has agreed on a tax rate of 6.30 which is 1.94 higher than last year's tax rate. We plan to use $334,125 of fund balance. Wright Chief of Police 4/13/23 To: The Honorable Mayor Woodard Members of the Board of Trustees Village of Cayuga Heights Re: Report of the Police Department for March 2023 In the month of March, the police department received 398 calls for service. In addition to these calls, 105 uniform traffic tickets were issued, and 3 parking violations were cited. A breakdown of the calls for service is as follows: One Felony complaint of Burglary was reported. A resident stated that their phone was taken from the unsecured apartment. There are no suspects in this case and the officer is awaiting further description of the missing item. 7 Misdemeanor Penal Law Complaints were handled. An incident of Criminal Mischief was reported after the on-duty officer had observed damage done to property in the cemetery. Soon after, it was determined that this incident had already been reported by a caretaker of the cemetery. 3 complaints of Fraud were received. After investigation of the first complaint, the officer determined that the incident did not occur within the Cayuga Height’s Police jurisdiction. 2 other complaints of Fraud involved residents stating their bank accounts had been compromised. One resident was able to be reimbursed for their losses and the other was able to secure their account before any transaction took place. 2 Larceny complaints were handled. One complaint involved a student having their bicycle taken from the elementary school. Camera footage does show the bicycle being removed from the premises; however no suspect has been identified. The second complaint was made by a resident who reported their unsecured vehicle being entered unlawfully and 3 wallets being taken. There are no suspects in this case. The investigation of 11 Traffic Stops led to 16 Vehicle and Traffic Misdemeanor charges. 11 for Suspended Registration and 3 for Aggravated Unlicensed Operation of a Motor Vehicle 3rd , 1 for AUO 2nd, and 1 for Failure to return license and Registration. Two Penal Law Violation charges for Trespass were filed after two suspicious subjects were seen attempting to take items from the premises of a local fraternity. Two Local Law incidents including 1 for In the Park After Hours and 1 for Soliciting. While on patrol an officer observed an unoccupied vehicle parked on the side of the road within Sunset Park. There was a note on the vehicle stating that it was disabled. The officer issued a parking citation and the following day the vehicle was gone from the location. The incident of Soliciting came in as a subject going door to door distributing flyers for home improvements. Upon the officer’s arrival in the area the subject 56 was not able to be located. Contact was made with a member of the company, as listed on the flyer, and advisement of the need to register with the police department was made. 1 property damage Motor Vehicle accident was handled in the 400 Block of State Route 13, which involved contact with a deer. No other incidents involving deer were reported. 10 calls for service were completed under the Tompkins County Mutual Aid Agreement involving CHPD officers assisting other agencies and 2 calls involving agencies assisting CHPD. Over the course of the month, Officers took part in the following training and/or events: Throughout the month all officers completed an on-line EVOC training. On the 13th Sergeant Manning and Ofc. Manheim met with member of the First Congregational Church in an effort to assess their emergency preparedness plan. From the 13th through April 5th, CHPD, once again, hosted 2 interns enrolled in the Criminal Justice Program at TST BOCES. On the 22nd Ofc. Barr and Ofc. Langlois conducted a Commercial Vehicle Safety inspection detail along with DOT. The full-time officers worked a total of 23 hours of overtime and the part-time officers worked a total of 144 hours. Sincerely, Chief Jerry Wright 57 EXHIBIT 2024-014 Village of Cayuga Heights Mike Wiese – B.O.T Report April 19th, 2023 Code Enforcement – No code training was attended. Street – The DPW continues to prepare for paving work which is scheduled to happen on the first week of May. They are re-establishing ditch lines in the area. Water – Water valves located in the upcoming paving areas in the northeast village have been reviewed and any valves showing issues have been addressed. Two valves were found to require a bolt replacement. One remaining valve at the intersection of Winthrop Drive and Burleigh drive requires attention and is currently being scheduled. The transmission main valve on Pleasant Grove Road has been repaired for Bolton Point. This valve was leaking and was found to only need new bolts to hold the valve together. The Hydrant located across the road from the Fire Department on Pleasant Grove Road has been repaired and is being elevated to better accommodate the terrain surrounding it. Sewer – The new tracking devices are installed in the village and we are working through various small issues to allow us to better utilize them. 58 EXHIBIT 2024-015 CHES 5K and Fun Run Join the annual Cayuga Heights Elementary School (CHES) 5K and Fun Run on Saturday, May 6, 2023. This fun community event is open to everyone who would like to race through the beautiful streets of Cayuga Heights on a spring day. 59 Funds raised will support the CHES PTA and the many PTA sponsored programs, activities, and events.
