RE: 202 Overlook Road
REPORT: A zoning permit application to have upto 120 days of short term rental in an apartment at the above
referenced property has been denied. This would exceed the 14 days allowed, for short term rental of a self-
contained apartment in a Residence District, by the Village of Cayuga Heights Zoning Ordinance Section
5.3.1.2.a. Short Term Rental. Therefore, the applicant is seeking a variance to allow the rental of this property
as proposed.
It should be noted that the Zoning Ordinance regulates such a request as a Use Variance, subject to the
procedures as prescribed by NYS Village Law.
A Public Hearing has been scheduled on April3, 2018 @7:15 pm atthe Fire Station, 194 Pleasant Grove
Road to hear comments on the variance request. The following properties are located within 200' and will

Use Variance for 202 Overlook Rd (Upper Unit)
I am requesting a use variance for the upper unit of 202 Overlook Rd, which is entered from Overlook
Rd. The lower unit, also known as 420 Kline Rd, is not requested to be part of this variance. I currently
have 420 Kline Rd rented long term as a separate unit. I would like to have additional short term days
added to the allowed use for the upper unit at 202 Overlook. Currently, with the new zoning laws, I arn
only allowed 14 days per year of 30 days or less since I am not renting a room in my home. The property
at2A2 Overlook Rd was the original "stable" and cariage house for 205 Overlook Rd, where I currently
reside. ln order to realize a reasonable return of 3% on the property, I would like to request an
allowance of up to 120 days per year short term.
I have included, as part of the variance request, cost basis for the property, latest tax appraisal (201g1,
income and expenses for the entire property and the Schedule E from the last 4 years of tax filing. Also
included are photos and explanations for the various issues.
The documents mentioned above are available upon request at the Clerk's office.
