the 25' required by the Village of Cayuga heights Zoning Ordinance Section 305-19.A: Yard

ZBA Variance Application for 510 Hanshaw Road. Fence Area {Heisht Variance)
Reasons that the requested variance should be granted:
Having a 6 ft wire fence is important to keep my dog safe from escaping the yard and running into the
street. She taught herself how to jump and climb a 4 ft fence and cannot unlearn these skills. There is
not a suitable alternative to a 6-ft fence. An invisible-fence will 1o'! successfully contain my dog. She is
the type of dog that learns she only gets shocked for a brief time when crossing the line and is then free
to wander. lt is my professional opinion as a veterinarian that invisible fences do not provide adequate
containment for motivated dogs, A physical fence is needed to contain highly motivated dogs.
The character of the Village should not be impacted- the fence will be obscured from view by dense
shrubbery and small trees. The fence will be of the same stvle that manv other homes in the villase use
(black woven wire, deer exclusion type fencing), and will be difficult to spot through a privacy hedge of
foliage. Even if portions of the fence are visible when foliage is thin, the top of the fence will be difficult
to visualize. The requested variance of a 2 ft difference in height should not be a substantial difference
when viewed from the road. The 6 ft height will actually not appear that high from the street, as the
edge of our front yard has a steep downhill from the street so the base of the fence will be set at a
decreased elevation relative to the street height and vantage point from the road, and will therefore
appear shorterthan actual height. We plan to have professional landscapers who specialize in native
plants, The Plantsman, help us beautify and maintain a privacy hedge of native trees and shurbs in the
strip of our yard between the proposed fenceline and the village Right of Way, to ensure we have lovely
foliage between the fence and the view from the roadside.
The requested variance should not have a significant environmental or physical impact on the area- it is
not a solid fence and will not obstruct movements of small mammals or birds common in the village,
and wiil not obstruct drainage of water as it is a >90% transparent fence'
Attached are photos of the front yard with view of the old 4 ft fence from the house, photos from the
street side of the foliage and privacy hedge that obscure the view of the front yard (and will obscure the
proposed fence), a photo of the style of fence we would like to have, and a survey map which includes a
proposed new fenceline (in orange annotation on the survey map).
The PDF of the survey map with proposed fenceline is attached in a separate PDF.
Photographs are on the next pages. For scale, the tape measure is extended to 6 ft in all photos, even
though the ground planned for the fence will be situated below the elevation of the road.
This is the view of the front yard towards the road, with a measuring tape extended to 6 ft height for
scale. The guardrail on the roadside has been annotated, to help show how the plants obscure the yard
from the road and will help obscure a fence. Please note the increased elevation of the road relative to
the yard, which will result in a 6 ft fence appearing shorter than its actual height from the perspective of
the roadside.

Here is a view of the privet hedge which will be obscuring the fence from view from the 5-way
intersection of Hanshaw and Hampton Roads and the driveway side of the yard. The privet hedge is
greater than the 6 ft height of the requested fence, and the fence will not be visible at ali from this
vantage point. Please note how the ground slopes down here, as an example of the lower elevation at
which the fence will be constructed relative to the roadway, enabling even shorter plants to help
obscure a fence.

This is an image from the roadside looking towards the front yard. Note how the dense vegetation
obscures the yard and house from view. As the road is higher than the ground level in the yard, even the
top of the 2-story house is difficult to visualize through the trees and shrubs.

thin, but still sufficient to obscure a fence. The current wire fence is barely distinguishable'

This is an example of the style of fence we are requesting. This fence was constructed by the same
company we are contracted with, Whitmore Fence Company, and this photograph is one they took of a
fence they constructed at a home on Hanshaw Road, just a few houses down the street from our home.
Our proposed fence is of a style that will be in keeping with the appearance of the village.
