Includes roles of Commission officers, especially that of the Treasurer and his/her role as chief financial officer including approval of warrants and budget (language taken from Administrative Policies and Procedures manual) – Paragraph 2, pg 7 (clean) 2. The current AMC states that, after reserving a reasonable amount for contingencies, surplus will be refunded to the municipalities. The proposed change changes this to placing any fund balance surplus into one or more funds – Paragraph 7, pg 15 (clean) 3. Removal of restriction on municipalities obtaining water from other sources – Paragraph 8, p 30 (redlined) 4. Stipulates work and services performed by the Commission, some covered by water sales revenue, some billed to municipality (language taken from municipalities’ Negotiated Work Plans) – Paragraph 9, pg 17 (clean) 5. Specifically lists Town of Ithaca as agent municipality for SCLIWC and municipalities, owner of property (real estate, deeds, easements) – Paragraph 12, pg 22 (clean) 6. Updates info regarding Village of Lansing and Lake Access Road ownership and maintenance – Paragraph 12, pg 23 (clean) 7. Allows new districts (i.e. district extensions in Towns of Dryden and Lansing) without amending AMC (as before) and simplifies the process – Paragraph 15, pg 24 (clean) Also under discussion is the possibility of eliminating Appendix B (in current AMC, this is Schedule D). 8. Expands water sales to non-member municipalities. It generalizes the agreement amendment that was implemented for Ulysses so that further amendments are not needed for future non-members. It also specifically prohibits a receiver of water from selling the water to a third party unless approved by the Commission – Paragraph 16, pp 25, 27 (clean) 9. Addition of expansion of plant section; provides a trigger point for implementing treatment capacity expansion – Paragraph 17, pg 30 (clean) 10. Settlement of Disputes is by judgment of the Supreme Court of State of NY in Tompkins County – changes arbitration to optional – Paragraph 22, pg 32 (clean) 11. Eliminates connection charges in districts formed after the inception of Bolton Point and eliminates Schedule B (Definition of Units for Purposes of Connection Charges) – pg 51, 81 (redlined) Page 2 of 2 12. Majority vote vs. unanimous vote – The current AMC requires a unanimous vote for changing the agent municipality, water rate and structure changes, AMC modification, and adding a non-member municipality. The proposed AMC requires a unanimous vote for changing the agent municipality, water rate and structure changes, AMC modification (possibly with the exception of appendices – these could be changed with simple majority), and decision for arbitration. – pp 8, 15, 16, 24 (current AMC); pp 12, 28, 32, 33 (clean) 13. Includes dissolution of Commission. Provides for allocation of Commission’s assets among members – Paragraph 23, pg 33 (clean) 14. Language update and clarification: water “rents”, removal of historical language (section on financing of initial construction – Projects 1 & 2), full inclusion of Village of Lansing as owner, updated water districts, rearranged sections to a more logical order
