DATE: TO: FROM: February 16,2006 PLANNING BOARD BrentA. Cross, Zoning Officer RE: Phosphorous Treatment WWTP Project,951 E. Shore Drive REPORT: The Village is in the planning phase of a project to install a new phosphorous treatment system at the WWTP. This will involve construction of a small building to house some equipment that will provide the phosphorous treatment function. Although there have been no similar industrial project in the Village, non- residential projects usually reguire the Planning Board to perform Site Plan Review. The main purpose of this process is to review the potential impacts of such a project on the local community and environment. , This particular project has several aspects that may permit the Planning Board to forego the usual process: 1. As the owner of a property dedicated for public service, a municipality is not subject to the restrictions of their own regulations. 2. The Village's Ordinance specifies the Site Plan Review process, limits the application of the process to properties within the Multiple Housing and Commercial Zoning Districts. The WWTP is actually located within the Residence Zoning District. ,/ 3. Due to funding/financing on this project, the Village Board of Trustees are required to conduct a SEQRA review as the owner of the property. Therefore, it seems unnecessary for the Planning Board to go through SEQRA review process, since it would be a duplication of effort. fu/ Basea on the above observations, I recommend that the Planning Board waive iA the Site Plan Review requirement for this project.
