Zoning Board of Appeals
Present: Chairman Robin Cisne, Members Kenneth Robinson, Joe Petrillose, Marian Kira,
Wayne Fleming and Peter McClelland. Others: Brent Cross, Rayinond and Margaret
VanHoutte, Al Biloski.
Chairman Cisne opened the meeting at 7:00 pm and gave an overview of the meeting format
and the meeting requirements. The first case up for review was a request by Raymond and
Margaret Van Houtte requesting to allow an existing 14.8' side yard setback, which is less
than the 15' required, and to allow an existing lot coverage of 15%, which is greater than the
12% allowed in a Residence District, at 1 Strawberry Lane (tax parcel 8.-2-11). Brent Cross
described the situation with the request and reiterated that there was a "miscalculation" on
the numbers used originally to get a Certificate of Occupancy approved. Chairman Cisne
asked if anyone wanted to speak to this situation. No further communication was heard
from residents on this matter.
Motion by Wayne Fleming
MOVE to approve petition for variance to allow Ray and Margaret VanHoutte an existing
14.8' side yard setback, and to allow existing lot coverage of 15% at 1 Strawberry Lane (tax
parcel 8.-2-11).
Seconded by Ken Robinson.
APPROVED by Robin Cisne, Marian Kira, Ken Robinson, Joe Petrillose and Wayne
Fleming
The second action brought before the Board was a request by Alan Biloski to construct a
deck on his home with a 6.V side yard setback, which is less than the 15' required in a
Residence District, at 508 Highland Road (tax parcel 12.-2-5).
Brent Cross spoke on the request. The south side of the house is in full compliance now as
part of the house was removed. The deck addition lines up with the existing structure which
also is under the required 15' setback. Lot coverage is good (9.4%) which is well under the
12%, not including the demolition. No other neighbors have spoken on this. Mr. Biloski
wrote to the owner on the side affected (Michael Steinberg) and he approved.

MOVE to approve the side yard setback.

RE: 1 Strawberry Lane, Tax Map No. 8-2-11
REPORT: In the process of selling the above reference property, the owner's discovered
that their house is not in compliance with the Village Zoning Ordinance.
Specifically, the new survey map indicates that the east side of the house is
14.8' from the property line, which is less than the 15' required by SECTION 6:
YARD REQUIREMENTS. The new map also shows that the existing structures
occupy 15.0% of the lot coverage, which exceeds the 12% that is allow by
SECTION 7: LOT COVERAGE. -r
The applicant has requested a variance per the above section. Therefore a
Public Hearing by the Zoning Board of Appeals has been scheduled for Monday,
November 3, 2003, 7:00 pm at the Village Hall, 836 Hanshaw Road.
Please note the part of the house that is not in compliance is an addition that
was built in the late `80's and was approved to be located 15' from the property
line. Apparently, no official surveying was done and the time and the result was
unintended. In fact, a Certificate of Occupancy was issued by the Village at the
time of completion.
