HomeMy WebLinkAbout03-01-2004Minutes from the Meeting of March 1st, 2004 – 7 Pleasant Grove Lane Village of Cayuga Heights Zoning Board of Appeals Present: Mirian Kira, Ken Robinson, Peter McClelland, Wayne Flemming, Brent Cross, Robin Cisne Attendees: Brigit L. Anderson, David W. Corson, 5 Pleasant Grove Lane At 7:09 pm Robin Cisne opened the meeting and explained the way that the meeting will be run, and the guidelines the ZBA will follow in making decisions. At 7:13 the meeting was started. Mrs. Anderson was surprised at the height issue of the house; their house stands at 30.5 ‘ tall but the Village of Cayuga Heights ordinance states that it can not be above 25’ high. They are not the first owners and would like to remodel. They seek to leave the house as it is in terms of height, they would like to see the paperwork stating the height of the house and what it has been, in case of selling the house in the future, there is no misunderstanding. The remodeling is to be done on the inside of the house. Wayne questions 2 variances – one on the height of the house, and the other on the addition. Brent states that they are both within compliance of Village law. The Building Permit and Certificate of Occupancy were all granted when the house was built in 1977. Wayne and Mirian state that the Village of Cayuga Heights certainly can not NOT grant the variance since the Village of Cayuga Heights granted it in the beginning. Mr. Corson has lived there since 1979, and height has not been a worry. It is not visible to anyone or an issue in the neighborhood. Mr. Corson requests that the 100$ fee be refunded to the applicant. There is no filing fee for an administrative error in the Village of Cayuga Heights. Recommended to the Mayor and Trustees to refund the money. Mrs. Anderson thanks us and is happy to have a letter or certificate. How does the Certificate of Occupancy certify the laws and compliance with the Village of Cayuga Heights law. MOTION by Wayne to approve the variance for an addition on the house. Ken seconds. All in favor, so VARIANCE IS GRANTED. Meeting is closed at 7:27 pm.
