Zoning Board of Appeals Public Hearing and Meeting
Held on January 28, 2008
Board Present: Robin Cisne, Ken Robinson, Sarah How, Robert Powers, and Peter
McClelland; Alternate, Sally Grubbs
Zoning Officer: Brent Cross
Other: Village Attorney, Dave Tyler
Zoning Board Secretary: Mary Jane Neff
Guest: See attached list
The Board met with counsel in a closed meeting at 7:00 PM
The public hearing was opened at 7:43 P.M.
Chairperson Cisne opened the meeting. She explained that the Board would consider Dooley
Keifer’s appeal. She further stated that since the fence area that the appeal was brought to
the ZBA had been removed, this appeal is considered mute.
Chairperson Cisne stated that since Winthrop Wetherbee’s appeal was also regarding the
legality of the fence at 100 West Upland Road; this Board also consider’s this appeal mute.
No further action is required by this Board.
The public hearing was closed at 7:46 PM.
The regular meeting of the ZBA was called to order at 7:46 PM.
A discussion followed among the board members regarding the existing fence and wall
ordinances. Brent Cross presented a slide presentation regarding various fences around the
Village. He defined his definition of a berm and a terrace and then explained how he had
measured various fences, walls, etc. throughout the Village.
It was the consensus of the Board that Chairperson Cisne writes a letter to the Board of
Trustees requesting the Board to amend the current fences and walls ordinance. Some
suggestions to be stated in the letter was to define the terminology used by the code officer,
adopt, as presented or as modified if the trustees deem it to be unclear, the drawings that
explain how fences and walls will be measured, and to re-examine the set back allowance
which allows a fence greater than 4 feet high. They support the ideology that the Village is a
beautiful place to live and that they do not support making it a box community by allowing
taller than 4 foot fences just because of the deer population
This meeting was duly adjourned at 8:45 PM
Respectfully submitted,
Mary Jane Neff, ZBA Secretary
