Dear Mr. Komar:
Our office received your letter on October 16, 2015 regarding your desire to appeal the decision
made by the Village of Cayuga Heights Zoning Board of Appeals in the variance case for 105
Berkshire Road on October 5, 2015.
Should you wish to appeal the Zoning Board’s decision, you may do so by bringing a lawsuit against
the Village under Article 78 of the New York Civil Practice Law and Rules. Due to time limitations
for such lawsuits, it is recommended that you hire an attorney as soon as possible if you would like
to proceed.
In addition, you may also address the Zoning Board of Appeals at the beginning of their November
2nd meeting. It is advisable that you email or drop off written material ahead of that meeting to be
distributed to the Zoning Board for their review. It is possible for the Zoning Board to agree to re-
hear a case if the Zoning Board votes unanimously to do so. This possibly could occur if compelling
evidence is presented that the Zoning Board had not considered.
