REPORT: A zoning permit a lication to allow a new ' iigh wood fence to be constructed on this
property was originally approved. After constr uctioregan, I became aware that the
fence was higher than 4' and closer to the fro it pro i arty line (about 5') than the required
25' front yard setbz ck. Therefore, the origir al apprc%al was revoked, pending proposed
modifications to ob ain compliance.
The owner has now proposed to lower the n ire fen a to 4' high, which will allow it to
remain in its current location, except for on rner of the fence that is installed on top
of a retaining wall. In that location, the fenc Iv fall h i ht would be 7' as measured from
the bottom of the wall to the top of the fenc ince the corner of the fence/wall is
located at 5' from the front property line, w is i is les than the 25' setback required by
Zoning Ordinance ection 6. Yard Requireits, t permit (corner) has been denied.
The applicant has r quested a variance to allc w the existing fence to modified to 4' and
remain in place. Th refore, a Public Hearin s be n scheduled on February 4, 2013
@ 7:00 pm at Villa a Hall, 836 Hanshaw R a , to h r public comment on this case.
