REQUEST FOR A VARIANCE

423 CAYUGA HEIGHTS ROAD
ITHACA,NY 14850
The property of 423 Cayuga Heights Road faces onto both Upland and Cayuga Heights Road.
Tl e street-facing fences along Upland Road are four feet and are within code. The fence on the
n rthwest side of the house, facing Cayuga Heights Road is also four feet and is within code.
The owners of the property, Francis and Elizabeth Moon, request a variance for a property line
fe ce on the north side between 423 and 425 Cayuga Heights Road This fence is a wooden five foot
fence that serves as a privacy fence. It existed at the time we bought the property. The houses are close
tog$ether. Neither the previous owners,the Newells,nor the present owners,the Norens, have had
complaints about this fence. It is weathered gray, has a small gate and is situated within shrubbery.

We also request a variance for the twenty foot long wooden fence and gate on the southwest
sic a of 423 Cayuga Heights Road (see photo). This fence is not obvious to either Cayuga Heights
R ad or Upland Road. The neighbors have indicated that they also have no objection to this fence and
ga e. It is approximately five feet high with weathered gray slats.
This fence serves to block deer who use the property line between 423 and 419 as a deer run.

da age to shrubs long the property line. This fence also serves as a security fence since we have
co lection of valuable sculpture on the back patio.
The current twenty-five foot setback requirement does not allow smaller landowners to enjoy a
protected garden area.
