This letter is to seek a Permit for the fences on the south, west and north sides q]y. I am not seeking a Permit by this letter for the fence on the east side of the property along Hanshaw Road. The fences for which I seek a Permit meet all Cayuga Heights zoning regulations. On the north and south sides the fences are entirely inside the property line with the neighbors to the north and south. The fence on the west side meets the Cayuga Heights requirement of a 25-foot setback from the property line along a road (Highland Road). Each of the fences is more than 90% see through and is of a similar, highly camouflaged color. These fences in no way fail to meet Cayuga Heights restrictions and meet all requirements for a Permit. Enclosed please find a survey map showing the fence locations on the property, a Permit Application and check for $25.00. Thank you very much for your consideration. Sincerely, Fair Gouldin Zoning Board of Appeals April 30, 2012 Village of Cayuga Heights 836 Hanshaw Road Ithaca, NY 14850 Dear Members of the Zoning Board of Appeals, Our property has an 8-foot fence across the east side running along Hanshaw Road. The fence does not comply with the Cayuga Heights requirement to be 25 feet back from the property line along a roadway. I seek a Variance for this fence for the following reasons: 1. A fence in compliance with Cayuga Heights law would fail to protect the 30-50 year old specimen dwarf conifers which are between the property line and the required 25-foot setback. Because these plants run in a continuous line along the entire east side of the property except for a gate area,there is no opportunity to install effective exclosure fencing of single plants or groups of plants.Also,a continuous 4-foot fence would be completely ineffective at protecting these plants. 2. Fifty percent of the fence is entirely and completely screened from view by plant material (bamboo) during 12 months of the year. 3. The rest of the fence has recently been deliberately and very highly screened by deer resistant spirea and forsythia in order to diminish its visibility. Please see attached photographs. 4. The fence complies with regulations in being 90% see through and all materials are similar in color and not brightly colored. (If given a permit, we would change the placement of several fence posts to decrease their visibility and paint them a more camouflaged color.)
