Requested Variance:
We are requesting an area variance so that we can build an 8 foot high fence(6 ft
solid, top 2 ft 50%transparent) on the property line between our house and the neighbor
at 105 Simsbury Dr.
Reasons that the requested variance should be granted:
We feel that our request for an area variance to build an 8 foot high fence on the
property line should be approved due to the numerous safety hazards for children that are
present on the neighbor's property. There is an above ground pool located less than 3
feet from the property line that is not fully enclosed with a fence. The pool deck is
littered with various containers of pool chemicals and bottles of bleach that are in plain
sight from our backyard. There are two separate turtle pens that are also located within
three to five feet of the property line. The pen that holds the larger of the turtles does not
have a cover or anything to keep children or pets from coming into contact with the
turtle. There is a creek that runs through our neighbor's property and behind our
property. Due to the flooding problems our neighbor made the creek deeper and wider in
an effort to prevent the creek from flooding her house. As a result,whenever there is
even moderate rainfall the creek flows significantly faster and the water level becomes
very dangerous. The grass on our neighbor's property is very long, as it is used to feed
the turtles. We have concerns about the length of the grass as it relates to ticks.
We are committed to preserving the beauty and integrity of The Village of
Cayuga Heights. We want a fence that is non-obtrusive and will only enhance our home
and neighborhood. Our neighbor is in favor of a fence between our properties and she
has met with Brent Cross about the need to protect our son/pet from the potential dangers
on her property.
We are concerned about these safety issues because we have a one year old son, a
dog, and we plan on having more children. We feel this type of fence is necessary to
keep our family safe. We are requesting an 8 foot fence (6 ft solid,top 2 ft 50%
transparent)to eliminate visibility and access to the dangers existing on our neighbor's
property.
