DATE: April 26, 2012
TO: ZONING BOARD OF APPEALS
FROM: Brent A. Cross, Zoning Officer
RE: 211 Hanshaw Road
REPORT: A zoning permit application, to allow an 8' high (90% open) fence, has been
denied. The proposed plans indicate that the fence will be located at
approximately 0' from the front property line (Highland Road side), which is less
than the 25' side yard setback required by Zoning Ordinance Section 6. Yard
Requirements.
The applicant has requested a variance to allow the fence to be erected as
proposed. Therefore, a Public Hearing has been scheduled on May 7, 2012 @
7:15 pm at the Village Hall, 836 Hanshaw Road to hear public comment on this
case.
It should be noted that the Highland Road side of this property is considered a
front yard in addition to the front yard on the Hanshaw Road side.

Setback Description
Section
c <25ft Extend height of existing split rail fencing on Highland Rd located on backside of property
using 4'low visibility poly deer fence.Garden arbor with gate to be constructed for access to
Highland Rd.
Points for Consideration:
1. Fence line is located on backside of residential property that abuts Highland Rd.
2. Fence extension will have low visual impact due to existing vegetation between existing 4' split
rail fence and sidewalk(photos attached).
