505 The Parkway
March 2012
Our property is located at 505 The Parkway. Between the two sides on Forest Drive and The Parkway
there is over 250 feet of road frontage and so a substantial portion of our lot lies outside the boundaries
for fencing. One of my favorite activities is gardening. After my husband and I moved to The Parkway
in 2004,we invested many thousands of dollars in plantings and landscaping. Initially, deer were a
nuisance, but not a serious problem with the use of deer-off etc. However, over the years they have
become an increasingly serious issue and by last year they were effectively destroying our garden. In
addition, our dog was getting sick from what the deer left behind and despite efforts to clean up the
droppings,we could never get them all and he was becoming seriously ill, so much so that we were
becoming unable to use the yard for him.
When we bought the house, there was already a picket fence conforming to village regulations along the
Forest Drive and Parkway sides of the property. A year ago in response to our increasingly severe deer
problems, after checking if it was all right with the neighbors,we put up a mesh fence attached to the
picket fence . Copying the fencing used at the Cornell Plantations,we used bamboo poles and mesh.
In addition we painted the poles dark green to blend with the background and planted lilac bushes and
small ornamental trees in front with the plan that over time the picket fence and mesh would not be
visible at all.
Last winter in an attempt to be law abiding, we moved the mesh fence to the 50' set back so that there
were then two fences. However, when lawn cutting time arrived, having a double fence proved
extremely difficult and almost impossible to keep the grass neat. In addition, having two rows of fence
with tall steel posts for the second fence was visually much more intrusive then our original fencing.
Consequently we moved the mesh fence back to the picket fence where it is now.
I would like to request a variance for our road frontage fences because:
1. Our large double frontage considerably increases the hardship of conforming to setback regulations,
and leaves a large share of yard exposed to deer
2. Doing without a high fence would result in the certain destruction of our garden and make it
impossible to use our yard for our dog.
3. Aesthetically having a second, tall mesh fence on steel fence posts beyond our existing picket fence
is much more visually intrusive then the existing arrangement. Right now, with the thin bamboo
poles and light mesh, it is hardly noticeable. Putting in eight foot steel or wood posts will be much
more visible--you will definitely know it is there.
4. With a double fence, it is also much more difficult to keep the landscaping trim.
For all these reasons I hope that you grant a variance and believe this would be in the interests of the
community to do so.
