Kirk’s First Motion (denied)- 1) Fence must remain constructed of lightweight,
collapsible, plastic mesh and bamboo materials which will allow a panicked deer the
ability to get through. 2) The configuration of the fence must remain as is with regard to
the picket fence and deer fence being co-located and the foundation supports of the deer
fencing inside of the picket fence.
Kirk’s Second Motion (granted)-
1. Fence must remain constructed of lightweight, collapsible, plastic mesh and
bamboo materials which will allow a panicked deer the ability to get through.
2. The configuration of the fence must remain as is with regard to the picket
fence and deer fence being co-located and the deer fence (both the plastic
mesh and bamboo posts) remaining inside of the picket fence.
3. The deer portion of the fence must have a jog of at least 10' along the Parkway
portion of the deer fence, no further northward than what is labeled as the
"remains of gravel drive."
4. The jog in the deer fencing portion must extend at least to the 25'setback.
