REPORT: In 2010, the owner constructed a "shed" type building which had a 5' overhang, which
exceeds the 3' allowed without the overhang being counted as lot coverage. This
resulted in the footprint exceeding the 144sf(policy based on building code) and
therefore the shed caused the lot coverage to exceed 12% for which a variance was
sought. At a ZBA meeting, many questions were raised about how such a "shed" should
be handled by zoning, which caused the owner to withdraw his application. He then cut
the 5' overhang down to 3' and therefore I deemed it to be in compliance with the
exemption for small buildings less than 144sf.
Subsequently, Kirk Sigel filed a request for interpretation to consider the shed as a
building that was subject to application of full zoning regulations including lot coverage
and setbacks. The ZBA decided that this particular shed was a building and subject to
full zoning compliance. This decision prompted the Village Trustees to enact a new law
that makes specific provisions to exempt small sheds from full zoning compliance.
The existing shed is 10' wide (with a 3' overhang) x 14' long x 13.5' high. The new law
allows maximum dimensions of 12' wide x 12' long x 10' high with overhangs included.
Since the shed on this property does not fully comply with all of the specific
requirements to allow exemption zoning requirements, the owner is seeking a variance
to allow the storage building to remain as built as a shed.
Therefore, a Public Hearing has been scheduled on March 5, 2012 @ 7:00 pm at the
Village Hall, 836 Hanshaw Road to hear public comment on this case. The following
