The s ied should e detached from the ground. 2. Ha h a foot pr'it equal or less than 140 square ft. Our shed is in compliance with these rules. Before building the shed I have provided drawings to the Village, showing the ed elevation and the footprint.However,those drawings were not necessary to be filed in. After the slied has been built, it has been pointed to me that the overhang should be equal or less than 3 ft. In the spring of 2010 1 applied or a varia ce, to increase the lot occupancy. During the ZBA meeting I withdrawn the applicationr variance and following that meeting we cut the overhang to comply with request. The shed is I ding built in the South m-West corner of the property at 3 ft distance (setback) from the West side neighbor pr erty (fence) and about 3.5 ft setback from the Southern neighbor property line which is directed to a tree at about the Southe West comer of the property. I would like to mention that the West side neighbor moved the fence ab 2 ft towards our prop rty sometime after the shed has been built,claiming that the original fence was not along the true propedy line. When we position the shed our West neighbors were present on site,they were in the total agreemnt with the location and with the shed design. During the construction they liked our shed so much that they wanted s to build similar shed on their property.During that period and for some time after the shed has been built we ha T onderful neighbored r Iationship. Before they moved the fence in the spring of 2010 the distance between the shed and the est property was about 5 ft, sufficient space to install a 5 ft scaffolding which has been used for buil ji ig the shed. Now we un e stand thaour shed is not in compliance with the new regulations which the Trustees have since written. Sped cally,the shed is more than 12 ft on one side and about 13.5 ft in height at the highest point,but the setbacks are Eit out 3 ft or more from t e side/rear property line. In order to remedy this, so we can gel a Certificate of Occupancy for the house,we would like to get a variance for this shed. Th i s variance lia s no negati ve impact on our neighbors and on the overall appearance of the property,but modifying the ilied to comply with the new rules will have a dramatic impact on us. We are since e ly apologizing to you f r the whole issues created to the Village Engineers, in particular to Mr. Brent Cross and te tie Zoning Board mem ers. We respected our neighbors. To us, the neighbors are like an extended family.We a rited to be an example in the community.The design of the shed was intended to add to the beauty of the neighbort cod.We ho ve positioned.the shed in good faith,with our neighbors' verbal acceptance,to minimize the obstruction of the shed to their properties. Any other location of the shed will have a negative effect on our neighbors,b s ructing their viewto the road.
