RE: 876 Highland Road
REPORT: A building permit for a second floor addition on the existing pool house has been denied because
there is a non-conforming side yard setback on the existing structure. The poolhouse was
constructed in 1965 with a setback of 8'-7", which is less than the 15' allowed by the Village of
Cayuga Heights Zoning Ordinance Section 6: Side Yard. Therefore, a zoning variance is required to
allow it to remain in the current location with the addition of a new second floor.
The appeal also involves a request to construct a second story on top of the existing building.
Additionally, the applicant is seeking an interpretation of the Village of Cayuga Heights Zoning
Ordinance Section 5: Height of Buildings to determine exactly how the"height"of buildings shall be
calculated. In the event the ZBA determines the height of buildings should be calculated in a way
that renders the applicant's proposed project to be out of compliance with the current Zoning
Ordinance, the applicant will immediately be seeking a height variance for the second story addition.
Please note, the height variance appeal would be conducted at the same meeting.
Therefore, a Public Hearing has been scheduled on February e, 2011 @ 7:00 pm at Marcham Hall,
836 Hanshaw Road to consider the setback variance and subsequent height interpretation/variance.
