Requested variance or interpretation: Variance to allow existing fence(s)to remain. Reason(s) that the requested variance or interpretation should be granted: The request for a variance should be granted for the following reasons: 1. The fence has two purposes: a. The fence was constructed to enhance our property and the substantial investment in time and money we've spent developing the gardens on our property. Our property was one of the gardens on the National Garden Conservancy's Open Days 2007 tour. Our gardens enhance the beauty of our neighborhood. b. The fence adds aesthetic value to the overall theme of the gardens. The fence is an open design with four rails unevenly spaced(closer at the bottom and more opened at the top)with post caps that enhance the Asian style. 2. The fence has been up since 2000. Before building,we obtained verbal permission from our neighbors and,to our knowledge, there have been no complaints from our 3 neighbors whose property borders the fence. Our property sits lower in elevation to the neighboring properties bordering the fence on the east with 2 of the houses a substantial distance from the fence. The fence does not obstruct any view towards the West from those houses. 3. Our property is not a rectangular or square shaped property. We have no traditional back property line. Our lot is a pie-shaped with extremely large trees and power lines running down the east property line. Because of the uniqueness of the shape of our property,there was no other way we could utilize the full extent of our property without the construction of a fence at this location. Had we constructed the fences with a 15' side yard setback, we would have "lost"a significant amount of our back yard and maintenance of the land within the 15' setback would be difficult,possibly becoming unkempt and aesthetically unpleasant for neighbors' views. 4. The fence is constructed of natural wood, aging to blend in with the surrounding trees, vegetation, and gardens. The fence is constructed with 4 2"x 6"rails per section and 10' posts. The fence is 83% open/see through,which is very close to the 90% see through requirement. Given the location relative to our neighbors' houses, this is a negligible difference.
