Requested variance: this variance request is to allow an existing 6'fence on the right side of the house
to be close to the property line.

Background information:
The house in 816 Triphammer Road, built in the 1930's, is oddly located in the property,with the house
being extremely close to the front (by Triphammer Road) and to the right side of the property. Much of
the property, empty land, is to the left of the house.The 6'fence is located in 816 Triphammer Road to
the right of the house.The right side of the house is extremely close to the neighbor on the right.
When we moved into this house in 2000,there was already an existing 6'fence to the right of the house.
We don't know the exact year when the fence was originally built.The fence was built even before the
previous owner of the house, who started living in the house in the mid 1980's.A neighbor estimates
that the fence was built by the "previous-previous" owner, prior to 1970.Judging by the condition of the
fence, which was rotting and in disrepair, it had been around for decades prior to the time we moved
into the house in 2000.Attempting to incrementally repair the old fence did not prove to be productive,
and about 10 years ago, we had replaced it with new wood.The existing fence has the same footprint as
the old fence.As part of this project,we had taken down the fence at the front of the yard and did not
replace it.We also placed a 4' rail fence to the left and the back of the house. When we were replacing
the fence,the owner(at the time) of the house immediately to the right of our house was very pleased.
Using the same footprint as the old fence, neither we, and as far as we know,the fence contractor, were
aware of the village requirement for a side fence to be further away from the property line. It was not
until this year(10 years after the replacement wood, and possibly decades after the original fence
located in the same footprint was erected) did we get any notification that the fence was not in
compliance.
The following are pictures of the property:

There is not enough space between the property line and the house to satisfy the current village
fence requirement.
4. Picture 4: view of the fence from the backyard. Note that the 6'fence does not go down the
entire length of the property. Further away from the immediate neighbor to the right and
further away from Triphammer road and its sidewalk,the 6'fence turns into a 4' rail fence.
5. Picture 5: picture of left side of the house. Note that the entire left side of the property (grass
foreground in picture) is not fenced-in. Only right next to the house is there a fence (in this
picture is a 4' rail fence).The property to the left of the house is not fenced.
Variance Request
We are requesting a variance to allow us to keep the 6'fence.We need the fence for privacy and
security reasons.The house is very close to Triphammer Road and its sidewalk(about 1%car lengths
from house to road).Triphammer Road is a very busy road, and the sidewalk is very busy with foot
traffic. In addition,the house and the neighboring house to the right are extremely close to each other,
and the fence provides much needed privacy. Moreover,the neighboring house to the right is a rental
property with two rental units.The renters are transient in nature, and seemingly don't reside there for
long. We don't know who the residents are, and are generally not there long enough to get to know.
Security and privacy are especially important with our young children (3 and 4 year olds) and a small dog
(Bichon Frise). Moreover, being close to Triphammer Road,the fence provides additional assurance that
they cannot readily go into a busy street unsupervised.
The fencing is not for deer control.
