I, Ilene M. Lambiase, being duly sworn, depose and say that;
l. I have been the owner(s) of premises known as 406 East Upland Road, Ithaca, NY
14850 since August 14, 1987.
2. The property is improved for and used exclusively as a residential property for one to
four families, and there is no commercial activity conducted on the premises.
3. I have made no structural changes, extension or additions to the improvements located
on the premises since we took title. All structures located thereon have been in their present
location, as shown by an instrument survey entitled "Survey Map No. 406 East Upland Road,
Village of Cayuga Heights, Tompkins County, New York" dated July 28, 1986, prepared by
T.G. Miller, P.C. (copy attached), for at least two years.
4. There are no structures, driveways, paths, fences or other improvements which
encroach onto our premises from any adjoining property and none of our structures, driveways,
paths, fences or other improvements encroach from our premises onto any adjoining property not
owned by us.
5. No neighbor has disputed the location of any of our boundary lines and no person has
in the past or does presently claim any rights to own or use our property or any part thereof.
6. This Affidavit is given to induce the Tompkins Trust Company to place a mortgage on
said premises without the necessity of a currently dated instrument survey of our property. We
understand that Tompkins Trust Company will rely upon the truth of the statements made by us
