A. PUBLIC HEARING 7:00 P.M. December 9, 1968 held in the Village Office.
PRESENT: No residents other than Village officials attended. (See list under
Regular Meeting, plus Village Justice William Tucker Dean.)
Mayor Marcham read the proposed Ordinance Article XVI - Curfew, copy of which
appears in minutes of regular meeting. There being no comments the Hearing was
closed at 7:12 P.M.
B. PUBLIC HEARING 7:15 P.M. held in Village Office.
PRESENT: 2 Village residents (Mr. and Mrs. Krebs).
Mayor Marcham read his prepared statement which was distributed to those present,
explaining the need for additional space to accommodate the police and fire
departments.
Village Justice Dean recommended approval of the planned additions, and retired.
Hearing was closed at 7:25 P.M.
C. MINUTES of a Regular Meeting of the Board of Trustees of the Village of Cayuga
Heights held in the Village Office on Monday, December 9, 1968 at 7 :30 P.M.,
PRESENT: Mayor Frederick G. Marcham, Trustees Ronald E. Anderson, Harold R. Fisher,
Verne A. Fogg, Mary T. Freeman, Carl H. Nelson, Rane F. Randolph; Attorney Roger B.
Sovocool; Clerk Vera W. Snyder; Engineer John B. Rogers; Fire Chief Richard A. Vorhis;
Assistant Fire Chief Edward Olmstead; Police Chief Jack W. McGraw, Sr.; Police
• Sergeant Harlin R. McEwen; Treasurer Gordon B. Wheeler.
OTHERS PRESENT: Peter Walsh, Ithaca Journal reporter, William Kopald, WTKO
representative and WRCU representative. .
VOTED to approve the minutes of November 11, 1968 after inserting the words "to be
effective 12/1/68" in Resolution #1355 after "the year 1968" in the first sentence.
VOTED to approve Abstract of Audited Vouchers dated December 9, 1968 in the
following amounts: General Fund - $6,043.14, Sewer Fund - $3,878.10,
Capital Fund - $572.62.
Mayor Marcham reported attending several meetings, one with Tompkins County
Personnel officers relating to the reclassification of the Village Engineer from
noncompetitive status to competitive status. He requested the classification
remain as it was. It was explained that since our Engineer earned more than $1500
per year and put in from 20 -25 hours a week it is a State regulation the position
be classified competitive. He also mentioned his and Mr. Rogers meeting with the
Workmen's Compensation Insurance carrier representative relative to the Gardner_
case. It was determined the first absence (8 weeks of which was paid by Compensation
Insurance) was all they felt they were responsible for. The last absence was not
eligible for Workmen's Compensation coverage.
The Mayor stated that the Personnel Committee consisting of Trustees Fogg, Freeman,
Randolph and Treasurer Wheeler had completed their deliberations and will perhaps
have some recommendations to the Board tonight. He expressed his thanks to the
• Committee for the time they have given to this study and for the deep and solid
work they accomplished.
The Mayor referred to Treasurer Wheeler's memorandum in regard to a possible Village
bond issue. There was a discussion of the Bond Resolution.

The Attorney recommended that if we use bonding attorneys we should start by having
them prepare the bond resolution.
The Treasurer reported on his contact with Marine Midland Bank in Buffalo. They
recommended we use bond attorneys. The Bank would print the bonds, handle pro-
jection and timing of issue and sale of bonds.
A quotation of $750 was given to Mr. Wheeler for their services for a bond issue
of $200,000 to $215,000.
RESOLUTION #1362 - APPROVE ISSUANCE OF BONDS
VOTED to approve the issuance of bonds for a 21 year period in an amount not to
exceed $210,000; the purposes for the issuance to be as follows:
1) Unpaid Bond Anticipation Notes
2 Cornell Balance
3 Village Hall Additions
4) Contingency on Item 3
5 Legal and Consulting Fees

The Board requested Attorney Sovocool to secure an estimate of cost of services
from Bonding attorneys, Sykes, Galloway and Dikeman for preparation of bond issue
not to exceed $210,000 for a 21 year period.
There was a discussion of Hanshaw Road and Cayuga Heights Road transferred to the
Village from the County, they having had to accept them from the State when Route 13
was completed.
It was decided that the Mayor and Attorney prepare a letter to New York State
Conference of Mayors regarding the transfer of roads from the County to the Village.
Fire Chief Vorhis referred to his report previously furnished to the Trustees and
it is on file in the Village Office.
He stated the Fire Councilmen desire to retain the old fire truck if a third truck
is required by the Fire Underwriters.
Attorney Sovocool reported that the Torn of Dryden desires to change our wording
pertaining to occupancy in the Sewer Contract for District One.
A discussion followed and the following action was taken:
RESOLUTION #1363 - REWORDING OF DRYDEN SEWER CONTRACT
VOTED to authorize the Mayor, Engineer and Attorney to negotiate further with the
Town of Dryden on the rewording of Sewer Contract for Dryden Sewer District No. 1.

Attorney Sovocool presented a proposed Sewer Ordinance Amendment which is necessary
so that the Village ordinances will comply with State Health Department regulations
concerning discharge of metallic matter in the sewer system.

' RESOLUTION #1364 - PUBLIC HEARING AMENDMENT TO
SEWER ORDINANCE
VOTED to hold a public hearing at 7:15 P.M. January 13, 1969 to consider the
proposed changes in the Sewer Ordinance.
The Engineer referred to his report previously furnished to the Trustees and on
file in Village Office and discussed the flow -meter chart and read a letter from
Consulting Engineers Teetor- Dobbins regarding possible reasons for some of the
infiltration.
Engineer Rogers discussed the request from George Abbott of 507 Highland Road for
a fire hydrant on Iroquois Road and the necessary water line to it. There are
two hydrants within a 500 -600 foot radius. Mr. Abbott desires the Village to
consider running a water line down Iroquois Road and erect a hydrant. Engineer
to ascertain cost of installation of line from the City of Ithaca. Also secure
estimated cost of installing the private 2" pipe from Mr. Abbott.
VOTED to approve printing of the Grievance Day Notice to Village taxpayers as
presented by the Village Clerk.

VOTED to authorize the purchase of a new adding machine with a multiplier in an
amount not to exceed $241.40.
RESOLUTION #1365 - WORKMEN'S COMPENSATION INSURANCE
VOTED resolved that the Board of Trustees enter into an agreement with the Utica
Mutual Insurance Company for the purpose of securing adequate Workmen's Compensation
Insurance, the policy to take effect January 1, 1969.

RESOLUTION #1366 - ADOPT CURFEW ORDINANCE
VOTED to approve the adoption of Article XVI Curfew to be added to the Village
Ordinances, effective January 1, 1969 to wit:

ARTICLE XVI
CURFE1
• SECTION I: All children under the age of 16 years are hereby forbidden to be upon
the streets or in any public places or public buildings in the Village of Cayuga
Heights between 11:00 P.M. and one half hour before sunrise unless accompanied by
the parent, guardian or other adult having the care and custody of the minor, or
unless such minor is in the performance of an errand directed by said parent,
guardian or other adult having the care and custody of such minor person, or unless
the business or employment of such minor, engaged in with the consent of the parent
or guardian or other adult having the care and custody of such minor, makes it
necessary to be upon the streets, or other public places in said Village during
the hours specified herein; provided, however, that these latter two exceptions
shall not apply when such minor shall be playing or unnecessarily loitering in or
upon any street or other public places in said Village.
SECTION II: All parents, guardians or other adults having the care and custody of
any child under the age of 16 years are hereby forbidden to permit such child or
children to be upon the streets or in any public places or public buildings in
the Village during the hours above stated unless such child is accompanied by said
parent, guardian or other adult having the care and custody of the minor, or unless
such minor is performing an errand directed by said person or unless the business
or employment of such minor, engaged in with the consent of such person, makes it
necessary to be upon the streets or in any public place or a public building in
the Village.
SECTION III: Failure to comply with this Ordinance sha71 constitute a violation
as defined in the Penal Law of the State of New York and any offender shall be
punished in accordance therewith.
Effective January 1, 1969.
Recommendations of the Personnel Committee were distributed.
The Mayor inquired if the Trustees wished to take action on these recommendations
or take them home and study them and make recommendations at a later meeting. It
was suggested these recommendations be given to all employees for their review and
recommendations.
There was a discussion of the additional space requirements and it was decided to
hold a special meeting for this decision on December 16, 1968 at 4:00 P.M.
It was decided to hold a special meeting on December 23, 1968 at 4:00 P.M. for
the purpose of taking action on the Personnel Committee recommendations.
Meeting adjourned 11:00 P.M.
