Minutes 9/18/1967129 After discussion of the position for an assessor the following action was taken: RESOLUTION 1133 - ASSESSOR RESIDENCE - APPOINT ASSESSOR VOTED to provide that a resident of the Town of Ithaca may serve as Village Assessor, and further provide for the appointment of Donald Franklin as Village Assessor, leis term of service to begin as of June 1, 1967 for one year at $1,000 per annum payable monthly, subject to agreement between the Village Board and Mr. Franklin as to duties and procedures. Wheeler OTHERS PRESENT: Reporter Patricia Nordheimer, Ithaca Journal Ten Village Residents Mayor Marcham called the meeting to order at 7 :30 P.M. and the following actions were taken: VOTED to approve the minutes of meetings held June 19, July 17 and August 14, 1967 as previously furnished to the Trustees in mimeographed form. VOTED to approve Abstract of Audited Vouchers dated September 18, 1967 in the following amounts: General Fund $10,695.94 Sewer Fund $ 6018.95 Mayor Marcham read the petition of Williamsburg Park residents regarding excessive water run -off. Mr: Stuart Lewis, acting as spokesman for the group, restated some of the conditions cited in the petition, described his personal problem, and re- quested immediate action of the Village to alleviate the problem. :Several others affected by water run -off also spoke, asking the help of the Village to solve the' problem before spring rains. 9/18/67 1301 The Mayor summed up the situation and advised the petitioners that water cannot be diverted from its natural run -off. He added that we will take another look at the existing storm drain system on our right -of -way, and, if appropriate, put in further ditches, and where a stream runs on private property, we will investigate to see what we can do about it. The group left at 8:40 P.M. The petition is on file in the Village Office. The Clerk read the one bid received, prepared by V. Giordano Construction and Supply Corp., on sidewalk improvements in the Village of Cayuga Heights Northeast Sidewalk District; the price bid was $38,975.00. The maximum amount proposed to be expended in the petition is $31,100. Mr. Ralph Jones, Attorney, representing the Sidewalk District, suggested we try other alternatives rather than prepare and circulate a new petition.. After a discussion of this bid compared with the bid of 1966 of $25,000 the following action was taken: RESOLUTION 1134 - SIDEWALK BID NOT ACCEPTED VOTED RESOLVED not to accept the bid on sidewalk improvements submitted by V. Giordano Construction and Supply Corp. in the amount of $38,975.00. It was the consensus of opinion that the Engineer be asked to take another look at the specifications,.with the idea of reducing costs and report to the Board on any modifications he regards as possible without significantly changing the sidewalk construction program. Mr. Joseph L. Rosenblum, 1045 Highland Road, complained about unsightly condition ' of next door neighbor's yard, stating he had built a fence to shut out the view only to learn through the Zoning Officer that his fence was in violation of the Zoning Ordinance. He had requested permission for a variance but it was denied by the Zoning Board of Appeals. Mayor Marcham explained that the Board of Trustees did not have the power to change a decision of the Zoning Board of Appeals. Attorney Sovocool advised Mr. Rosenblum that if he so desired, he could file a complaint with the Village Justice and he would decide the issue. The remaining visitors left at 9:30 P.M. Mayor Marcham read his report of activities during the summer and it is on file in the Village Office. Attorney Sovocool again brought attention to the expired Fire Protection Contract with the Town of Ithaca. After discussing the matter, the following action was taken: RESOLUTION 1135 - FIRE PROTECTION CONTRACT VOTED to authorize the Attorney to draft an agreement for fire protection. between the Village and Town of Ithaca for the calendar.year of 1967 for the Northeast Water District and Forest Home, in the amount of $5,800.. There followed a discussion of fire.protection to the Town of Lansing and it was t decided that the Mayor should prepare a letter to the.Town of Lensing Fire District, with the aid of Trustee Nelson, regarding their fire protection contract. 9/18/67 M 1. The Village Attorney is to follow through on Catherwood water easement, - Highland Rd. The Attorney stated that no decision had been received, as yet, on Route 13. We have not received the State's brief, but Mr. Sovocool has learned that the Judge has all necessary papers and is considering the case. A discussion of the proposed sewer ordinance brought out the fact that in ordert.to receive state aid, a sewer ordinance needs to be adopted. RESOLUTION 1136 - PUBLIC HEARING SEPTEMBER 28, 1967 - SEWER ORDINANCE VOTED to hold a Public Hearing for the purpose of considering the adoption of a Sewer Ordinance on September 28, 1967 at 4 P.M. Mr. Boice 'of Pritchard's Corners Station presented revised plans for a three -stall car wash to be located back of the Esso Station. RESOLUTION 1137 = CAR WASH VOTED RESOLVED to authorize the installation of a three -stall car wash (1 two - minute automatic service unit and 2 five - minute self - service units to be connected to the sewer system) in accordance with the lay -out provided and the provisions offered by Mr. Boice, and further RESOLVED to grant to Mr. Boice a permit on the general terms specified in his proposal, the exact language to be determined by the Mayor in consultation with the Village Attorney. Mayor Marcham left at 10:30 P.M. requesting Deputy Mayor. Robert Dean to continue the meeting. Police Chief George read his reports for three months, June, July and August,-and they are on file in the Village Office. Police Chief George explained the need for him to make emergency and experimental regulations regarding traffic problems. After a discussion, the following action was taken: RESOLUTION 1138 - PUBLIC HEARING - ADDITION TO TRAFFIC ORDINANCE VOTED to hold a-public hearing to hear those for or against the proposed addition to Article VI of the Traffic Ordinance regarding Emergency and Experimental Regulations, on September 28, 1967 at 4:15 P.M. in the Village Hall, as as it , ' On recommendation of Police Chief George, the following action was taken:, RESOLUTION 1139_ POLICE DEPAR24ENT - PROMOTIONS AND . SALARY INCREASES VOTED to promote Sergeant McGraw to the position of Lieutenant at a salary of $7,500 per annum; also to. promote Patrolman McEwen to the position of Sergeant at 9/18/67 132 a salary of $6,900 per annum; and to increase the salary of Patrolman Darling to $6,700.per annum; all promotions and salaries to become effective at the beginning of the next pay period, September 23, 1967, and payable bi- weekly. Fire Chief Vorhis read his reports for June, July and August 1967, and they are on file in the Village Office. Engineer Rogers reported on roadwork and completion of the smoke survey of sewer lines by Teetor and Dobbins. The Engineer presented Mr. Schoenfeld's preliminary plans for subdivision of his land in the northeast corner of the.Village for review. RESOLUTION 3.140 - SCHOENFELD SUBDIVISION PLANS VOTED to instruct the Engineer to.advise Mr: Schoenfeld that his plans are acceptable in principle but that.final plans must show drainage detail to conform with natural drainage, including that portion adjacent to but outside of the Village wit* Engineer Rogers stated that he will soon request.bids for the sidewalk snow plow. With reference to the proposed hydrant in the Commercial Zone, Mr. Rogers informed the Board that Mr. Walter Heasley had not committed himself regarding payment toward the hydrant. Mr. Glover of the Carriage House Apartments has paid $2,000 to the Village as his share toward the hydrant cost. The Attorney stated he had presented the water line easement request to Mr. Heasley's lawyer, but that Mr. Heasley has not signed it. Mx. Rogers will discuss the matter further with Mr. Heasley. G -290 -650 G -290 -630 543.34 Cover Workmen's Compensation 9/18/67 133 RESOLUTION 1141 - RENEW BOND ANTICIPATION NOTES NOS. 9 AND 10 DUE OCTOBER 14, 1967 AND NOVEMBER 18, 1967 VOTED RESOLVED to pay $2,000 on the principal of Bond Anticipation Note No. 9 due October 14,, 1967 to the First National Bank and Trust Co. plus interest and renew it in the amount of $60,000 Q 3'% per annum and further RESOLVED to pay $3,000 on the principal of Bond Anticipation Note No. 16 due November 18, 1967 to the Tompkins County Trust Co. plus interest and renew it in the amount of $45,000 CSI 3-,% per annum. Clerk Snyder advised the Board of a request from Charles Collins for an increase of $300 per annum in the contract price for the use of his dump, effective January 1, 1968 for the ensuing year. RESOLUTION 171+2 - INCREASE DUMP CONTRACT TO $1,800 PER YEAR VOTED to increase amount paid to Charles A. Collins, Sr., for use of his dump from $1000 to $1,800 per year effective January 1, 1968. Snyder Village Clerk MINUTES of a Special Meeting of the Board of Trustees held in,the Village Office, 194 Pleasant Grove Road, Ithaca, New York on September 28, 1967., A. PUBLIC HEARING held at 4:00 P.M. to consider a proposed revision of the Sewer Ordinance. PRESENT: Mayor F. G. Marcham Trustees Ronald E. Anderson Verne A. Fogg Mary T. Freeman Race F. Randolph Engineer _ John B. Rogers Police Commissioner Lowell T. George OTHERS PRESENT: Reporter Patricia Nordheimer, Ithaca Journal The Mayor announced the holding of a Public Hearing on a proposed sewer ordinance and reported that information regarding the Hearing and 'a description of the proposed sewer ordinance had been published and posted as the law requires. He distributed copies of the proposed ordinance. Members of the Board and the Engineer discussed the appropriateness of defining domestic sewage so as to include the waste water produced by automobile washing stations, cleaning or dyeing works, laundries and similar establishments. They had in mind the implied acceptability of such wastes, under stated conditions, as suggested by Section 7, subsection (i). No other villagers appeared. The Mayor declared the Hearing closed at 4:12 P.M. B. PUBLIC HEARING held at 4:15 P.M. to consider an amendment to the Traffic Ordinance. PRESENT: Same as above. The Mayor announced the holding of a Public Hearing on an amendment to the Traffic Ordinance to allow the Police Commissioner in certain circumstances to install traffic signs temporarily.. Copies of the,proposed amendment were available for inspection. The Mayor stated that information regarding the amendment had been published and posted as the law requires. , No other Villagers appeared. The Mayor declared'the Hearing closed at 4:25 P.M. 9/28/67
