Held at 7 :00 P.M. to consider adoption of an ordinance regulating regis- tration and use of bicycles. No residents present other than Village Officials (see below).. Hearing closed at 7:15 P.M. B. Held at 7:15 P.M. to consider granting easement to Nev York Telephone Co. to lay underground cable in the Village. No residents present other than Village Officials (see below). MINUTES of a.regular meeting of the Board of Trustees of the Village of Cayuga Heights held at the Village Office on Monday, December 18, 1967. PRESENT: Mayor F. G. Marcham Trustees Ronald E. Randolph Mayor Marcham called the meeting to order at 7:30 P.M. after the-three public hearings. VOTED approval of the minutes of meeting held November 20, 1967, copies of which were previously furnished to the Trustees. VOTED approval of the Abstract of Audited Vouchers dated December 18, 1967 in the following amounts: General Fund $6,660.01 Sewer Fund $$ 243.44 Mayor Marcham gave his report for the period since. the November meeting. Representatives of the Seventh Day Adventist Church desire to build a church in the Village. The Mayor informed them of the Village ordinances regarding churches and the necessary procedure to request a variance. Chief George's report on Police activities for the month of November 1967 is on file in the Village Office, copies of which were mailed to the Trustees with the Agenda. Chief George referred to page 3 of his report regarding signs and stated he had contacted Town Highway Department and had been informed they were too busy to make signs for the Village. Engineer Rogers is to contact the Town Superintendent of Highways to ascertain the possibility of having this work done at some future date. The Police Chief requested reimbursement of Patrolman Reynold's tuition charges for a police science course. RESOLUTION 1173 - REIMBURSEMENT PATROLMAN REYNOLDS VOTED to reimburse Patrolman Reynolds in the amount of $26.00 for tuition paid to Auburn Community College for a police science course. iF it• iF There was a discussion of the complaint against Atwater's Super Duper Market. A pile of refuse and boxes at the rear of the store is not only unsightly but a fire hazard as well. Mayor Marcham agreed to write a letter to Atwater's Super Duper Market with a copy to the President of Community Corners. Chief George requested the approval of the Board to purchase the' International Association of Chiefs of Police sight -sound training series for $260.00 , 12/18/67 M5 RESOLUTION 3.174 - PURCHASE OF TRAINING SERIES VOTED resolved to authorize the purchase of International Association of Chiefs of Police sight -sound training series for Police Department in the amount of $260.00. Mrs. Shirley Travis, part -time typist in Police Department is leaving January.15, 1968 - RESOLUTION 1175 - EMPLOY TYPIST . VOTED to authorize appointment of Mrs. Barbara C. Potter to the position.of part - time typist in the Police Office..as,.of:..January 21 1968, four.hours a day at $2.10 per hour payable monthly. dE 9E VOTED to accept report of Fire Chief Vorhis on the activities of the Fire Department for the month of November.1967 and place it on file. Attorney Sovocool reported on Court of Claims decision in land take. case. Judge. Young's decision covered thirteen pages and is on.file in the Village Office.. Damages in the slim of $47,500 were awarded to the Village for direct and conse- quential damage, with interest thereon from January.15, 1963 to July. 15, 1963 and from October 21, 1964 to date of entry of judgment (December 5,.1967)- Easement to the north believed to be too speculative to consider at this time. Damages for the frustration of future plans cannot be allowed. . Copies of the decision to be sent to Trustees and our Consulting Engineers, Teetor and Dobbins. A discussion of.the proposed Bicycle Ordinance.with a few minor changes resulted in the following action: RESOLUTION 1176 - ADOPT.ARTICLE XV VOTED resolved to adopt Article XV, Registration and Use of Bicycles:. SECTION 1 - Definition. The term bicycle shall mean and include every device propelled by the feet acting upon pedals, having two wheels. SECTION 2 - Registration required. a. No resident,of the Village of Cayuga Heights shall ride or, operate a bicycle upon the public highways, parks, sidewalks or public places in the Village..of Cayuga. Heights unless such bicycle shall have.been registered as herein provided and shall conspicuously display the.required license plate or sticker. . b. The parent of any.child and the guardian of any,ward shall not authorize -or ' knowingly permit any such child or ward to violate any.of the provisions of this Article. SECTION 3 - Issuance of registration cards and plates. a. Applications shall be made to the Police Department upon a form provided by. the Village. 12/18/67 146 b. The Police Department, upon receiving proper application therefor, shall issue bicycle registrations and renewals thereof, together with license plates or stickers. Each bicycle shall be inspected by the issuing officer and the bicycle I must comply with the New York State Vehicle and Traffic Law as to condition and safety equipment before being licensed. SECTION 4 - Fees and expiration of registrations. The fee for issuance of such registrations shall be fifty ($ -50) cents. Such registrations shall be issued for a period of two (2) years and shall expire on March 31, 1970. Renewals shall expire on March 3lst every two years thereafter. Lost registrations or license plates or stickers will be replaced upon the payment of a fee of fifty (MO) cents each. SECTION 5 - Transfer of registration. It shall be the duty of every person residing in the Village of Cayuga Heights who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the Police Department the registration issued to such owner together with the name and address of the person to whom the bicycle is sold or transferred. Notification shall be made within five (5) days of the date of sale or transfer. The license plate or sticker issued to the seller or transferor shall not be valid unless validated by an issuance of a registration to the buyer or transferee upon application duly made. SECTION 6 - Regulations. No person shall willfully or maliciously remove destroy or alter the number on ' any bicycle for which a registration has been procured pursuant to this Article. SECTION 7 - Penalties. Violation of this ordinance shall constitute disorderly conduct, punishable by a fine not in excess of $15.00 for each offense, and, in addition the Village Court may order the removal and detention of the registration,plate or sticker from such person's bicycle for a period not exceeding ninety days. Effective April 1, 1968. Attorney Sovocool presented the Telephone Company easement and stated he wants to secure the consent of the company first and then will bring it back for final approval of the Board at a future date. RESOLUTION 1177 - ADOPT AMENDMENT TO ARTICLE VI VOTED resolved to amend Section 82, Parking Prohibited in Designated Locations, of Article VI, Traffic Ordinance, paragraph l.k. to read as follows: k. On the east side of Cayuga Heights Road within the right of way line from the southVillage line north for 160 feet. 12/18/67 1'47 Commenting on the Engineer's Report, Mayor Marcham suggested a letter go out to those residents found to have illegal connections to the sewer system such as downspouts, e foundation drains, etc., as. indicated in Teetor and Dobbins' report on Infiltration Survey. No final answers to our letters of June 9, 1967 from Town of Ithaca Supervisor Kerr, Town of Lansing Supervisor Dates and Town of Dryden Supervisor Todd on infiltration in their respective sewer districts. RESOLUTION 1178 - BROOK LANE SEWER LINE VOTED to authorize the Engineer to investigate possibility of having City of Ithaca Public Works Department replace entire length of 6" sewer line with 8" sewer line in Brook Lane. A letter has just been received from Mr. George Glover regarding fire hydrant installation in the Commercial District. Mr. Heasley to be approached by. Trustee Nelson to see if he will reconsider the amount of his contribution to installation cost of hydrant. Trustee Nelson recommended that the light on Hanshaw Road be moved 40 feet east to be opposite Forest Drive; also that a light for the parking lot be connected to the street lighting system. RESOLUTION 1179 - PARKING LOT LIGHT VOTED to authorize Trustee Nelson to approach Mr. Lacey of the New York State Electric and Gas Corporation to seek his advice on the installation and cost of a light in the parking lot.to the north and west of the Village Hall. 9F 9E 9E RESOLUTION,1180 - SIDEWALKS VOTED to authorize the Engineer to draw up new specifications for sidewalks in the Sidewalk District and new time table requirements as he sees fit. Engineer Rogers read a complaint from Mr. Oscar S. Rothaus of 106 Devon Road regarding hazardous curve in Devon Road in front of his residence. Trustees recommended the letter be referred to the Police Department for investigation and report. Treasurer Wheeler's Report for the Six Month period June 1, 1967 to November 30, 1967 showed the following bank balances: General Fund . RESOLUTION 1182 - AUTHORIZE PREPARATION OF TAX ROLL, BILLS VOTED to authorize the preparation of the Tax Roll and bills by the County Assessment Department at an annual cost of between $200 and $250. RESOLUTION 1183 - TITLE CHANGE - DELSERT GROVER , VOTED to change title of Delbert Grover from "Maintainer" to "Assistant Sewer Plant Operator," instead of to "Shift Operator," as previously voted. iE iF iF RESOLUTION 1.184 - MOTOROLA CONTRACT VO'T'ED to execute the new Motorola Contract for servicing radio equipment for the Police Department in the amount of $23.00 a month.
