MINUTES of a Public Hearing on the petition for forming a sidewalk district, held
at the Village Hall, 194 Pleasant Grove Road: Ithaca, New York on March 13, 1967

Fifteen Village

Mayor Marcham opened the Hearing by explaining the requirements for forming a
sidewalk district in the Village and outlining the boundaries of the proposed
District.
A number of residents spoke in favor of the proposed ";sidewalks and several ad-
vocated a larger district to include part of the Town of Ithaca between the
Village line and the Northeast School.
The method of allocating the cost was discussed: Occupied lots = 1 unit;
Unoccupied lots = l :unit; and 1 acre undivided land = 1-unit.
This concluded the Public Hearing.

After a discussion of the Petition for formation of the Northeast Sidewalk District,
Attorney Sovocool presented a proposed resolution and after certain revisions were
made the following action was taken: ' . . '
RESOLUTION 1053 - NORTHEAST CAYUGA HEIGHTS SIDEWALK DISTRICT
VOTED resolved`.WHEREAS, persons owning real property in the proposed Northeast
Cayuga Heights Sidewalk District in the amount of more than one -half (2) in value
of the taxable real property within the proposed sidewalk.district as appears by
the last preceding completed assessment roll have petitioned the Board of Trustees
of the Village of Cayuga Heights for the establishment of a Northeast Cayuga Heights
Sidewalk District,:and
WHEREAS, said petition has been duly filed with the Board of Trustees of the
said Village on the 13 day of February, 19671 specifying that sidewalks shall be
constructed at a cost not to exceed $24,880.o0, to be borne by local assessments
on property within the district and interest not to exceed five per cent (5%) based
upon a unit method of one (1) unit per lot within'the said proposed district, and,'
WHEREAS, the Board of Trustees by resolution ordered a public hearing to be
held on the 13th day of March, 1967, at 7 :00 P.M. at the Village offices,in the
Village of Cayuga Heights, and
WHEREAS, a notice of time, place and purpose of such hearing was given by the
Board of Trustees by posting such notice in two public places within the Village
over seven (7) days prior thereto and by publishing a notice in the official news-
paper once, seven (7) days immediately preceding the hearing, and
WHEREAS, a public hearing was duly held on the 13th day of March, 1967, at
7:00 P.M. at the Village Office in the Village of Cayuga Heights, New York,
Now, upon the evidence given upon said public hearing and upon motion duly
made and seconded,'it is
RESOLVED AND DETERMINED that the notice of hearing was duly posted and pub -
lished in due form as required by Local Law #1, of the year 1966, of the Village of
Cayuga Heights, and it is further
RESOLVED AND DETERMW that all the property and property owners within the
proposed district are benefited by the establishment of a sidewalk district, and
it is further
RESOLVED AND DETERMINED that all the property and property owners benefited
are included within the limits of the proposed sidewalk district,. and it is further
RESOLVED AND DETERMINED that the establishment of the Northeast'Cayuga Heights
Sidewalk District is in the public interests, and it is
RESOLVED, DETERMINED AND ORDERED, that a sidewalk district be established in
the Village of Cayuga Heights, Tompkins County, New York, to be disignated as the
' Northeast Cayuga Heights Sidewalk District and to be of the following description
and boundaries, to wit:
ALL THAT TRACT OR PARCEL OF LAND situate, lying and being in the
Village of Cayuga Heights, Tompkins County, New York, and beginning
at the intersection of the center line of North Triphammer Road with
the north line of the Village of Cayuga Heights; thence southerly .

along the center line of North Triphammer Road to the most southerly
corner of premises now-or formerly of Lawrence Scott (known as 830
Han""shaik). thence_ northeasterly: 202 feet: to'a.:southeast corner of
said Scott property; thence,southeasterly along the south line of property
now or formerly of Richard S. Hill and wife and James A. Fay and wife,
318.5 feet, more or less; thence northerly along an east line of said
Fay premises 380.5 feet, more or less; thence easterly 450 feet, more
or less, to the east line of the Village of Cayuga Heights; thence north
along an east line of the said Village to its northeast corner; thence
westerly along the north line of the said Village to the point and place
of beginning.
and it is further
RESOLVED, DETERMINED AND ORDERED, that the Village of Cayuga Heights' shall
cause to be constructed four (4) inches thick:And four (4) feet wide, portland
cement concrete sidewalks on the Village right of way lying generally adjacent
to adjoining property lines on the east line of North Triphammer Road from the
north line of the said district to•the south line of the said district and along
the south line of Winthrop Drive as it bends and turns from the east side of North
Triphammer Road to the east line of the said district at a cost not to exceed
$24,880.00, to the owners within the district, with said costs to be assessed to
said owners at one unit per occupied lot and one -half unit per vacant lot and all
land not subdivided to be assessed at one unit per acre until such time as such
land is subdivided, and it is further
RESOLVED, DETERMINED AND ORDERED, that upon completion of said improvement
the cost of constructing the same shall be assessed according to Section 5 of
local law #1, of the year 1966, of the Village of Cayuga Heights.

Mayor Marcham read a letter fram Teetor and Dobbins in reply to his inquiries
copy of which is on file in the Village Office.
After a detailed discussion, the Board decided to invite Teetor and Dobbins to
submit an:.apprcpriate draft of an agreement under which they will operate to
carry out their services as consulting engineers as indicated in their letter of
February 23, 1967 and to suggest that the agreement be in two alternative forms;
one to separate out the infiltration program from the rest, and thus to make
necessary two agreements, and the other a single agreement for the total program.
The Mayor gave the report of the Police Commissioner for the month of February
and it is on file in the Village Office.
Attorney Sovocool reported working on an ordinance to cover the traffic control
problem at the Corners Community Center. He stated he will report on the New
York Telephone Company's request for franchise to lay underground conduit in the
Village at our next meeting.
The Attorney informed the Board of a complaint by Max Black, 408 Highland Road,
against Ceracche Television Cable Corporation. Originally one small cable strung
in front of his residence, now has three large cables and he demands they be
removed. The Television Cable Corporation would not do so. .KY. Black claims
the cable is on his property - could be in our right of way.
Attorney Sovocool reported on the following matters: 1. Letter to residents '
who have not removed their diseased elm trees has been written. 2. Court of
Claims case presents.nothing new and still postponed to June. 3. Hahn and
Thaler certiori proceedings adjourned with no action. 4. Liberman case, being
handled by Mr. Mulvey will come up in May.

RESOLUTION.1055 - LEASE POLICE DEPARTMENT OFFICES',
VOTED to authorize the Mayor and Attorney to execute the lease.for Police'
Department offices with Mr. Heasley. .
Fire Councilman Vorhis gave his report for February 1967 and.it is on.file in
the Village Office.
Engineer'Rogers reported that the used truck for $4,000 which 'the Board approved
purchasing 2/13/67 is in good condition and that he will draw.up specifications
for truck.-and follow the regular bid process.

The Assessor's report is on file in the Village Office.
Engineer Rogers reported on non- payment.of.bill rendered November 9,.1966 to the
Town of Lansing for water charge of $1,311.21 for connection to and use of:Village
owned water lines and tanks. He also advised the Board that no sewer district had
been formed for the area including the sewer main installed from.Ithaca Associates,
Inc. through Catherwood property and.connected to the Village sewer system at
Berkshire Road.
(Howard Johnson) Ithaca Associates, Inc, is'now connected to the Village Sewage
System without 9*mm a permit.
The Beard instructed the Mayor to write the necessary,letters:to Mr. Catherwood,
Mr. Schoenfeld and (Howard Johnson) Ithaca Associates, Inc.; also letter,to Town.
of Lansing on:watek..bill and to City of Ithaca about the water situation.

RESOLUTION 1056 - ITHACA ASSOCIATES, INC. SEWER PERMIT
VOTED to authorize the Mayor to execute a sewer permit to (Howard Johnson) Ithaca
Associates, Inc. to June 1, 1967 after being drawn up by the Attorney.

VOTED resolved to set April 31 1967 as date for the Annual Organization Meeting of
the Board of Trustees at 8:00 P.M. (VL Sec. 87).
RESOLUTION 1058 - BUDGET HEARING
VOTED resolved to set date for Public Hearing on the 1967 -68 Budget, April 3, 1967
at 7:30 P.M. (VL Sec. 109).

Village Office, 194 Pleasant Grove Road, Ithaca, New York on April 3, 1967 at 8 P.M.
A. PUBLIC HEARING held at 7:30 P.M. to consider the Tentative Budget for 1967 -68
