Snyder Village Clerk MINUTES of a Special Meeting of the Board of Trustees held in,the Village Office, 194 Pleasant Grove Road, Ithaca, New York on September 28, 1967., A. PUBLIC HEARING held at 4:00 P.M. to consider a proposed revision of the Sewer Ordinance. PRESENT: Mayor F. G. Marcham Trustees Ronald E. Anderson Verne A. Fogg Mary T. Freeman Race F. Randolph Engineer _ John B. Rogers Police Commissioner Lowell T. George OTHERS PRESENT: Reporter Patricia Nordheimer, Ithaca Journal The Mayor announced the holding of a Public Hearing on a proposed sewer ordinance and reported that information regarding the Hearing and 'a description of the proposed sewer ordinance had been published and posted as the law requires. He distributed copies of the proposed ordinance. Members of the Board and the Engineer discussed the appropriateness of defining domestic sewage so as to include the waste water produced by automobile washing stations, cleaning or dyeing works, laundries and similar establishments. They had in mind the implied acceptability of such wastes, under stated conditions, as suggested by Section 7, subsection (i). No other villagers appeared. The Mayor declared the Hearing closed at 4:12 P.M. B. PUBLIC HEARING held at 4:15 P.M. to consider an amendment to the Traffic Ordinance. PRESENT: Same as above. The Mayor announced the holding of a Public Hearing on an amendment to the Traffic Ordinance to allow the Police Commissioner in certain circumstances to install traffic signs temporarily.. Copies of the,proposed amendment were available for inspection. The Mayor stated that information regarding the amendment had been published and posted as the law requires. , No other Villagers appeared. The Mayor declared'the Hearing closed at 4:25 P.M. 9/28/67 ]35 C. SPECIAL MEETING of the Board of Trustees was called to order at 4:26 P.M. by Mayor Marcham. ® PRESENT: Same as above. There was discussion of the proposed Sewer Ordinance and the following action_.was taken: RESOLUTION 1147 - ADOPTION OF SEWER ORDINANCE VOTED RESOLVED to adopt the proposed Sewer Ordinance with the following additions in Section I. In the third sentence, after the words "both public and private" to add "automobile washing stations, cleaning and dyeing works, laundries and similar establishments," these words.to precede the words "bathtubs, shower baths, or equivalent plumbing fixtures." �t �t (NOTE: Full copy of Sewer. After discussion the Board took the following action on the proposed amendment to the traffic ordinance:: RESOLUTION 1118 - ADOPT AMENDMENT TO TRAFFIC ORDINANCE VOTED RESOLVED to adopt the proposed amendment to the Traffic Ordinance as follows: 1 AMEN24ENT TO ARTICLE VI, TRAFFIC ORDINANCE DELEGATION OF POWERS SECTION 30 - Authority of Police Department to regulate traffic. 2. Emergency and experimental regulations. a. Authority, limitation. The chief of police by and with the approval of the Village Engineer and Mayor is hereby empowered to make and enforce temporary or experimental traffic regulations to cover emergencies or special conditions. No such temporary or experimental regulation shall remain in effect for more than one hundred twenty (120) days, without formal action by the Board of Trustees. b. Tests. The Village Engineer may test traffic control devices under actual conditions of traffic. Effective October 10, 1967. The Police Commissioner reported that recommendation of the Committee which had interviewed candidates for the post of Village Police Patrolman. Following his report and recommendations the Board took the following action: RESOLUTION 1149 - APPOINT POLICE PATROLMEN VOTED to appoint the following as.police patrolmen: Larry Cooper, his appointment to begin October 10, and William Reynolds, his appointment to begin October 14, the ' salary for each to be at the rate of $5,800 per year payable bi- weekly.• iF dF iF Engineer Rogers reported a meeting he and the Mayor had:had with residents of North Triphammer Road regarding stump removal and major grading in connection with.the 9/28/67 136 installation of sidewalk'in that neighborhood. After discussion, the Board Passed the following resolution: RESOLUTION 1150 - SIDEWALK PREPARATION VOTED.to authorize the Engineer to remove stumps and to finish major grading in preparation for installing a sidewalk on North Triphammer Road from Winthrop Drive northwards to,the Village Line and to keep a record of the costs so that they may be charged against the Northeast Cayuga Heights Sidewalk - District. Marcham, Mayor Clerk pro tem MINUTES of a Regular Meeting of the Board of Trustees of the Village of Cayuga Heights held in the Village Office October 16, 1967 at 7:30 P.M.. .. PRESENT: Mayor F.. "G. George Treasurer Gordon B. Wheeler Clerk Vera W. Snyder OTHERS PRESENT: Mrs..Patricia Nordheimer, Ithaca Journal "Mitch" Davis, WTKO Radio Station ABSENT: Trustees Mary T. Freeman and Carl H. Nelson -" VOTED.to approve minutes of meetings held September 15 and-28) 1967 copies of which were previously furnished to the Trustees. VOTED to approve the Abstract of 'Audited Vouchers dated October 16, 1967 in the following amounts:. General Fund $3,815.67 Sewer Fund. $3,177.79 Trust and Agency Fund 1,486.39 . Capital,Fund. ".. 4,170.00 Mayor Marcham gave.his report on his activities since the last meeting, copy of which.is on file in the village Office., The Mayor explained the Outfall'Pipe:. Damage Suit.against Leonard Liberman and stated that the case had been settled out of Court. The Village is to receive $3,000 for damages, Liberman is to , drop his counter -claim and cancel most of the 1957 stipulation, set forth in.the settlement of condemnation proceedings, and the Village.is to.offer no objection to a State grant for him to develop his marina. Copy of agreement is attached. lo/16/67 137 Mr. Payne of the Lansing Fire District had called the Mayor in reply to his letter ' regarding the fire protection district to be covered by our Fire Company. He stated that the area covered was to remain the same as now in effect. The Mayor read a letter from Village. Justice Dean suggesting "Speed Zone Ahead" signs be erected just outside the Village limit on Hanshaw, Pleasant Grove and North Triphammer Roads and that Triphammer Road name be changed to South Triphammer Road. Police Chief George reported on the activities of the Police Department for the month of September 1967 and his report is on file in the Village Office. Mr. George informed the Board that he believes it advisable to erect a railing around the curve on Triphammer Road where two bad accidents had occurred, to prevent cars from leaving the roadway. He recommended that a committee be appointed to investigate the situation. The Mayor appointed the following committee to investigate and report on the desirability of erecting a protective railing on Triphammer Road as stated above: Carl H. Nelson John B. Rogers Lowell T. George There was a discussion of Village Justice Dean's request for "Speed Zone Ahead" signs and the following action was taken: RESOLUTION 1151 - "SPEED ZONE AHEAD" SIGNS VOTED RESOLVED to authorize the Mayor to request permission of the supervisors in the Town of Ithaca and Town of Lansing for the Village to erect "Speed Zone Ahead" signs just outside the boundary of the Village, in the Town of Ithaca on Pleasant Grove Road and in the Town of Lansing on North Triphammer Road. AND FURTHER RESOLVED, if permission is granted, to authorize the Clerk to purchase the signs. Fire Chief Vorhis read his report of activities by the Fire Department for the month of September and it is on file in the Village Office. Chief Vorhis reviewed the telephone situation in the Fire Department which now costs $55.20 per month, or $662.40 per year. He proposed installing in the Fire Station a Limited Business Line (75 calls per month plus 5¢ per call thereafter) at a cost of .................... ............................... 7.55 An extension on second floor above Fire Station........... 1.35 An extension at Ithaca Fire Station........ ........... 4.85 TOTAL $13.5 per month or $165.00 per year. The Telephone Company is presently checking the entire telephone set -up including leased lines for the Fire Department. The proposed change in telephone installations would, of course, require the cooperation of the Ithaca Fire Department, which has a qualified dispatcher on duty 24 hours a day. Mr. Vorhis presented a suggested letter to Chief Weaver of the Board of Fire Commissioners, City of Ithaca, requesting their cooperation in answering our fire phone. 10/16/67 138 RESOLUTION 1152 - FIRE DEPARTMENT TELEPHONE SYSTEM VOTED RESOLVED to ask the Ithaca Board of Fire Commissioners if they will grant permission for installing and answering an extension of the Village of Cayuga Heights emergency telephone on their dispatcher's desk in the Ithaca Fire Department and, if so, under what conditions they would be willing to do so. RESOLUTION 1153 - MAIL REPORTS TO TRUSTEES PRIOR TO MEETINGS VOTED to request the Attorney, Engineer, Fire Chief and Police Commissioner to prepare their monthly reports early enough to be mailed to the Trustees three or four days before the meetings. Attorney Sovocool stated no news had been received on the status of Route 13 land claim from Judge Young's office. It is expected that the State will appeal the decision if it is in our favor. Engineer Rogers reported that they have encountered difficulty in the stump removal on North Triphammer Road since the Village equipment is not adequate for such large stumps. RESOLUTION 1154 - srw REMOVAL VOTED to authorize Engineer Rogers to employ assistance of Messrs. Lynch and Ewanicki for removal and destruction of stumps in the path of the sidewalk on North Triphammer Road, the cost estimated to be $700 and charged against the Northeast Cayuga Heights Sidewalk District. 9E 9F iF Mr. Rogers reported on the bid opening at 12 Noon, Friday, October 13, 1967 for a sidewalk snowplow. Two bids were received. 1) Elliott & Hutchins, Inc., Malone, New York Bombardier 70" blade - $5400.00 Delivery,- 45 days 2) Seneca Supply & Equipment Co., Inc., Ithaca, New York Cayuga Model L 13 - 4 wheel drive tractor with cab - $3215.00 Alternate bid - 60" reversible angle blade interchangeable with above V plow $238.00 Delivery immediate (Does not meet specifications.) Engineer Rogers explained the superiority of the Bombardier over the other make for our requirements and recommended its purchase. RESOLUTION 1155 - CONDITIONAL ACCEPTANCE OF SNOW PLOW BID VOTED RESOLVED to accept the bid of Elliott & Hutchins, Inc., for a Bombardier I Snow Plow at a cost of $5,400.00, subject to favorable results of consultations with users of this equipment under conditions similar to ours. 10/16/67 *aF* 139 Mr. Rogers read Jack Bebbington's letter in regard to future plans for extension of Randolph Road and his desire to know the attitude of the Board concerning the terminal point for Randolph Road. Mr. Rogers to reply to Mr. Bebbington's letter 1 with information based on the preliminary plan for the area submitted by Otto B. Schoenfeld to the Village. The Engineer had prepared a letter to all users of the Village Sewer System and the Board approved its content. He also presented a proposed letter on trimming of overhanging shrubs and received several suggestions to revise certain sentences. RESOLUTION 1156 - APPROVAL OF OVEAi'IME VOTED to approve overtime for September previously approved by the Engineer for the following: Garvin, 7 hours $18.75 Truax, 3 hours 7.95 Gardner, 8 hours 18.40 Grover, 4 hours 10.80 RESOLUTION 3.157 - SALARY INCREASE - ROSE M. TIERNEY VOTED to confirm approval, given by the Trustees in a telephone poll on September 20, 1967, to increase the salary of Rose M. Tierney from $4,330 to $4,680 effective October 1, 1967. as ae ic• ' RESOLUTION 1158 - PAY NOTARY PUBLIC FEES - ROSE M. TIERNEY VOTED to pay Notary Public fees incurred by Mrs. Tierney to become a Notary Public in the amount of $11.00. at• at• �• RESOLUTION 1159 - RE LIBERMAN SUIT - OUTFALL PIPE DAMAGE VOTED to confirm action taken as a result of a telephone poll of Trustees on October 5 regarding accepting advice of our attorneys in the outfall damage suit against Leonard B. Liberman to settle for some sum between $4,000 and $3,000. it �• it Clerk Snyder informed the Board that the Village may by adoption of a new resolution participate in the 160th or Non - Contributory Retirement Plan. Estimated cost to the Village about 8% instead of the present 5%. If the Village adopts a resolution they will not be actually billed until March 1969.
