Minutes 10/18/19561 A) PUBLIC HEARING was called to order at 7:00 P.M. on October 18, 1965 by Mayor Marcham by reading the official notice of same: "NOTICE OF PUBLIC HEARING ON PROPOSED ORDINANCE ". NOTICE IS HEREBY GIVEN, that a Public Hearing will be held by the Boatel of Trustees of the Village of Cayuga Heights at the Village Hall, 194 Pleasant Grove Road in such pillage on the 18th ✓ day of October 1965 at 7:00 o'clock in the evening of that day to consider amending Article III on Fumigation and Fires by adding as second paragraph restriction on outside burning of rubbidh, trash and leaves." Three residents appeared in addition to village officials, two residents opposed any restriction on burning brush and papers. Fire Chief Morse explained the hazards of such fim and gave instances of considerable damage originating from just such sources. In addition to danger of fires getting out of control, there is the matter of pollution of the air as well as the expense of caking out the fire department: Later after the Hearing had closed two gentlemen appeared to express their views on the matter and they were in favor of the enactment of the ordinance. B) MINUTES OF a regular meeting of the Board of Trustees of the Village of Cayuga Heights hold at the Village Office on October 18, 1965 at 7:30 P.M. George After discussing the wording ofthe ordinance the following action was taken: RESOLUTION 779 - ADOPTION OF FIRE ORDINANCE VOTED resolved to adopt amendment to ordinance by transferring the phrase "in a container" to the end of the sentence, to wit: ARTICLE III - FUMIGATION "AND FIRES" First paragraph to be called "Section 1." Add as "Section 2." "No garbage, rubbish, trash, leaves, construction material or brush shall be burned out of doors in the Village of Cayuga Heights unless a permit is obtained from the Chief of the Fire Department of the Village or any person designated by him. No permit shall be issued, however, for (a) on any Sunday or Legal Holiday, or (b) on any day between the hours of 1 P.M. and 8 A.M. No permit shall be needed for any fire for cooking purposes in a container." BOND ANTICIPATION NOTE CERTIF DATED OCTOBER 14, 1964 CERTIFICATE OF THE VILLAGE TREASURER OF THE VILLAGE OF CAYUGA HEIGHTS, TOMPKINIS COUNTY, NEW YORK, AUTHORIZING THE ISSU- ANCE OF A $65,000 BOND ANTICIPATION NOTE OF SAID VILLAGE IN CONNECTION WITH THE AL- TERATIONS AND ADDITIONS TO THE SEWER SYSTEM OF SAID VILLAGE. I, the undersigned Village Treasurer of the Village of the Village of Cayuga Heights, Tompkins County, New York, DO HEREBY CERTIFY: 1. Pursuant to a bond resolution dated May 20, 1963, duly adopted by the Board of Trustees of said Village, on said date, authorizing the issuance of $218,000 serial bonds of said Village to pay the cost of the alterations and additions to'.the sewer system for said Village, which is not an assessable improvement, and delegating to me, as chief fiscal officer, the power to authorize the issuance of and to sell bond anticipation notes, including renewals thereof, in anticipation of the issuance andsale of said bonds, which power is in full force and effect and has not been modified, amended or revoked, I HEREBY AUTHORIZE the issuance of a renewal bond anticipation note of said Village, in the principal amount of $65,000 in anticipation of the sale of said bonds. Such note shall be executed in the name of said Village by its Mayor and its Village Treasurer, sealed with its corporate seal, attested by its Village Clerk, and =the same shall be in substantially the form , attached hereto. Such note is hereby sold at private sale to the First National Bank and Trust Company of Ithaca, New York, at a price of not less than par and accrued interest if any. Wheeler Village Treasurer ' RESOLUTION 782 - TRANSFER OF FUNDS VOTED to approve the following transfers in accounts as requested by Treasurer: General Fund From To Amount A -81 3o A-125-73-0. $ 25.00 A -81 -430 A- 290 -400 75.00 A -82 -430 A- 290 -400 145.00 10/18/65 A- 290 -65o A- 101 -400 * 500.00 At this point Attorney Sovocool presented the check from Cornell University in the amount of $43,000, which covers the payment of the $40,000 agreed to in the new Sewer Contract with the University, which has now been consummated, and $3,000 for the future construction of 400' of sewer main lying between the intersection of Old Country Club Road and Highland Road and the inter- section of Kline Road and Highland Road. According to the contract the Village will receive from Cornell an additional $40,000 payable over 30 years plus interest, payable in annual installments beginning with Jtily 15, 1965. RESOLUTION 783 - SEWER CONTRACT WITH CORNELL UNIVERSITY VOTED to authorize the Mayor to sign the contract with Cornell University and Tompkins County which concludes the negotiation regarding the financing of part of the sewer plant expansion. aF � iF RESOLUTION 784 - CONVEYANCE OF AIRPORT SEWER MAIN VOTED to authorize the Mayor to sign the agreement with Cornell. University and Otto B. Schoenfeld, for the Village to accept from them the easement and that part of the Airport Sewer Main which lies within the Village. VOTED to approve the Abstract of Audited Vouchers as presented by Treasurer in the following amounts: General Fund $13,920.84; Sewer Fund $3,406.42; Trust & Agency Account $2,035.24; Capital Fund $2,067.25. Mr. Wheeler presented some of the financial benefits to the Village in. becoming a small city such as increased per capita tax, no taxes payable to local governments, as well as other advantages. After a discussion it was decided that Mayor Marcham would write to the Conference of Mayors for information on becoming a city. RESOLUTION 785 - HANDLING OF $43,000 PAYMENT VOTED to authorize the Treasurer to deposit the amount of $40,000 in the Capital Fund (checking account) and $3,000 in the Water & Sewer Improvement Capital Reserve Fund (savings account). it iF it VOTED to approve the minutes of August 17, and September 20, copies of which had been previously furnished to the Trustees in mimeographed form. No action was taken on the Mayor's suggestion to have the Board of Trustees determine the responsibility for maintenance of the Village Hall and surround- ing property. 10/18/65 1 1 1.85 A discussion of the land taken by the State for Route 13 brought out the following: a) should Village employ legal representative who is specialist in such claims b) time -wise when would case be apt to come up before Court of Claims. Attorney stated the case may not come up for another year but the details of the case ought to be presented to the Villagers legal representative, who will try the case at least six months prior to trial, so that he will be able to acquaint himself with the details. It was suggested that right- of -wWl problem be submitted to Attorney General, but recommended waiting until settlement of Hilda Smith case is known. Attorney stated we will have to have some one do legal research for us. RESOLUTION 786 - LOSS OF SEWER RIGHT -OF -WAY VOTED to authorize the Mayor and Attorney to take whatever steps may be necessary to advance the interest of the Village in regard to securing a judgment or a legal decision regarding the Village right to compensation for loss of the sewer right -of -way. iF iF iE A discussion of the poor condition of pin oaks in the Village resulted in the suggestion that our Tree Warden, Mr. David Pimentel be consulted as to trees in the Village right -of -way and Professor A.M.S. Pridham for those located on private property. Mayor Marcham read the report of the Fire Chief for the period September 20 to October 18, 1965 which is on file in the VillageOffice. On the recommendation of the Fire Council the following action was taken on the 1966 charge for fire protection to the Town of Ithaca, RESOLUTION 787 - 1966 FIRE PROTECTION COST- TOWN OF ITHACA VOTED to approve 1966 charge to.the Fire Protection District of the Town of Ithaca in the amount of $3,529, which has been approved by the Cayuga Heights Fire Council and the Town of Ithaca Supervisor. at *� RESOLUTION 788 - FIRE DEPARTMENT PURCHASES VOTED to approve the following purchases requested by the Fire Council: 1) 1000 government printed, stamped envelopes - size 10, in the amount of $62.4o 2) 9- Special Chrome- plated Hose Adapters in the amount of $163.89. 10/18/65 �t iF i86 There was a discussion of Triphammer Road curves and the Mayor read a letter from Professor Mackesey in which Cornell University offerad to donate ' sufficient land to the Village for straightening the road where accidents have been occurring. He also reported on a meeting with Lowell George and Judge Dean regarding the hazard and the following suggestions were made: 1) might be signs to indicate that this was a curved road; 2) a street light installed; 3) that the road be restricted and straightened;. 4) .-penalties might be increased and 5) the Mayor had even suggested adding another patrolman to the present force, on the grounds that the most effective deterrent is a police car. Police Commissioner George presented his report for.the. month of September and it is on file in the Village Office. Trustee Lewis recommended that the Greater Ithaca Regional Planning Board be requested to study problem of routing traffic away from residential area. RESOLUTION 789 — PURCHASE SIGNS & STREET LIGHTS VOTED to purchase 4 winding road signs, 6 - 30 mile per hour speed -limit signs costing approximately $200 and to arrange for erection of street light on Triphammer Road on pole number 41 -15 in front of 330;Triphammer Road. 9E iF iF RESOLUTION 790 - STREET LIGHTS - WINTHROP DRIVE VOTED resolved that three 2500 lumen lights be erected by the New York State Electric and Gas Corporation on Winthrop Drive, 1 at intersection with Warwick Place, pole No. L- 275 -5, pole No. L -275 -6 and pole No. L- 275 -7. iE iF dt RESOLUTION 791 - TRAIMC CONTROL SIGNALS VOTED to seek assistance from the Community Assistance Program by requesting them to investigate the intersection at Hanshaw, North Triphammer, Triphaumer and East Upland Roads as well as intersection of Hanshaw Road with The Parkway as to desirability of installing traffic control signals. Attorney Sovocool presented case of outside sewer user who had neglected ' to secure proper sewer permit and to pay the annual sewer rental use charge to the Village for the period 111161 - 611166, as to whether he should }aye 10/18/65 to pay penalties on unpaid sewer rental charges plus penalty accrued annually. If user had secured proper permit, all unpaid sewer rental charges plus penalty would have been paid by Town of Ithaca, therefore the following action was taken: RESOLUTION 792 - BACK CHARGES - HANSHAW ROAD SEWER DISTRICT VOTED to collect back charges on sewer rental from January 10 1961 to June 1, 1966 plus penalties, as billed in the amount of $472.37 for the property located at 346 Warren Road, Ithaca, New York, Hanshaw Road Sewer District. Attorney reported on abandonment by State of Hanshaw, Cayuga Heights and Wyckoff Roads to the County as of October 8, 1965 (Official Order No. 1123) who will turn these roads over to' -the Village. We have been advised that the County Superintendent plans to fix Cayuga Heights Road bridge. Attorney suggested our Village Sewer Ordinance should be revised and presented sample copies of several ordinances used in the county, which are on file in the Village Office for reference. Attorney reporting further on trailers stated Ordinance cannot control parking of unoccupied trailers - - - -, Comptroller Opinion. Unoccupied trailers cannot be hooked up to utilities, must be locked, must have certain safety precautions. No action taken. Attorney presented right -of -way agreement with Cornell University for permission of Village to cross their property and hook up to sewer main at rear of 168 Pleasant Grove Road, for sewer connection for tool shed 'facilities. Easement to be recorded in County Clerk's Office and a copy returned to Cornell. Discussion of units that might be charged to Cornell University and the Tompkins County Airport brought out that water meter readings would indicate that Cornell should be charged for 41 units and the County for 10 units for the period January 1, 1965 to January 1, 1966 based on meter readings for January 1, 1964 - January 1, 1965. Engineer Rogers reported that control of dutch elm disease within the Village, is going along satisfactorily, but elm trees outside of Village on City boundary, Town of Ithaca boundary and Town of Lansing boundary show serious infection. Our Tree Warden suggested the Board call this to the attention of the new City Public Works Superintendent and the respective Supervisors in the Town. Engineer presented request of Ben Boynton regarding sewer extension on Wyckoff Road and a water connection with the Village water mains for serkice to same area. RESOLUTION 793 - WYCKOFF ROAD - SEWER & WATER SERVICE VOTED to authorize Engineer Rogers to answer Ben Boynton's letter in a favor- able light as he recommended to the Board. 10/18/65 187- i« RESOLUTION 794 - DUMP CONTRACT VOTED to authorize Engineer to provide for a contract for three years at $1600 a year payable twice a year for use of Collins' dump for acceptance of normal Village dumping and the digested sludge with Charles A. Collins, Sr. � at iF VOTED to hold a special meeting November 1,,1965.at,4:30 P.M. to consider bids on a 4 -wheel truck as authorized for purchase in the budget.
