RESOLUTION 579 - ADDITIONAL PAINTING VOTED TO authorize the painting of the rear hall and stairwell of Fire Station at the same time the Village Office is painted. dF 9F iF 3t There ensued a review and considerable discussion of the sidewalk problem on North Triphammer Road but no final action was taken by the Board. S r � Village Clerk MINUTES of a Regular Meeting of the Board of Trustees-of the Village of Cayuga Heights held at 7:30 P.M. on September 21, 1964 in the Village Office. PRESENT: Mayor Frederick G. Marcham Trustees John B. Bebbington, Jr. Robert T. Dean Katherine Ensworth Orval C. French David C. Weatherby Leroy K. Young Engineer John B. Rogers Attorney Roger B. Sovocool Police Commissioner Lowell T. George Fire Councilman Roger A. Morse and six residents VOTED to approve minutes of meetings of June 8 & 29, July 20, August 12 and September 8, 1964 as furnished Trustees in mimeographed form with the exception of Resolution No. 566 - Study Program Expenses in the July 20, 1964 minutes, which will be discussed later. VOTED to approve Abstract of Audited Vouchers dated September 21, 1964 in the following amounts: General Fund $7,672.02, Sewer Fund $367.14, Capital Fund $25,722.57 and Trust and Agency Account $200.00. c\��X�a Mayor Marcham briefed the Board on the action of the Zoning Board of Appeals on the request for a variance of Leonard Elkins to keep two sheep and one kid on his property at 805 East Upland Road. It was the consensus of opinion that the request should be denied, ..Mayor to so advise Mr. Elkins. Mayor stated on basis of his authorization by the Board he had accepted bid for 1962 Chevrolet Police car from Cayuga Heights Fire Company in amount of $860 being the highest bid. Mayor Marcham appointed David Weatherby and Gordon Wheeler to study and report back to the Board at next meeting precisely where we stand on the matter of financing the alterations and additions to the sewer plant; what we are to expect from the Federal Government, Cornell University and amount which we need to raise by bond issue. There was a discussion on Route 13 confiscation and Mayor reported no further word from State. Attorney Sovocool stated we had until February 1965 to file in Court of Claims but will do so before then. Mayor asked him to report on situation at next meeting. In mean- time Mayor to write to Mr. Riley again. Mayor Marcham briefed the Trustees on the 5% Plan of New York State Employees Retirement System and was requested to mail them more detailed information for their consideration. Engineer Rogers reported North Triphammer Road had been sealed which finishes the work to be done this year except for completing the four foot shoulders on each side of road. The cost of road running in the neighborhood of $20,000. The Mayor then called on residentis to present their views on building a sidewalk on the east side of North Triphammer Road. A discussion ensued. Some were in fairor of extended shoulder and some in favor .. of a sidewalk. Mr. Edward Abbott, attorney representing four property owners presented their disapproval of a sidewalk. Mr. Ian Macneil representing the P.T.A. of Cayuga Heights School expressed their opinion in favor of a sidewalk for safety of children and suggested a different apportionment of cost. Engineer Rogers reported on traffic counts, one before road construction and one afterwards. First count indicated 5,100 cars a day and a second count 3,600. RESOLUTION 580 - PROCEED TO TREASURER'S REPORT VOTED to proceed with Agenda and Treasurer's 3 month Report. Treasurer Wheeler presented his report for period June 1 - August 31, 1964. Temporary Investment General Fund 113,023.82 Sewer Fund -Plant 29,600.40 Sewer Fund -Lines 19,662.64 Water Improvements Fund Totals (all in one bank account) 162,286.86 After brief discussion report was accepted and placed on file. Bank Balance 8/31/64 282194.56 ' 22,437.67 -76,535.23 8,855.81 52,952.81 L7 RESOLUTION 581 - TRANSFER OF FUNDS VOTED to authorize Treasurer to make the following transfers: from to amount General Fund A- 290650 A -290 -630 1.00 A- 290 -650 A -43 -400 500.00 A -290 -650 A -290 -622 36.00 Sewer Fund G -290 -650 G- 290 -613 25.00 RESOLUTION 582 - FOM BOND NOTHIE VOTED resolved to renew the Bond Anticipation Note in amount of $65,000 payable to First National Bank and Trust Company for financing additions and alterations to Sewage Treatment Plant which canes due October 14, 1964 for period not to exceed one year. RESOLUTION 583 - AUDIT June 1, 1963 - May 31, 1964 VOTED to accept the Audit Report for period June 1, 1963 to June 1, 1964 by Paul Bradford C.P.A. with thanks and place it on file. dE iF iF at Police Commis6loner George presented his report for the month of August 1964 and it is on file in the Clerk's Office. Mr. George also reported on police activities during June.and July. In June there were 150 complaints, 18 traffic arrests and 14 traffic tickets issued. In July there were 232 complaints, 13 traffic arrests and 8 tickets issued. The report is on file in the Village Office. Roger Morse, Fire Councilman gave a report on activities since June 8, 1964, date of his last report copy of which is on file with the Village Clerk. He reported the Fire Department's desire and recommendation of the Council in regard to identifying the building with 8" plastic lettering above the garage doors, "CAYUGA HEIGHTS VOLUNTEER FIRE DEPARTMENT" at a cost of $143.00. Fire Council requested approval to purchase for $860 one 1962 Chevrolet police car to enable them to transport emergency equipment and of additional equipment and services in the amount of $781.90 to adapt the car to their needs. RESOLUTION 584 - PURCHASE OF POLICE CAR AND EQUIPMENT AND/OR SERVICES VOTED to authorize the purchase of 1962 Chevrolet Police car by.the Fire Department for $860 and auxiliary equipment under terms specified by the Fire Department,at an estimated $781.90. 9F iF iF it 9 5*' 9 RESOLUTION 585 - FUNDS FOR ABOVE PURCHASE VOTED to use money remaining in Fire Department Equipment Fund A -81 -200 after deluge gun bill is processed and to draw on the savings account of the Capital Reserve Fire Equipment Fund for the disbursements authorized in Resolution 584. RESOLUTION 586 - SIGN FOR FIRE HOUSE VOTED to authorize installation of lettering over the fire house doors and to use funds in'A -81 -400 - Other Expenses. iE iF iF 9F Attorney Sovocool had no report to make but stated he would check with Armand Adams on Liberman lawsuit and called attention to request of administrators of Newman's Estate that we settle our account in the near future. Mr. Macneil then presented a request for the P. T. A. regarding additional school crossing guards. They would like to see a guard at corner of East Upland and Triphammer Roads, :.intersection of Devon and Hanshaw Roads and at the corner where Kline, White Park, Highland Roads and The Parkway meet. , Mayor explained our problem was to secure people willing to serve as guards, but that he would pass the request on to our Police Commissioner for investigation and recommendation. There ensued a discussion on the sidewalk costs and since there is no budget set up for sidewalks this will need to be decided later. RESOLUTION 587 - SIDEWALKS VOTED that the Engineer is to proceed at once with the construction of the sidewalk from the Scott property to Winthrop Drive with Village forces until weather closes in, and the problem of cost and allotment of funds to be taken up after work is begun, at October meeting. RESOLUTION 588 - OVERTIME VOTED To approve overtime of 40 hours for Andrew Geiger in lieu of vacation time. The Clerk was instructed to reply to letter from Mr. Banner, Assistant Superintendent of the Ithaca School District regarding the request for a refund of tax penalty since by law this must be collected. 97.1 MINUTES of a Special Meeting of the Board of Trustees of the Village of Cayuga Heights held on October 5, 1964 at 12:15 P.M- in the Village Office. Proposed amendment prepared by Attorney Sovocool. PROPOSED AMENDMENT TO ARTICLE VI SECTION 70 ORDINANCES OF THE VILLAGE OF CAYUGA HEIGHTS, N.Y. BE IT ORDAINED, that pursuant to Section 1643 of the Vehicle and Traffic Law of the State of New York as amended by the laws of 1964 Chapter 844 Section 3, Article VI Section 70 of the Ordinances of the Village of Cayuga Heights be amended to read as follows: SECTION 70 - Maximum speed limits a. Thirty (30) miles per hour is hereby established.as the maximum speed at which vehicles may proceed within the corporate limits of this Village. 10/5/64 to�� 6� PRESENT: Mayor Frederick G. Rogers Reporter Mrs. Nordheimer Engineer Rogers reported briefly on shoulder and sidewalk grading on North Triphammer Road. ' Mayor Marcham informed the Board of the action the State had taken in amending State Vehicle and Traffic Law, Section 1643 raising the speed limit on all roads to 30 miles per hour in cities and villages effective October 1, 1964. This amendment thus necessitates the amending of Village Ordinance Article VI Section 70, to increase the speed limit from 25 miles per hour to 30 miles per hour on all village roads. BE IT ORDAINED, that pursuant to Section 1643 of the Vehicle and Traffic Law of the State of New York as amended by the laws of 1964 Chapter 844 Section 3, Article VI Section 70 of the Ordinances of the Village of Cayuga Heights be amended to read as follows: SECTION 70 - Maximum speed limits a. Thirty (30) miles per hour is hereby established.as the maximum speed at which vehicles may proceed within the corporate limits of this Village. 10/5/64 to�� 6� r• roMbi RESOLUTION 590 ; PUBLIC HEARING ON SPEED LIMIT VOTED to instruct the Clerk to publish notice of Public Hearing on October 19, 1964 at 7 :00 P.M. to consider amending the speed regulations in the Village by increasing the limit to 30 miles per hour to comply with the State Vehicle and Traffic Law. *��at Attorney Sovocool informed the Board that it would be necessary to enact an ordinance before we could authorize the Police Commissioner to establish,'a speed limit for trial purposes. This would not help the present situation since the timing would be the same as to pass an ordinance amending the speed limit. He suggested the Board could propose such an ordinance for possible future use. It waW the consensus of opinion that consideration be given the matter at our next meeting. Adjourned 12:45 P.M. A PUBLIC HEARING on change in Village Traffic Ordinance was held on October 19, 1964 at 7 P.M. in the Village Office, preceding the regular Board of Trustees Meeting. r, The Mayor read the Legal Notice covering.the amendment to Village Traffic Ordinance changing the speed limit from 25 to )tZ miles an hour on Village streets. 30 No residents appeared other than Village Officials.
