F. G, Marcham, Mayor Village of Cayuga Heights MINUTES of a Public Hearing on Proposed Sewer Rent Ordinance held at 7:00 PM December 16; 1963 at the Village Hall. PRESENT: Mayor Trustees Engineer Attorney and four residents Frederick G. Marcham John B. Bebbington, Jr. Robert T. Dean Orval C. French Thomas E. Norton David C. Weatherby Gordon B. Wheeler, John B. Rogers Roger B. Sovocool of the Village. In behalf of the Corners Community Center, Inc., Attorney J. Clynes filed a statement suggesting change in the proposed ordinance. The Mayor read the proposed ordinance. Residents in attendance raised questions regarding interpretation of the ordinance and when these were.answered to their satisfaction they left. The Mayor read and the Trustees discussed the proposal contained in the Clynes statement. The public meeting closed at 7:30 P.M. Upchurch SUBJECT: Treasurer's Six Months Report Because of a conflicting meeting at G.L.F. which I must attend, I will not be present at your Board meeting t•:onday night, December 16, 1963. Therefor, I am enclosing a copy of my six months' report. A look at the report: - On page two, the detail of receipts for the General Fund - receipts, exclusive of surplus, are $154,165.74 against Budget of $165,956.00. Taxes due ($1106.54) Fire Protection ($29600.00) State Aid per Capita ($49118.00) and Payment from Sewer Fund ($4,000.00) plus other smaller items of income will bring actual receipts to a figure in excess of budget before year ends. Also, since actual surplus at 6/1/53 was $25,979.28 in excess of budget, receipts for this fund are in good shape. On pages 3 and 4, the detail of expenditures for the General Fund shows actual for the aix months to be $91,816.85 against budget of $170,956.00 leaving $79,139.15 remaining for the last six months. However, Debt Reds ion, Road Improvements ($159000.00) plus contract services -Roads ($18,828.19) plus Planning ($1000.00) are all expended with no more to be spent in the last six • months. Therefor, with $5,815.00 left in the Contingent account, expenditures appear to be within limits. However, Streets & Sanitation, Personal Services and Refuse Collection, Personal Services are both running at a rate in excess of budget. On page 59 Sewer Fund (Plant) actual receipts are almost equal to budget. However, actual surplus 6/1/63 was $111.50 less than budget,' Expenditures of $230267.02 against budget of $580045.00 leaves $34,777.98 in the budget for the last six months. But, Debt Redemption ($8,000.00) and Payment to General Fund ($4,000.00) must be made in the last six months. This will be a tight budget to live within during the next six months. I trust that Harold Cornelius will be alerted to this. On page 69 Special Assessment Fund -Sewer Idnes receipts are almost equal to budget. Expenditures ($6,441.30) compared to budget ($30,040.00) leaves ($23,598.70 for the last six months. Debt redemption ($149000.00) and 6 months interest 11,6,386.25) must be paid. This fund should balance out okay. On page 6, Special Assessment Fund-Water Improvements actual receipts are excess of budget. Expenditures should-be close to budget. This fund will balance out okay. On page 7, you will find detail of Capital Fund and Trust and Agency Account. If there are any questions, please make note of same in the minutes and I will answer same by mail. Note - also enclosed is memo indicating need for transfers to replenish depleted budget accounts. Will you please ask the Board to approve. LI Thank you. 33 The Trustees discussed the proposed ordinance and agreed to the following changes in the language set forth in the proposed ordinance: In 3 b. line 2, after "sorority house ", insert "or dormitory" and change the wording "living unit" to "dwelling unit". In 3 d- line 10 after "sorority house ", insert "or dormitory" and line 20 after "sorority house "l insert "or dormitory" and put period. Expunge the rest of the sentence. In 3 e. add to line 7 as follows, after water put a comma and add the following: "except that portion thereof not discharged into the sewer system under special permit ". Write a new Section 4 as follows: 114. Sewer rents shall not be charged against properties granted special permits under Article X of the Village Ordinances or against properties connected to any other municipal system." Change the numbers of Sections 4 & 5 of the proposed ordinances to numbers 5 & 6. RESOLUTION 406 - SEWER RENT ORDINANCE VOTED resolved to adopt Sewer Rent Ordinance as follows: ARTICLE XIV SEWER RENTS AN ORDINANCE Establishing and Imposing Sewer Rents Pursuant to Article 14-F of the General Municipal law ' WHEREAS the Village of Cayuga Heights has constructed and installed for public use a sewage treatment plant pursuant to a resolution of the Board of Trustees adopted on December 289 1955, authorizing such construction and the issuance of $269,000 serial bonds to pay the cost thereof, which resolution provided that sewer rents should be established and imposed for the use of the sewage treatment plant; NOW THEREFOREp be it ordained by the Mayor and the Board of Trustees of the Village of Cayuga Heights as follows: Section 1. The sewer system or the part or parts of the sewer system for which such rents shall be established and imposed are as follows: (a) The sewage treatment and &posal works with necessary appurtenances including pumping stations, and the extension, enlarge- ment or replacement of or additions to such sewage treatment plant. (b) The operation, maintenance and repairs of the entire village sewer system, including the sewage treatment plant and the collection system. Section 2. Revenues derived from the sewer rents, including penalties and interest, shall be credited to a special fund to be known as the "Sewer Rent Fund." Moneys in such fund shall be used in the following,order:- (a) For the payment of the costs of operation, maintenance and repairs of the entire village sewer system. (b) For the payment of the interest on and amortization of or payment of indebtedness which has been or shall.be incurred for the construction of the sewage disposal plant. (Plot including indebtedness, and the interest thereon, which is to be paid in the first instance from assessments upon benefited real property.) (c) For the construction of sewage treatment and disposal works with necessary appurtenances, including pumping statinns or for the extension, enlargement, or replacement of, or additions-top such sewage treatment and disposal works. Section 3. The basis of the charge for such sewer rent shall be computed in units as follows with each unit bearing a proportionate part of the moneys necessary for the annual expense under Section 2 herein: (a) The owner of any private single family residence shall be assessed one unit. (b) Any two family residence, apartment house, or multiple residence other than a fraternity or sorority or dormitory, shall be assessed one unit for each apartment or dwelling unit. (c) An additional one -half unit shall be charged,to any family having two roomers with additional one -half units for each additional two roomers. (d) Fach fraternity or sorority house or dormitory shall be assessed one unit for each five occupants in the said fraternity or ' sorority or dormitory. (e) The owner of any commercial, business or industrial property, including but not limited to schools, churches, professional offices, gas stations, stores, and all other places of business shall be assessed one unit for each enclosed building housing such commercials business or industrial property with an additional assessment of one unit for each 16,000 cubic feet of water, or part thereof, consumed annually in each such building over the firsj169000 cubic feet of water, except that portion thereof not discharged into the sewer system under special permit. I . Section 4. Sewer rents shall not be charged against properties granted special permits under Article X of the Village Ordinances. or against properties connected to any other municipal system. Section 5. Sewer rents shall become due annually on the first day of June and may be paid without interest or penalty on or before the first day of July. Section 6. The collection of unpaid sewer rents may'be enforced pursuant to the pro- I visions of Article 14-F of the General Municipal law as heretofore enacted or hereafter amended. \' " \ \\11 35: Trustee Norton introduced Mr. Golder who explained the work of the building inspection system operated by the City of Ithaca and suggested that the Village might benefit by using the City's services. He pointed out that the Village has not adopted a building code and did not maintain an inspection system for electrical installations, except those performed by the Fire Insurance Underwriters. He spoke also of enforcement of the Mitchell Act in the Village. Members of the Board reminded him of the services performed by the Village Fire Inspector and other aspects of Village policy relating to the inspection of buildings. After discussion the Board agreed to discuss at next meeting problems relating to enforcement of Mitchell Act and the duties of the Fire Inspector. VOTED approval of minutes of Special Meeting of October 11, 1963 and regular meeting of November 189 1963• VOTED approval of Abstract of Audited Vouchers dated December 16, 1963, in the following amounts: General Fund $3,028.53; Sewer Fund $483.01; Capital Fund $559127.00 RESOLUTION 407 - SEWER AND WATER IMPROVEMENT RATES VOTED resolved to establish Sewer Rates, 1964-659-as follows: 80% Average Width Charge and 20% Land Assessment Charge; and to establish Water Improve- ment Rates, 1964 -65, as follows: 70% Average Width Charge and 30% Total Assessment Charge. ® RESOLUTION 408 - SAVAGE FARM CASE VOTED resolved to instruct the Mayor to negotiate further with Mr. Neal Stamp regarding the long outstanding settlement with Cornell University in the Savage Farm Case. RESOLUTION 409 - CORNELL UNIVERSITY CONTRIBUTION TO SEWER PLANT ADDITION VOTED resolved to instruct the Mayor to inform Mr. John Burton, Cornell University, that the Village is ready to open discussions again regarding the University's agreement to contribute to the enlargement of the Sewage Disposal Plant. RESOLUTION 410 - GENTLE SEWER PAYMENTS VOTED to refer to the Attorney the matter of Avery Gentle's payment for sewer line installation, with recommendation that he seek advice from Mr. Alpert of the New York State Department of Local Government. 36 RESOLUTION 411 - INSURANCE CLAIM - PLANT DAMAGE - OUTFALL PIPE BREAK VOTED to request the Attorney to inquire what is the state of the Village claim regarding blast damage to the Sewage Disposal Plant caused by the ,Contractor building Route 13, and the Liberman Damage Claim. RESOLUTION 412 - APPOINTMENT OF WALTER Co OICONt" ACTING POLICE JUSTICE:; VOTED resolved to appoint Mr. Walter C. O'Connell as Acting Police Justice, effective December 169 19639 at a salary of $12.50 per week of service payable monthly. RESOLUTION 413 - APPOINTMENT OF DR. 0. J. VAN DYK AS A MEMBER OF THE ZONING BOARD OF APPEALS VOTED resolved to appoint Dr.,0.,J. VanDyk as a member of the Zoning Board of Appeals to fill out the unexpired term of Professor Nilson, who has resigned. RESOLUTION 414 - PARKING VIOLATION FEES VOTED resolved to refer for conference between Police Justice Dean and the Village Attorney the question by what authority and at what rate the Village should assess fees for parking violations. RESOLUTION 415 - WATER CONTRACT - CITY OF ITHACA VOTED resolved to empower the Attorney, Engineer and Mayor to negotiate with City of Ithaca officials and such persons as may represent other interested communities on the new contract for water service drawn up by the City of Ithaca. RESOLUTION 416 - FIFTH PAYMENT ON SEWER PLANT VOTED resolved to authorize partial payment to Bongiovanni, Inc. of $541,130.50 for work on Sewage Disposal Plant, subject to submission by contractor of appropriate payroll audit, as required by Federal Government. The Engineer reported that work in progress at the Sewage Disposal Plant had been inspected and found satisfactory by the Federal Inspectors. 1 37 RESOLUTION 417 - EXTRA WORK ON SEWAGE PLANT VOTED resolved to authorize as an extra payment in the cost of constructing the Sewage Disposal Plant, the sum of $1,100 for painting, as recommended by the Cbnsulting Engineer, payment to be made subject to endorsement'. by Village Engineer after further inspection. VOTED to accept the Treasurer's Six Month Report. VOTED resolved to authorize the Engineer to negotiate with Fingerlakes Construction Company to plow3i Village sidewalks during the present winter on the same basis as last year. The Engineer reported on questions arising from negotiations over an easement to be granted by Sheldon Smith for a sewer line from Village Tool Shed. RESOLUTION 420 - GRIEVANCE DAY NOTICES VOTED resolved to approve Grievance Day.Notice for 1964. RESOLUTION 421 - OVERTIME VOTED resolved to approve the following overtime: Haskins,. 10 hours * $25.00; Hayes, 2 hours = $4.52; Oltz, 8 hours = $17.36• V RESOLUTION 422 - ASSESSMENT MEETING DATES VOTED resolved to set January 69 80 and 10 as dates for Special Meetings of the Village Board to sit as assessors to fix property valuations and sewer units for the 1964 Village Tax Roll. RESOLUTION 423 - ASSESSMENT PROCEDURE VOTED resolved to review those properties partially assessed last year, those that have been sold in the year 1963, those for which building permits have been issued from January 19 1963 to December 31, 1963 and such others as the committee appointed under Resolution 397 shall recommend.
