HomeMy WebLinkAboutReg Mtg. Minutes 11/19/19621L1 MINUTES of a Regular Meeting of the Board of Trustees held at the Village Office on November 19, 1962 at 7:30 P.M. PRESENT: Mayor Marcham ® Trustees French McElwee Norton Weaterby Wheeler Engineer Rogers Treasurer Upchurch Police Commissioner George Attorney Newman Guests were Dr. Orrin J. VanDyk of 616 Cayuga Heights Road; Town of Ithaca Super- visor Ben Boynton and Mr. Charles Fulkerson.' Dr. VanDyk was introduced to the Board by Mayor Marcham. He expressed his concern regarding future use of Donald Belcher's property located in Village west of Route 13. A considerable amount of fill has been and is being piled onto this property and is now some 50 to 75'feet deep. Dr. VanDyk reported persons taking pictures of houses in the neighborhood who on being questioned stated they were assessors. These persons also questioned property owners as to purchase price of their houses. To clarify the situa- tion Dr.,VanDyk called Mr. Belcher and questioned him as to his plans but did not receive an answer. He fears a commercial development of some sort. Desires Village, to take ac- tion to halt continued dumping of fill by Route 13 contractor. He left. Supervisor Boynton and Mr. Fulkerson informally presented a problem in regard to Mr. Fulkerson's sewer connection expenses and especially the cost of encasing the sewer pipe along East Remington Road in concrete and requested that the Village accept the cost of ® encasing this pipe since they felt it was a benefit to the Village rather than Mr. Fulkerson and the Blood Estate. The amount involved is $250. They left at 8:05 P.M. After discussing the matter presented by Dr. VanDyk regarding the fill being placed on Donald Belcher land, it was 136. VOTED to instruct the Mayor to write a letter with Attorney Newman's approval to Mr. Belcher pointing out to him the intention of the Board, as it now exists, not to change the zoning in the area and also pointing out to him Section 5 of Article IX of the Village Ordinance in regard to height of buildings which should raise some doubts in his mind as to possible use of the area if he contemplates building on it. The Fulkerson sewer line was discussed and it was found on consulting the contract with Renwick Heights Sewer District that this sewer line was to be installed at no cost to the Village of Cayuga Heights. 137. VOTED not to consider the payment of the $250.requested. 138. VOTED approval of minutes of meeting held October 15, 1962 as previously furnished Trustees in mimeographed form. 139. VOTED approval of Abstract of Audited Vouchers dated November.19, 1962 in the following amounts: General Fund $2,589.44; Sewer Fund $258.49; Capital Fund $200.77. 140. VOTED to pay Acting Police Justice Dean the sum of $50 as compensation for services rendered to Village during October when Police Justice Kerr was on vacation. Mayor Marcham reported Miss Hilda Smith's lawyer had informed him she is willing to consider an offer from the Village for her land located west of North Sunset Drive. 141. VOTED to instruct the Mayor to follow up correspondence with Miss Smites V 11.2 lawyer, Mr. Mahoney, in an endeavor to acquire possession of Miss Smith's land. 142. VOTED to authorize the amending of Sewage Treatment Plant Additions Con- tract dated March 9, 1962 between Village of Cayuga Heights and Crandall and Miller; Engineers by substituting the name of "Thomas G. Miller, Engineer' for "Crandall and Miller, Engineers." Attorney Newman presented proposed amendment to Section 2 of the Zoning Ordinance defining the word family. 143. VOTED to call a Public Hearing of all interested persons for or against this proposed amendment on December 17, 1962 at 7:30 P.M. Attorney Newman presented proposed contract between Villa a of Cayuga Heights and Charles Collins, Sr. for use of his dump at an annual rate of 1,200 to become effective January 1, 1963. Some additions and changes were recommended and Attorney Newman will rewrite the contract accordingly. 144. VOTED to offer contract to Mr. Collins for use of his dump after it had been . redrawn by Attorney Newman. 145. VOTED to instruct Mayor Marcham and Attorney Newman to-request Mr. Liberman (1) to remove the present fill which covers our outfall pipe, (2) to inform him we do not wish him to dump or carry over the existing rocks any further material and (3) that the Village will hold him liable for any damage, or any future damage that we do not know about, to our pipe line, sending copies of letter to County Health Department and State Officials concerned. Mayor Marcham informed the Board he has received material and report from Mr Scott on insurance problems and will distribute them to Insurance Committee. The Mayor read the report of Fire Councilman Quinlan for thb period June 1, 1962 to November 15, 1962 and it was 146. VOTED to accept this report with the Board's compliments and place it on file. Police Commissioner George read his report and it is on file in the Clerk's office. 147. VOTED approval of the following transfers requested by Treasurer: GENERAL FUND TO A14OUNT FROM AMOUNT A- 101 -410 150.00 A- 296- -650 330.00 A- 101 -44o 150.00 A- 125 -400 25.00 A- 101 -200 5.00 SEWER FUND TO FROM AMOUNT G- 123 -400 G- 290 - '650 550.00 Engineer Rogers reported on snow preparation -- stockpiling of salt -- contract price for plowing sidewalks $6.50 per hour by Finger Lakes Construction Co. 148. VOTED to authorize Engineer Rogers to do business with Finger Lakes Construc- tion Company on terms stated in their proposal. Engineer reported that pole barn is framed -in, doors have not yet been received. Due to error in the interpretation of plans roof is lower in rear but GLF is willing to reduce the price from $ 52200 to $5,000 if satisfactory to Board. The Board felt 1 1 1 113 this to be a,fair reduction. Plans and specifications have been mailed to 11 bidders on Sewer Plant Additions. 149. VOTED to accept John MacNeill's proposal for running the east line of the Village at a cost of $900 plus cost of erecting such monuments as he and Village Engineer may deem necessary since these monuments would be.useful in the future. 150. VOTED to table the request by Route 13 officials regarding easement for water line at 706 Cayuga Heights Road. 151. VOTED to approve 20% additional charge for overhead in work done by Village forces. The 2 to apply to wages only. 152. VOTED to pay Mr. Bodman's claim for charges involved in sewer main backing on September 23, 1962 and to notify insurance company after confirming the facts as stated. 153, VOTED to approve overtime in amounts specified as follows: Ralph Garvin $8.40; Walter Hayes $17.60; Steve Oltz, $16.40; Bert Truax $14.40.. 154. VOTED to approve use of Certification of Claims form to replace old notar- ized verification form. (V. L. Sec. 128) Meeting adjourned at 10:40 P.M. Vera W. Snyder Village Clerk A. A Public Hearing was held on December 17, 1962 at 7:30 P.M. in the Village Office at 194 Pleasant Grove Road to hear all persons for or against an Amendment to Section 2 of the Zoning Ordinance pertaining to occupancy of houses. PRESENT: Mayor Trustees L Attorney Engineer Interested Residents Marcham Dean French McElwee Norton Newman Rogers Mr. & Mrs. Robert VonBerg Mayor Mareham explained the requirements for amending an ordinance and stated such requirements had been met and then read the proposed amendment: Section 2. Residence District. In the Residence District, no building shall be erected or extended and no land or building shall be used for other than any of the following purposes: 1 -a. Residence for not more than two families with not more than two other occupants, or b. Residence for not more than one family with not more than three other occupants:: or c. Residence in which there is no family and not more than four occupants. NOTE: The word "family" as used in this section shall include a husband or widower, a wife or widow, his or her childreng and his or her other blood relatives. The word "occupant° as used in this section shall., mean and apply to(nny person living in a house for more than one month who is not a member of a family residing therein.
