VOTED to accept John MacNeill's proposal for running the east line of the Village at a cost of $900 plus cost of erecting such monuments as he and Village Engineer may deem necessary since these monuments would be.useful in the future. 150. VOTED to table the request by Route 13 officials regarding easement for water line at 706 Cayuga Heights Road. 151. VOTED to approve 20% additional charge for overhead in work done by Village forces. The 2 to apply to wages only. 152. VOTED to pay Mr. Bodman's claim for charges involved in sewer main backing on September 23, 1962 and to notify insurance company after confirming the facts as stated. 153, VOTED to approve overtime in amounts specified as follows: Ralph Garvin $8.40; Walter Hayes $17.60; Steve Oltz, $16.40; Bert Truax $14.40.. 154. VOTED to approve use of Certification of Claims form to replace old notar- ized verification form. (V. L. Sec. 128) Meeting adjourned at 10:40 P.M. Vera W. Snyder Village Clerk A. A Public Hearing was held on December 17, 1962 at 7:30 P.M. in the Village Office at 194 Pleasant Grove Road to hear all persons for or against an Amendment to Section 2 of the Zoning Ordinance pertaining to occupancy of houses. PRESENT: Mayor Trustees L Attorney Engineer Interested Residents Marcham Dean French McElwee Norton Newman Rogers Mr. & Mrs. Robert VonBerg Mayor Mareham explained the requirements for amending an ordinance and stated such requirements had been met and then read the proposed amendment: Section 2. Residence District. In the Residence District, no building shall be erected or extended and no land or building shall be used for other than any of the following purposes: 1 -a. Residence for not more than two families with not more than two other occupants, or b. Residence for not more than one family with not more than three other occupants:: or c. Residence in which there is no family and not more than four occupants. NOTE: The word "family" as used in this section shall include a husband or widower, a wife or widow, his or her childreng and his or her other blood relatives. The word "occupant° as used in this section shall., mean and apply to(nny person living in a house for more than one month who is not a member of a family residing therein. 1XV-1 Mr. VonBerg requested zoning ordinances be enforced as already written. Mayor Marcham explained difficulties encountered in endeavoring to do so since present ordinance is not strong enough for legal action. Hence the reason for amendment. The Public Hearing was then closed. B. MINUTES of a Regular Meeting of the Board of 'Trustees held at the Village Of fice on December 179 1962 at 8:00 P.M. PRESENT: Mayor March �m Trustees Dean French McElwee Norton Engineer Rogers Police Commissioner George Attorney Newman Guests were Thomas G. Miller, Jr.; Residents: General Ralph Hospital, D. P. Detrick, Mr. & Mrs. Robert Kane. General Hospital read and presented a petition opposing the proposed erection of an apartment house on 113 Cayuga Heights Road, requesting - rezoning from multiple housing to residential zone of area bounded by the line of Wyckoff Road - Overlook Road- Ridgewood Road -Kline Road and the south Village line. Petition was signed by 51 resident taxpayw ers. The question of parking was raised and also the number of occupants of the apart- ment house. The residents left and Mayor Marcham reported on bids submitted on December 3, 1962 on Sewer Plant Alterations and Additions. The following bids were received and , publicly read: M. A. Bongiovanni, Syracuse, N. Y., $232,900; Congel- Hazard, East Syracuse, N. Y., $222,200;.Burly Construction, New York City, $418,949. Mayor Marcham stated that he had met with Village Engineer Rogers, Consulting Engineer Miller and Ray McElwee to review the bids and wished to recommend the Board reject all bids. 155. VOTED to reject the 3 bids received Dedember 39 1962 on Sewer Plant Altera- tions and Additions. Mr. Miller discussed the bid situation with the Board, giving his opinion as to why so few were received and suggesting some reworking of the specifications before re- advertising for bids in January, suggesting February 4 for bid opening date and letting of contract in late February or early March. The financing of the project was also discussed and it was 156. VOTED to authorize Engineer Miller to make such alterations in specifica- tions as suggested with view to seeking new set of bids at an early date. 157. VOTED to authorize the Treasurer, Engineer and Attorney with assistance of the Mayor to investigate further possibilities of financing the project. 158. VOTED approval of minutes of November 19, 1962 previously furnished Trus- tees in mimeographed form. 159. VOTED approval of Abstract of Audited Vouchers; General Fund $29723.53; Sewer 1Fund 19012.85; Capital Fund $1033.80. 161. VOTED to authorize Mayor Marcham to seek additional information from Sup- ervisor Boyn on regarding participation of Village in Recreation for Youth Program co-, operating with Town of Ithaca. 160. VOTED to authorize the Mayor to sign Amendment to Articles of Agreement of the Greater Regional Planning Board admitting the Town of Danby to the Board. 162. VOTED to instruct the Mayor to inform Mr. Laverty and Town of Lansing Supervisor Dates of some of the problems that emerge in the minds of the Village Board regarding the problem of water pressure and water supply in the Village and in areas the Village feels it is committed to for the supply of water suggesting some of the-costs that might be involved. Th$.N,ayor reported on activity of Committee on Municipal Cooperation. Among other things they discussed the question of fencing of Route 13. The Committee was in favor of maximum fencing. Mayor Marcham stated Regional Planning Board met and presented their report on various items, one of which was on annexation and they recommended annexation should not be forced at this time. The Mayor and•Engineer attended a meeting with representatives of the State Board of Equalization and Assessment on December 139 1962w State appraisals on ten Village properties were discussed, which were appraised higher than Village figures. According to state representative, land in the Village is worth $90 per front foot. Tony Macera is state representative. Mr. Newman discussed the contract entered into between Cornell University and the Village regarding university contribution to cost of enlargement of sewer plant dated 8/24/59. It was decided to let the contract remain as is. After the Board had discussed the rezoning question presented by petitioners earlier in the meeting, Mr. Newman gave the Board his legal opinion on the 15' easement on Cayuga Heights Road, stating the easement had been given to J. T. Newman and Charles H. Blood, both deceased and therefore could see no possibility of easement ever being used. Mr. Rogers asked to have this opinion in writing. Police Commissioner George gave his report on Police Department activities for the month of November and it is on file in the Clerk's Office. He-also reported on contacts he made regarding servicing of our police radios. For various reasons no other concern is available to render as good service as our present contractor, Communications Engineering Service, so he recommended renewal of contract for 1963. 163. VOTED to renew contract with Communications Engineering Service Company of Elmira Heights, N. Y. for 1963- 164. VOTED to authorize the Mayor to talk to General Hospital and Mr. Kane and inform them that for the time being we do not find any firm legal ground to reject an application for building permit but that the matter is being studied and kept quiet in the hope that interested parties can get together and find a satisfactory solution in regard to erection of apartment house in their neighborhood. 165. VOTED to authorize change in title of Andrew J. Geiger from "Laborer" to . "Motor Equipment Operator" effective January 1, 1962, which automatically necessitates his joining the New York State Retirement System. 166. VOTED to authorize the Mayor to sign release of easement for water line at 706 Cayuga Heights Road. 167. VOTED to refer to Police Commissioner George the request,for light by Westview Apartments on Triphammer Road. 116 168. VOTED to table request for road to Westview Apartments. Engineer reported on small fire in packer body which caused but slight damage, and of the accident on return trip from Syracuse in which a car drove into the rear end of the packer, bending bumper - keeping check on rear -end mechanism for any damage. 169. VOTED to accept Treasurer's Report port for period June 1 to December 19 1962. 170. VOTED to approve the following transfers: GENERAL FUND TO FROM AMOUNT A- 125 -400 A- 290 -650 50.00 A -127 -40o " 200.00 SEWER FUND G- 123 -400 G- 290 =65o 600.00 G- 123 -410 " 300.00 Inasmuch as there was no opposition to proposed amendment to Section 2 of Zoning Ordinance it was 171. VOTED to adopt the proposed amendmeegnt as read at Public Hearing. 172. VOTED to approve De6ember-24 and ai-f 31 as.holidays. 173. VOTED to approve Grievance Day Notice as presented. 174. VOTED to approve November overtime as follows: Cornelius $22.50; Garvin $16.80; Oltz .20; Geiger $16.40; Haskins $20.00; Hayes $17.60; Extra help -Truax $7.20.
