Trustee Norton reported the urgent request by resident Dr. William Geer that a
street light be placed near his property on Comstock Road. Damage has been done
to his property.
VOTED to request the Police Commissioner to investigate and report at the next
meeting.

MINUTES of the Regular Meeting of the Village Board of Trustees held Tuesday,
November 21, 1961 at 7:30 P.M. in the Village Office, 194 Pleasant Grove Road.
PRESENT: Mayor F. G. Marcham;.Trustees Dean, French, Norton and Wheeler; Engineer
Rogers; Trbasurer Upchurch; Police Commissioner George; Fire Councilman Quinlan and
Attorney Newman.
1) VOTED approval of minutes of meetings of October 17 and November 3, 1961=
previously submitted to Trustees in mimeographed form after correction to October
/�17. 1961 minutes,.Item 9, third paragraph as follows:
//-""VOTED: To inform Mr. Liguori and Supervisor Boynton that the Board of Trustees
consent that the sewage disposal from the property of Charles Fulkerson on the east
side of Remington Road be made by the City of Ithaca.through the Renwick Heights
Sewer District, and that on account of practical difficulties said Fulkerson .
property be excepted from the requirement that all properties in the Village be
connected with the Village sewer system."
"ALSO VOTED: That if such a connection is made with the Renwick Heights Sewer
System, the Village will take appropriate action to enforce payments in event that
the property owner defaults in the payments required o$ him for the construction of
the improvement or for his annual sewage disposal charges; and the Mayor is
authorized to execute a contract with the Town of Ithaca and /or City of Ithaca
which will guarantee the making of all payments*
2) a. VOTED approval of Abstract of Audited Vouchers as presented by Clerk in the
following amounts: -General Find $9,801.929 Sewer Fund $4,409.94.
-b. VOTED approval of transfer of funds to pay for siren from General Fined
A- 290 -650 to account A -81 -200 amount of $75.00.
3) a. Report of Mayor - Committee on ordinances, Dr. Baker and Mr.'McElwee absent.
However, it was decided to study proposed amendments to Village of Cayuga Heights
Zoning Ordinances as drawn up by Attorney Newman after he reviewed recommendations
of the ordinance Committee;
Proposed Amendments to Village of Cayuga Heights Zoning Ordinance
Section 2 is hereby amended by adding paragraph 8 to read as follows:

Section 4 is hereby amended by adding to the list of businesses in paragraph 7
the following:
"Commercially operated swimming pools."
SECTION 5. Heights of buildings. No'building or structure shall be
erected in a residence district so as to exceed twenty -five (25) feet in height, or
in any other district so as to exceed thirty (30) feet in height.
The limitations of height shall not apply to chimneys, ventilators, skylights,
or other necessary features usually carried above roofs, nor to spires of churches
or other buildings if such features are in no way used for living purposes.
The height of a building shall be measured from the lowest point of the base of
the building at the elevation of the proposed grade line of the ground to the average
height between eaves and ridge for pitched roofs and to the highest part of the
parapet for flat roofs. In cases where the proposed grade line of the ground is
higher than the existing ground, the change must be approved by the Zoning Officer
at the time of issuance of the zoning permit.
Section 6 is hereby amended to read as-follows:
"Section 6. Yard Requirements. Yards free from buildings and of the follow
ing minimum dimensions are required, said dimensions to be measured at right angles
to property lines:
Residence District
Front Yard 25 feet
Side and Rear Yards 15 feet
Multiple Housing District
Front Yard - twice the maximum height of the building on the front street
side, but in no case less than 30 feet.
Side and Rear Yards - the maximum. height of the building on the
side facing the respective side and rear yards.
Commercial District
Front Yard 35 feet
Side & Rear Yards 30 feet
The yard requirements hereinabove specified shall be the same in the case
of swimming pools.
Section 7 is hereby amended by adding the following sentence to the last para-
graph thereof:
"The areas covered by overha4ng building eaves of ' or less or by non - roofed
swimming pools shall be omitted in computation of the ui ing coverage.
Section 9 is hereby amended to read as follows:
"Section 9. Fences and Walls. The provisions of this ordinance unless other-
wise specified shall not apply to fences or walls not over four (4) feet high above
the natural grade, or to terraces, stips, unroofed porches, driveways, open parking
areas, or other similar features. Fences over four (4) feet in height are permitted
only when set back to the same yard requirements as for buildings. .Swimming pools,
other than small portable pools, shall be enclosed by adequate protective fencing.
Section 19 is hereby amended to read as follows:
_'SECTION 19. Zoning Permits. No building or structure shall be begun or ex-
tended, until a zoning permit authorizing such construction shall have been issued
by the Zoning Officer, except that no permit shall be required for small accessory
buildings not over six (6) feet by six (6) feet by eight (8) feet high, or for
small portable swimming pools.
Such building or structure shall be constructed or extended in accordance with
the terms of the permit.

Every application for a zoning permit shall state the tended use of the
building, the number of families to be housed, if any, the eight of the building,
and shall be accompanied by a plot plan with all the dimens ns shown indicating the
size and shape of the lot, the position of the buildings, and the front, side and
rear yards.
Applications for zoning permits shall be accompanied by fees payable to the
Village as follows:
For buildings the estimated cost of which
is not in excess of $50,000 $ 5.00
For buildings estimated to cost over
$500000 add not exceeding $1009000 10.00
For buildings estimated to cost over
$1009000 " 20.00
Unless there has been substantial progress in the work for which a zoning
permit was issued, said permit shall expire one year from the date of issue."
(underscoring indicates suggested new wording)
After discussion of above amendments Trustees decided not to make a decision
on Section 9- Fences and Walls, dealing with swimming pools and fencing thereof, .
until a later date.
Trustees suggested changing Section 19 to read as follows: "Zoning Permits.
No building or structure shall be begun or extended nor shall any buikding be
remodeled so as to change the function or structure of any of its rooms until a
zoning,permit authorizing such construction shall have been issued by the Zoning
Officer.......... etc. (underscoring indicating new wording)
' VOTED to tentatively approve the wording of above amendments as presented.
A Hawkers, Peddlers & Solicitors' Ordinance was read by Attorney Newman based
on the City of Ithaca's ordinance, but somewhat less detailed. During discussion
of this ordinance, certain additions to Charitable Organizations were suggested in
Section 8 - Exemptions.
VOTED to provisionally approve wording of the proposed Hawkers, Peddlers and
Solicitors's Ordinance as offered by the Attorney with suggested additions.
Engineer Rogers suggested a sufficient fee be charged for issuing road opening
permits to assure road being placed in as good shape as when opened. Trustees
instructed Engineer to look into matter.
There was a discussion regarding collection of yard refuse as stated in 1961
Village Folder and it was reiterated the Engineer should enforce it.
b. Mayor requested that Fire Councilman Quinlan under his report, advise the
Board of success of Fire Council, which has been operatingfor a year.
A brief discussion followed on Route 13 and a suggested letter prepared by
Trustee Wheeler to Governor Rockefeller opposing interchange on Cayuga Heights Rd.
among other matters was read.
VOTED to send letter to Governor Rockefeller over Mayor's signature,with
copies to Ray Ashbery and George Metcalf.
c. VOTED to accept the Offer and Acceptance of Federal Grant for Sewage
Treatment Works as presented by the Water Pollution Control Board and authorize
Mayor Marcham to sign for the Village of Cayuga Heights.

4) Attorney Newman's Report
a. The fire protection cost to the Town of Ithaca for 1962 in the amount of
$2,671.82 was approved by the Fire Council on 11/15/61 and later by the Cayuga
Heights Fire Company #11 and Town of Ithaca Supervisor Boynton, also the renewal
of the contract for a period of five years, 1962 -1967 using same formula as in
the past to figure cost.
VOTED approval of $29671.82 amount of cost for protection for 1962 and re-
newing Town of Ithaca Fire Protection Contract which expires December 319 19619
period January 19 1962 through December 319 1967 using same formula but deleting
and revising certain inapplicable parts as discussed to bring it up to date. Mr
Newman to draw up the new contract.
b. Mr.-Newman presented bills from McKinney Agency covering Comprehensive
General Liability Insurance policies, one for period 4/6/59 to 416160 in supple-
mental amount of $94.27 covering recommendations of charges when Audit was made
by insurance carrier; other bill for period 4/6/60' :to 4/6/61 in amount of $549.00
less credit of $25.74 or total of $523.26, (credit being for mileage correction
from 18.7 to 15.2 miles) as determined by insurance carrier's auditor. Mr. Newman
said McKinney Agency stated willingness to forgive supplemental bill for 1959 -60
but in 1960 submitted a bill for $549 for period 1960 -61. The Board rejected this
bill in June 1960 on the ground that the error on street mileage was company's
error, policy showing 8 instead of correct number of miles of roads.
VOTED that McKinney insurance bills be paid as recommended by Attorney Newman.

Mr. Newman reported on status of Cornell Sewer case and after discussion, it
was
VOTED to request the Committee consisting of Trustees French, McElwee and
Engineer Rogers, which has been negotiating with the University regarding sale of
the Savage Farm lot, to take up negotiations with the University in order to make
a final attempt to settle litigation concerning the Savage Farm sewer assessment.
5) Fire Councilman Quinlan read his report containing Council approval of proposed
1962 cost of Fire Protection Contract with Town of Ithaca in amount of $2,671.82,
which was also approved by Cayuga Heights Fire Company #19 and renewal of contract
for 5 years. Report placed on file.
Mr. Quinlan expressed the belief that the-Fire Council had proved successful
during the one year of operation.
6) Police Commissioner George read his report and recommended installation of 6
new 2500 lumen lamps on Pleasant Grove Road at a total cost of $114.00 for this
year; installation of one new 2500 lumen lamp on Ridgewood Road and increase to
2500 lumen the light on pole #36 -131 which would cost approximately $14.50 for this
year. Also recommended installation of 2500 lumen light on Comstock Road on pole
#39 -22 at a cost this year of approximately $11.50. Total cost of above installa-
tions being $140.00 for this year.
VOTED to approve proposed changes in street lighting as recommended by Police
Commissioner.
Commissioner George then gave his report of the Police Department for the
month of October, 1961 and it is on file in the Village Offices.
7) Engineer read letter from Harlow Fleck in regard to water lines to his develop-

VOTED to reassign Steven S. Oltz to position of Motor Equipment Operator for
® the Village as soon as possible.
Discussed Charles Collins' proposal to pick up garbage anywhere in Village
at cost of $2.00 per load. Requested Engineer to check into actual cost.
Engineer reported test made on Highgate Road showed difference in resurfacing
material than bid called for.
Engineer read the report prepared by Professor James Spencer of Agricultural
Engineering Department which listed comparisons of�Haterials used and New York
State Type lA as called for in bid. Engineer Rogers stated he had met with Mr.
Compagni of Economy Paving Co. However, the material used is probably as good as
specified but being of finer quality, might be more slippery when wet and possibly
coarser material would have spread farther. The Trustees believed it to be
satisfactory and complimented the Village Engineer for his diligence in the matter.
The Engineer advised the Board that Mr. Nichol, whocwas awarded the sidewalk
plowing contract, will use a 4 foot tread plow and blower equipped with lights.
The Engineer stated the Gentle sewer cost figures had been completed and
ssed out copies to Trustees. Cost of materials and rental of equipment being
$3x537.609 plus men's wages, use of village truck, and 15% overhead for a further
$1,185.49 or a total cost of $4,723.09« Since the Village agreed to pay cost of
westernmost manhole of $457.919 the cost to Mr. Gentle will be $4,265.18.
After Mayor read letter from Vice President Burton of Cornell University,
regarding desire of Village to purchase Savage Farm lot for a park, it was
VOTED to inform Mr. Ryan of the Finger Lakes Parks Commission that it is
impossible to proceed with the plan to purchase part of Savage Farm for a Village
park.
Engineer Rogers called attention to the plantings around the Village Hall
which are being done by nurseryman where Mr. Cornelius has been dumping sludge
from plant.
It was suggested that before we re- establish sewer rates again a Committee
be appointed to investigate. After a brief discussion, it was decided to include
a discussion of sewer charges on the agenda for the next meeting.
Mayor Marcham read Supervisor Boynton's acknowledgment of our willingness to
cooperate in policing part of the Town of Ithaca.
VOTED a fee of $1.00 be charged.for making copies of Village records on Copy
machine.
VOTED to hold next regular meeting Tuesday, December 19, 1961.
