2..• (a) Mayor Marcham read Attorney Newman's letter of May 11, 1959 giving his
opinion that it is legal to use surplus funds in the Capital Fund -Sewer and Water, and
Sewer,Capital Reserve Fund accounts for the building of a second tank, the financing
of the additional cost could be done through loans from the University; and his
opinion that the Village did have legal authority to sell sewerage service outside of
the Village limits.
(b) VOTED to charge a flat fee of $29000 a year for sewage service to
Tompkins.County Airport and to Cornell University Research Development Area as present
plans indicate for the General Electric Company including the present General Electric
Plant. Such charge to include routine maintenance but major maintenance will be done
by the Village and paid for by Cornell University. This agreement shall run two years,
1 after which time it may be redetermined by the Village Board of Trustees.
(c) VOTED for the Village to pay $30000 toward the cost of a proposed new
second sewage.treatment tank and to borrow $209000 from Cornell toward the tank, and
to request the University to meet, out of its own funds as a gift to the Village,any
-expense above this total of $509000.for engineering and inspection costs (estimated
at about $59000). Debt service charges on the total $50,000 to be repaid within.
30 years will amount of $2,700 thus making a total annual charge to the University of
$4,700.00
(d) VOTED to authorize Mayor Marcham and Carl Crandall to represent the
Village in sewage contract matters with Mr. John Burton of Cornell University.'
(e) Mayor Marcham read Mr. Wallick's report of the Greater Ithaca Regional
Planning-Board of May 11, 1959 regarding the preliminary plan of Route 13.
(f) VOTED to instruct the Clerk to write Mr. Towlson of the State Department
of Public Works to secure, as soon as possible, plans, profiles and cross sections of
proposed Route 13 through the areas where it crosses Cayuga Heights Road and where it
crosses n back of the Village sewage plant.

VOTED to correct minutes of May 23, 1959 to read transfer in appropriations of
the Sewer Fund to G- 123 -100 from G -123 -400 - $950.00`hnd to approve as corrected.

' of Public Works, E. E. Towlson's letter.of.May.19, 1959 stating that only preliminary
plans and profiles of Route 13 relocation through the Village were available. There
were no cross sections available and he would show what was available in his office.
Mayor Marcham discussed the Village paint of view on Route 13 relocation at length
with Assemblyman Ashbery. Mayor Marcham reported a complaint of lawnmower noise,
but because there is no Village noise ordinance, it should be treated as a private
matter between neighbors.
VOTED-to table discussion of a dog ordinance. '
4. Engineer Crandall reported that )contractor Degree has been warned to
speed up clean -up operations or work would be taken out of the contractor's hands.
The state's application-of a heavy armor coat to Renshaw Road in the-Village brought
up the question of the condition of the Village streets. It was suggested by Trustee
McElwee that a road betterment schedule be considered. The high cost of road work
and our relation with the Town of Ithaca in using their equipment was brought out by
the Engineer and he stated that as soon as Degree has finished his work, Texas Iene,
Highgate Place and other Village streets would be surface treated.
It was proposed to make the Village road maintenance program an issue at
the next Village Annual Meeting with the Residents. }
Application has been made to the State Department of "Public Works for a
catch basin and grating at the corner of Klinewoods Road and Renshaw Road to control
the storm water problem.
The Engineer reported that the,Hanshaw Road Sewer District plans have been
approved by State Department of Health and stated a contract resolution by the
Trustees with this District will be required. A large elm killed by the installation

6. Attorney Newman reported that no progress has been made by the appellant
toward arguing the SAVAGE FARM SEWAGE CHARGE before the Appeals Court and that there
was no action for the Village to take at this time.'
The case involving the request for exemption of the Country Club property,
now owned by Cornell University, has not as yet been arranged to be heard by this court
(expected this summer). -
Case of Sheldon Smith against the Village on matters of land assessment are-
scheduled to be heard on June 199 1959. --
The Brewer.action has been put over to the regular meeting of the Supreme
Court in November, 1959• ,
7. VOTED to accept the Police Commissioner's Report for 14ay,1959 as read
by him which included:

VOTED to purchase a car for the Village Police Officer for use in his official
capacity.
VOTED to authorize the Clerk and the Police Commissioner to draw up specifi-
cations and to advertise for bids for a car for the Village Police Officer.
Request from resident Frank Clifford for "Children at Play" signs at Village
Park and Highland Road was turned over to the Police Commissioner.
8. Fire Commissioner Hanselman reported that one fire had been put out in May
for Mr. Lucente.
The Fire Commissioners considered and recommended that the following mainte-
nance and construction work be done to the Fire Hall according to the following priority.
a) Recementing stone window sills (estimated cost $160)
b) Enclose area at rear of building with 516" fence (estimated cost for
materials $275) labor to be supplied by Fire Company.
c) Painting of all exterior woodwork of building particularly the western
exposure (no estimate of cost available).
VOTED,to allocate, out of Village funds, monies to pay for recementing sills
and painting of'all exterior wood of Village Hall and Fire House.

Letter of 5/28/59 from J. J. Wanderstock was read to the Board and it was,
VOTED to grant.permission to Mr. Wanderstock to tie into the new sewer
system .without cost other than the present $80 sewer use unit charge.
Letters of tor. R. Einaudi %dated 611159 were read and it was
VOTED that.upon receipt of a sworn statement that the residence of 212
Overlook Road will have no roomers for the period of 6/1/59 to 5131160 and that
if such status should change back, charges will be accepted on the 1960 -61 sewer
U112 the records be corrected and a refund of $20 be awarded Mr. Einaudi for over-
payment.
