PRESENTS Mayor Marcham Trustees Baker, Robert Catherwood, L. M. (Mrs.) Grant, Robert McElwee, Raymond Norton, Thomas O'Connor, James Treasurer Upchurch, Frederic Engineer Crandall? Carl Police Commissioner George, Lowell Attorney Newman, Charles 1) VOTED approval of minutes of November 10, 1959 famished the Trustees in mimeographs form. 2) VOTED approval of bills for payment as read by the Treasurer and as per SchedulesA,T-0 and 6-S. 3) 1�wor Marcham reported his attendance at a meeting on the University Research Park, the purpose of whidh was to discuss ways and means of insuring the success of the project. No present action that involves the „Village, but planning for the development of residential tracts in surrounding area is of great interest to the Town of Lansing. Mayor Marcham and Clerk Rogers met with Mr. Towlson on Route'13 relocation.�� A redesign of the Cayuga Heights interchange was discussed. The Mayor emphasized that the Village did not want any interohange'on Cayuga Heights Road. Maps of the right of way in back of the Sewer Plant were not brought by Mr. Towlson, but the Village was assured an underpass to allow men to work on the sewer under the right i of way would be built. If the location of future sewers necessary under the right of way was made known_to: the State, it would also'out the sewer under the road dur- ing construction. , The Mayor read the November 20th letter from the Tompkins County Board of Health pertaining to septic tanks on Sunset Drive. The matter was discussed and it was VOTED RESOLVED that in the opinion of the Board of Trustees there is no problem in connection with the use of septic tanks by the occupants of the three properties to the south (Bishop, Miller and Edgert). The Village Board grants per- mission to the owners of the other three properties to make lateral connection with the Renwick Heights Sewer District facilities, and recommends that the Sewer District negotiate with them. ALSO RESOLVED that the Board is willing to grant permission to the owners of the three properties to the south *e- the -eeath to enter into agreement with the ' Renwick Heights Sewer District if they wish to do so. Complaints of residents on snow plow damage to lawns was discussed with the conclusion that there was little basis for complaint. 172 1, , . 4) Attorney Newman reported the obtaining of a•release from Mr. Brewer and the submission of it to the Treasurer so that the claim of $250 could be paid. Engineer Crandall brought up the question of Village liability dn• street and sidewalk maintenance and referred to the City of Ithaca's new or- dinance attempting to limit liability. It was suggested that the Village might adopt a similar ordinance. VOTED to request Attorney NewAan'tostudy City Ordinance on street and sidewalk liability and to report to the Board of Trustees if it might be ap- plied to the Village. 5) Trustee Norton reported for the. Fire Commissioners that on December 3rd, 1959s Fire Underwriters inspected the Fire Department and gave compliments on progress made over the preceeding year. New hydrants were tested and the oral report was good (no written report has as yet been received). No copy of the fire truck contract signed by company official has as yet been received. Chief Quinlan or Commissioner Hanselman will go to Elmira the following weekend and attend to the matter. 6) Police Commissioner George read his report for November` which included: 13 complaints received 23 traffic summons issued 28 parking tickets issued The problem of icy intersections was raised. Engineer Crandall said Foreman Haskins could be called off his work of trash collection at any such an emergency occuAd to spread salt and cinders. Parents parking on both sides of The Parkway near Northway Road to pick up children,'block traffic. The Commissioner is to try placing "no parking signs" during certain hours on the east side of The Parkway; and to notify the parents through the school principal. Trustee McElwed noted that next fall High School students would have to walk down Kline Road or Renwick Drive.Nsithen road has sidewalks and both roads are steep, winding and dangerous. He proposed that next sumder, provision should be made for a safe walkway. 7) Engineer Crandall had nothing to report. Trustee McElwee reported on the work of his water improvements charge and bond committee. Figures were given for the cost to those benefited at vari- ous interest rates and for 30 and 40 year bond issue of $150,000. "The following resolution was offered by Trustee Baker who moved its adoption, seconded by Trustee O'Connor, to wit: WHEREAS the Board of Trustees of the Village of Cayuga deights by a bond resolution dated September 19, 1958, authorized the issuance of $200,000 serial bonds to pay the cost of an extension of the water distribttion up- tem of the said village; and WHEREAS, it is now desired to provide for the details and authorize the sale of such bonds to the amount of $150,000 and to provide for other matters in connection therewith; NOW THEREFORE;, BE IT follows: RESOLVED, by the Village Board of the Village of Cayuga Heights, as 7 U 1 173` Section -1I The serial bonds to be issued for the purpose aforesaid shall each be designated substantially CAYUGA HEIGHTS WATER (SERIAL) BOND, 1960, shall be dated January 15, 1960, of the denomination of $1,000 each, numbered ® from 1 to 1509 both inclusive, shall mature in numerical order in the amount of $4,000.00 on July 15 in each of the years 1961 to 19710 both inclusive, $5J'000 on July 15 in each of the years 1971 to 1980, both inclusive, and $6000 on July 15 in each of the years 1961 to 19909 both inclusive; and shall bear interest at a rate not exceeding five per centum per annum, pay- able semi - annually January 15 and July 15. Such bonds shall be in bearer coupon form with the privilege of conversion into bonds registered as to both principal and interest, and shall be payable as to both principal and interest in lawful money of the United States of America at the Tompkins County Trust Company in Ithaca, New York, which by contract is the paying agent of the issuer. Such bonds shall be signed in the name of the said Village of Cayuga Heights by its Mayor, sealed with its corporate seal, attested by its Village Clerk, mid the interest coupons shall bear the facsimile signature of said Mayor. Section 2, All other matters, except as provided herein relating to such bonds, shall be determined by the Mayor of said Village of Cayuga Heights# Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Mayor shall determine. Section 3. It is'hereby determined that subdivision 1 of paragraph a of Section 11.00 of the Local'Finance Law applies to the aforesaid object or pur- pose and that the period of probable usefulness thereof is forty years, computed from October 15, 1953s the date of the first bond anticipation note issued in anticipation of the sale of such bonds. Section 4. The faith and credit of said Village of Cayuga Heights, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same became due and payable. There shall be annu- ally apportioned and assessed upon the several lots and parcels of land which the Village Board shall determine and'specify to be especially benefited by the improvement, an amount sufficient to pay the principal and interest of said bands as tha same become due and payable, but if not paid from such source.. all the taxable real property within said Village shall be subject to the levy of an ad ,� valorem tax without limitation as to the rate or amount sufficient to pay the principal of and interest on said bonds as the same become due. Section 5. The powers and duties of advertising such bonds for-,sale,, conducting the sale and awarding the bonds, are hereby delegated to the Mayors- who shall advertise such bonds for sale, conduct the sale and award the bonds in such manner as he shall deem best for the interest of said Village of Cayuga Heights, provided, however, that in the exercise of these delegated powers, he shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of mimicipal bonds. The receipt of the Treasurer of said Village of Cayuga Heights shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 6. This resolution shall take effect immediately. Engineer Crandall explained the determination of, and recommended' and it was I m VOTED to base 70% of the cost of the water improvements financing on an average w th charge and 30% of the coat on an assessed valuation oharge. Those who benefited from increased pressure only, will, pay the assessed valuation charge only. Trustee Grant opposed. v VOTED to give the Mayor authority to set the day for a publio hearing on water improvements charges to be levied subject to the recommendat on 1 Attorney and the Clerk. 8) VOTED to accept Treasurer's report as read and submitted in mimeographed form which included the following bank balances for 11130159. Treasurer distributed in mimeographed form accounts reosivhble as of 11130159 totalling $2,672.00 and mentioned that it was the largest list ever left at'this time of year. 9) • The Clerk reported the hiring of Mrs. Rose Tierney for general office.- help at the rate of $2.00 per hour for a three month's trial basis. VOTED to increasethe yearly salary of the Deputy Clerk, Vera Snyder, from $33,2 0 to $3,750 effective retroactive to December 1, 1959. Upon recommendation of the Clerk and an estimate of $214 from Burr Ripley to install storm windows on the northwest windows, it web , VOTER to install storm windows on both windows and to install dots felt sweeps to reduce floor draft. 1, /J VOTED approval of application for Veteran's Exemption from Real Prop- erty Tax inn a amount of $1100 from Eda-ard Mo Govern, 210 Comstock Road. 10) VOTED to set the date for speoial meetings of the Village Board sitting as Assessors to fix property valuations for the 1960 Village Tax Roll for January 4, 62 8, 1960. 11) VOTED to set date for the next regular meeting - January 12., 1960. 12) Adjournment 10:30 P.M.
