V Be ;r�� John Be Rogers, III Clerk Minutes of a Special Meeting of the Village Beard of Trustees held at the Village Office at 5:00 P.M. on August 8, 19589 PRESENT: Mayor Trustees Engineer Attorney F. O.Marcham M. E. Campbell L. M.•Catherwood J. F. O'Connor T. E. Norton J. R. Simpson Carl Crandall Charles H. Newman ti VOTED to approve payment of bills as per schedules 3 -A, 3 -O; 3 -S and 3H -GTI. On the recommendation of the Village Engineer, it was VOTED to enter into a one year contract with the Burgess Manning Company for annual inspection of their meters in the Village Sewer Plant, Engineer Crandall reported that arrangements had been made with Mr. Otto Be Schoenfeld to-give the Village a right of way across his land, and an acre of land for a site•for the water storage tank necessary for the Northeast Water District. VOTED to instruct the Village Attorney to prepare a deed for the right of wpy for water. mains AW fob land for a water tank to be given to the Village by Mr. Otto Be Schoenfeld. Engineer Crandall reported that extensive work was being done by Village workmen on culverts and storm drainage ditches along the roads which had to be done prior to resurfacing. Attorney Newman reported that a claim against the Village, by resident R. Seldon Brewer of 1013 Triphammer Road, for water damage to his house and apartment had been filed. Upon recommendation of Attorney Newman, it was VOTED that the Attorney should examine the clai�i."as prescribed•in'Village Iaw. After reviewing the letter of April 3, 1958 from J. Reed Colbert and the sewer charges in question, the Trustees VOTED not to change the sewer charges of the Cornell Residential Club. VOTED to add extended coverage and vandalism and malicious mischief insurance to the fire insurance coverage on the Village Sewer Plant. VOTED approval of the proposed 1958-59-sewer charges and postal card notices thereof to Village property owners with notice of public hearing September 5, 1958 to adjust ' grievances as previnusly authorized. The Mayor mentioned that this was the last meeting for Trustee M. E. Campbell and thanke#fhim for his services; wished him luck in his move to Florida. The Mayor asked /the Board had suggest;Ions for a replacement to fill Trustee Campbell's term and if so that they be brought to his attention. 114 VOTED that sewer charge bills for fiscal year June 19 1958 -May 319 1959 be dated UR76er 31, 1958 to be payable without penalty through November 30,'1958. Bolton 218 Cayuga Heights Road Attorney Neal Stamp on behalf of Cornell University stated that the farm house at 704 Hanshaw Road had been completely demolished and the land known as 704 Hanshaw Road had been combined with the rest of the Savage Farm property. Therefore,.there should be,no sewer charge for 704 Renshaw Road. A written com- plaint'was filed with the Clerk to this effect. Also on behalf of Cornell Univer- sity he formally grieved on the sewer assessed to the Savage Farm property as statedc in a written complaint field with the Clerk. Attorney Shirey, on behalf of J. R. & Robert R. Colbert, claimed that the sewer charge of 45 units assessed to the Cornell Residential Club was unjust because the , units of the club were not the same as ordinary living units and that the occupancy was of a.low number. An official written grievance was filed with the Clerk. At the request of the Mayor, Attorney Shirey agreed to submit information as to the. number and attendance at banquets, dinners, etc. held at the Club. 1'15, VOTED to reduce sewer use charge of R. S. George 1) Minutes of'July 10, 1958 meeting were corrected to read (second paragraph, last line) - "premium of $3,263.40". Minutes of August 8, 1958 meeting corrected to read (fifth paragraph) "VOTED that the Attorney should examine the Claimant as prescribed in Village Law ". VOTED to approve the minutes of July 1, 1958 and the minutes of July 10, 1958 and August 8, 1958 as corrected. 2) VOTED approval of*bills as read by the Treasurer and listed ;in Schedules 3-At 3 -G. 3 -S and 3H -WI.: VOTED to borrow $69000 from the Water & Sewer Capital Reserve Fund-for the Water Improvement Fund. VOTED to transfer $1,000 from the Contingency Fund G- 290 -650 to the Sewer Fund, Supplies - G -123 -410. 3) Mayor Marcham reported that the nominating committee unanimously suggested that Dr. Alexius Rachun of 2iO Berkshire Road fill out the term of retired Trustee Campbell. VOTED to appoint Dr. Richun as a Trustee'of•the Village to serve for the remainder of the term of retired Trustee Campbell. Mayor Marcham read Mr. Towlson's letter of August 29th suggesting.that no more building permits be issued in the area near the proposed Route 13 relocation. 116 Engineer Crandall said that one permit had been issued to Mrs. A. Cicchetti for 706 Cayuga Heights Road which would have to be honored, but that Mrs. Cicchetti had been advised not to start building until Route 13 location was determined. Mr. Towlson's letter also pointed out that the Short Line Railroad Route location had been investigated and found impractical. 4) Attorney Newman announced that he expected a decision 9? the Savage Farm sewer case within two weeks and that Friday, September 12th at 2 P.M. had been set as the time to examine claimant R. S. Brewer. 5) Engineer Crandall reported that ditching of Village roads had continued throughout the summer and that many requests for this type of work had been received. The water service plans for the northeastern part of the Village are ex- pected to be advertised for bid September 24th and the contract is scheduled to be let in October 1958. Because this is to be financed by a bond issue it was VOTED to ask the Village Attorney to determine the procedure necessary to facili- tate the water improvement financing. The necessity and advantage of two water tanks instead of one tank was explained; the main advantage being safety to the Village residents. The estimated contract price for water expansion installation is $1709000. $409000 is expected to be reimbursed to the Village from the Northeast Water District when their water system is installed making an estimated net cost•to'the Village of $1309000. VOTED to accept the deed and easement (for water tank and lines) from Mr. Otto B. Schoenfeld. VOTED to request Mayor Marcham to thagk Mr. Otto B. Schoenfeld for his contribution of land and water easement and to include in his letter mention of receipt of Attorney Hamilton's bill and taht the Village would be glad to pay the bill if Mr. Schoenfeld so desires. 6) Treasurer Upchurch read a letter from Paul Bradford accompanying his a*it of the Village Books which explained his function as Auditor. VOTED to accept the Auditor's report with amendment "Sale of bonds July 1957" changed to read "Sale of Bonds, July 1958 ". 30TED to accept the Ceracche Television Inc. financial statement and pay- . ment due June 1958 and in accepting it to have it understood that in the future the Ceracche Television Inc. must comply with the Village Treasurer's request for proper financial statements. VOTED to approve the-Treasurer's report of August 311 1958 which included , the following bank balances: General Fund $ 749090.58 Sewer Fund 49844.85 Capital Fund - Sewer 279372.69 Spec. Assess.Fd.(Sewer lines) 10,103.87 Cap. Fd.Water Improvement 12.62 ' VOTED to repay $7,112.84 from the Capital Fluri Sewer to the Water & Sewer Special Reserve Fund. 7) No report from the Fire Commissioner. 1:17 8) Police Commissioner G*bge read his reports for June# July and August,19589 which included 31 complaints. A new school guard, Mrs.Eugene Robbins of Pleasant Grove Road was hired as of September 1, 1958- ' ® VOTED to pay the annual liability insurance premium on Police Officer Whiting's car and to see that the policy is written to cover Officer Whiting and the Village of Cayuga Heights. VOTED to purchase an inhalator for $131.089.to be carried in Police Officer's car. VOTED to transfer from the Contingent Account - A- 290 -650, $32.00 to Police Department Expenses Account - A -82 -2009 $32.00. 9) Clerk Rogers reported that in connection with proposed sewer charge grievances heard September 59 19589 it was . i VOTED to reduce Miss Williams' sewer use charge , on 322 Highland Road, from 3 to 1 unit, pending the receipt from Miss Williams of a Septic Tank Permit. VOTED to completely eliminate all sewer charges to Cornell University on 704 Hanshaw Road on the understanding that this property will be combined with the Savage Farm. VOTED to deny the request of Cornell University for a change in the sewer charge on the "Savage Farm Property". VOTED to base the average width charge for Mr.Streib, 112 N. Sunset Drive on 105'. VOTED approval of $147.60 for 3000 - 4¢ envelopes. VOTED to approve mailing of proposed letter of Tree Warden, Charles W.
