Handel Clerk Minutes of Special Meeting of the Village Board held at the Village, Office at 7 :30 P -M. on November 259 1957. PRESENT: Mayor • F. G. Marcham Trustee M. E. Campbell James F. Public Hearing on proposed sewer charges. 1. Above village officials and about 25 village residents and several attorneys met in the Village Fire Station prior to individual hearings on specific complaints. At.this time, the Mayor reviewed the sewer program and stated that a general explanation of costs and proposed charges would be made, following which statements could be made from the floor regarding the general plan orlpolicy of sewer charges. The Engineer reviewed the proposed plan of charges as explained in the January 209 1956 Sewer Brochure, which outlined the.whole sewer project and - which was approved by an informal vote of the villagers on February 9, 1956. Con- struction and other costs were about in line with estimates, and while all costs are notin as yet, indicated final figure of about $20,000 under the combined approved bond resolution of $7509000. The proposed individual sewer charges will pay,the budgeted costsfbr the June 19 1957 -May 319 1958 period. The Engineer, attorney and clerk then answered several questions relating to computation of proposed charges, length of financing period, amount of money to be raised, contingency allowance for shrinkage by reason of adjustments be- fore final charges are determined, and tax features of the proposed levy. Several statements were made from the that that inequities existed in individual charges, on which the Mayor commented that they would be heard-and considered individually. .,Several statements were also made that the proposed charges for sewer use rental relating to small families and roomers were unfair,•and that distribution of sewer rental might be made on a more equitable basis by means of water use)or population. These were answered by the Engineer that there are several systems of j i 72 charges that might be used and were in fact used by various communities. The Board had given consideration to alternate methods, and by reason of the particu- lar conditions locally, had chosen the family unit system. It is true that family size varies from one to eight or more persons, that roomers may or may not reside in the house for the full year, and may or may not pay for their room in money, that an apartment may not provide all the facilities of an ordinary family unit in a home, but it is also true that a portion of the Village is not served by public water, that public water is '.purchased by the Village from the City of Ithaca and billed individually to the Village residents, that there are indirect benefits and likewise responsibility-for cost sharing that cannot be directly related totally to such factors as water use, family size, population or size of living units, either in a house or an apartment. 2. Following the general meeting, the Village officials retired to the Village Office at 8:45 P.M., at which time they heard individually from all com- plainants. At this time 1,5 persons appeared, representing 19 property owners, and presented specific complaints regarding sewer charge items. The properties represented and persons who appeared are listed in the minutes of the Special Meeting. The Trustees also considered the written complaints from about 20 other property owners as also listed in the Special Meeting minutes. 3. Adjourned at 10:45 P.M. B. Special Meeting of Village Board 1. The following bills were approved for payment. See Schedule 6 -A, 6 -G, 6 -S. a) The following budget deficiency appropriations were: General Fund From A -2Qo -650 $ 750.00 To A -lo4 -1440 750.00 2. Considering the statements made at the above reported Public-Hearing and individual personal or written complaints, the Trustees VOTED to amend the formula for unit charges for sewer rental rates, as detailed in the minutes of October 8, 1957, item 7a, by a reduction of 10% in the unit charge for each apartment for apartments of 20 or more units. The effect of this amendment is to make this particular rate read: - "Apartments - less.than.20 units - each apartment 1 Unit Apartments - 20 or more units - each apartment 0.9 Unit Also the Trustees VOTED a reduction of 3 units in the total Corners Community Center sewer rental units. The effect of this is to change the formula as given in the minutes of October 89 1957 item 7a, to read : - "Commercial - Gas Station 1 Unit Professional Building 3 Units Bank 1 Unit Liquor Store 1 Unit Main Building 6 Units" 3. With corrections in the Sewer Work Books, as effected by the above changes, the Txustees considered the sewer roll completed and closed and VOTEDLapproval of the sewer roll in the aggregate amounts of $1,024,100 for land as- sessment; 789231 feet for average width of lot; and 865.75 units for sewer use rental; 74 and further approval of the individual property apportionments total2Ang tho.above mentioned aggregate amounts, and ordered the so completed sewer roll to be filed with the Village Clerk. ment, 5. To provide for individual chargeson the basis of the approved apportion- IT WAS VOTED RESOLVED, that the amount of $33,565.85 be levied for special assess- ment fund sewers, comprised of $6,150.00 on land assessment and $279415.85 on average width of lot assessment; that $38,992.50 be levied for sewer use rental, as these items have been verified by the sewer charge committee; that the Clerk extend upon the sewer charge roll the individual charges as computed from the individual property apportionments totallinE*hb amounts noted above, and to turn the thus completed roll over to the Treasurer. 6. To provide for collection of the sewer levy, IT WAS VOTED RESOLVED, that the Treasurer collect the individual charges.as provid- ed on the sewer charge ro7.1, with penalties as previously approved for delinquent payment. . 7. Clerk reported that Patrolman Lester A. Fowler had resigned as of November 30, 1957, and that acting on the advice of the State Civil Service,.Albany, in a telephone conversation with Mr. A. L. Steigman, the provisional appointment of a patrolman by the Mayor was being delayed until Albany had an opportunity to scan the XD -10 Forms for Application for Civil Service Examination, and provide the Village with a list of acceptable candidates. This would clear the Village from hiring an individual who could not meet the state age, education or.other basic requirements. 8. Certain items of hose, wrench and pump are needed by the Sewer Department for sewer cleaning. Accordingly, it was VOTED to authorize the Clerk to order such equipnent in the amount-of-about $675.00 and to charge the.same to the Capital Fund - Setter. 9. The Clerk has suggested that consideration be given to the possibility of extension of the Village boundaries by annexation, under. provision-of Village Law Sec. 348 -a, of the uninhabited area at the Sewage Treatment Plant Site, as acquired by purchase and condemnation from Maurice Avery and Leonard Liberman, Attorney Newman approved the.idea, and Engineer Crandall suggested the western limits should be the east line of the East Shore highway right of way. The area is-now in a water district as well as in the Town of Ithaca. At his suggestion, IT WAS VOTED that the Attorney investigate the legal angles of this matter and re- port back to theBoard, before.any approach, formally or informally, be made to the Ithaca Town Board. 10.
