B. Hearing on proposed ordinances, at 7:30 P.M.
PRESENT: Village Officials as noted above. Mrs. M. S. McIlroy, 419
Triphammer Road, Mr. James Matthews for Cornell University, Mr. W. Robert Farns-
worth for the Country Club.
1. Mr. Matthews presented a statement for Cornell University, re-
questing proposal to rezone Brainard- Woodcock and east of Triphammer Road area from
multiple housing to residential be denied. Mr. Farnsworth made a similar request on
behalf of the Country Club. The Mayor reported a conversation with Mr. Burton of
Cornell, in which he stated that Mr. Brainard and Mr. Woodcock were willing to with-
draw their request for the proposed rezoning. Mrs. Mollroy, Mrs. Catherwood and
Mr. Sayles spoke in favor of rezoning.
2. The Engineer suggested a change in the Parking - Section 3 of
proposed Traffic Ordinance to authorize the Police Commissioner to grant exceptions
where topographical conditions made the regulation unreasonable.
3. Clerk suggested change in Section 11- 11house" to "principal
building".
4. There were no further suggested revisions or changes except
in minor details of numbering and clarification of words.

1. Minutes of meeting of March 18, 1957 approved as submitted to Trustees
in mimeographed form.
2. Following bills approved for payment - See Schedule $11 and 11 -S.
3. a) The Mayor welcomed newly elected Trustee M. E.Campbell to the
official family of the Village.
b) Mayor noted that State Auditor, Mr. Fredenburgh had spent several
days at the Village Office on the audit for 1954-55 and 1955-56 fiscal years. His
informal report was that the books of the Treasurer and Clerk were in good shape.
4. Treasurer - Trustees VOTED to accept Treasurer's report for February,
previously mailed to the Village officials. Bank balance in General Fund as of
2/28/57 was $53.995.79. The March report will be mailed to the Trustees later in
the month.
5. Engineer - Sewers are about 90% complete. On request of Trustee Williams
to lay dust by oiling, Engineer will see what can be done at reasonable cost before
the permanent road topping is placed later on.
6.. Attorney - No report.,
7. Police Commissioner - Submitted his report for March, which the Trustees
VOTED to accept. He was authorized to purchase 12 additional stop signs, and suffi-
cient No Parking signs for the new traffic ordinance.
8. Fire Commissioner - no report.
9. Clerk - a) By resolution, the Trustees Voted to apportion the 1957 assess-

ment on the Links lot at The Parkway and Hlinewoods Road, erroneously assessed en-
tirely to Mr. Links, one -half ($1100) to Mr. Links and one -half ($1100) to Mr. Larkin,
as their respective ownership of the divided parcel appears on the roll:
b) A copy of the Greater Ithaca Regional Planning Board agreement, executed
by the City and Town of Ithaca has been received. No request has been made for payment
of the 1957 fee of $1000.
c) Trustees VOTED that Clerk notify Mr. Loberg that action is desired on
the fence on his property, so that he is ih compliance with the Zoning Ordinance tV
May 1, 1957.
10. Inspectors of Election - reported by Clerk - At the annual election on
March 19, 1957, 211 votes were cast, all for the office of Trustee for two year
terms, three to be. elected, as follows:

Clerk further reported that the elected Trustees had duly filed Oath of
Office and Affidavit of Eligibility.
11. Mayor appointed T. F. Sharp as Acting Mayor for 1957 -58 official year.
12. Following appointments were duly VOTED by the Trustees:
' a) Carl 9randall as Engineer for 1 official year, at an annual salary
rate of $7100 until May 31, 1957, payable monthly at the proportionate rate of
$2100 from the General bind and $5,000 from the Capital Fund - Sewer, and $5400
from June 1, 1957 until the expiration of his term, payable monthly at the propor-
tionate rate of $3,000 from the General Fund and $2400 from the Capital Fund - Sewer.
b) Carl Crandall as Zoning Officer for 1 official year.
c). Lowell T. George as Police Commissioner for 1 official year at annual
salary of $204; payable monthly.
d) ' 0. C. French as member of the Board of Fire and Light Commissioners
for five official years, until April 1, 1962.
e) Julius Weinhold as member on Board of Fire and Light Commissioners
for two years to fill balance of term of C. I. Bayles, who has resigned. '
f) Charles H. Newman as Attorney for official year 1957 -58 to act on
fee basis, as authorized by the Board of Trustees.
g) Paul Bradford asAuditor for official year 1957 -58, to act on a fee
basis, as authorized by the Board of Trustees, '
h) Sherwood Holt, as Chairman, and W. J. Foster, Jr., P. W.Gilbert,
T. W. Mackesey, F. H. Woodcock, H. H. Williams and Carl Crandall as members, to
constitute the Zoning Committee for the official year 1957 -58.
1) Engineer Crandall, Cleric Randel, and Trustees O'Connor and Simpson,
to constitute the Sewer Charge Committee for the official year 1957-58•
13. The Trustees duly VOTED the following resolutions: ;
a) That the First National Bank and the Tompkins County Trust Company,
both of Ithaca, N.Y. be designated as official depositories for Village funds for
the 1957-58 fiscal year.
b) That the Clerk be authorized to notify the official banks of the
fonwing names to be honored on checks for the year 1957 -58• (Three signatures re-
quired)l F., G. Marcham, Mayor, W. S. Randel, Clerk, F. M. Upchurch, Treasurer -
T.F. Sharp, Acting Mayor in absence of Mayor.
e) That the Treasurer be bonded in the amount of $259000 for the period
3/31/57- 3/31/58-
d) That the Clerk be bonded in the amount of $1,000 for period 9/1/57 -
9 /1 /S8.
e) That the Ithaca Journal be designated the official newspaper for
195758 official year.
f) That the Board of Trustees constitute itself and act as a Board of
Assessors for the 1957 -58 official year. (V. L. Sec.48)
g) Resolved that the Village Board of Health, previously consisting of
the Village Board of Trustees as members thereof, be and hereby is abolished.

15. Action on proposed Ordinances.
a) Trustee O'Connor moved the adoption of revised Ordinance .V - Mowing
and Care of Property, reading as follows:
"V. Mowing and Care of Property (As published October 15. 1953'and amended
April 1, 1957)•
"SECTION 1. The owner of any real estate in the Village of Cayuga Heights shall
keep his property in a sanitary and sightly condition, free from ash heaps, garbage,
and other rubbish, and mow all grass and weeds thereon at least once between June
lst and June 15th and at least once between July 15th and August 15th of each year.
The above requirement shall also apply to that portion of any abutting street or
road lying between the property line and the traveled roadway. Ashes, garbage,
and rubbish properly placed at the street front for collection by Village forces
shall not constitute a violation of this ordinance. (Amendment of April 1, 1957)
f he size of containers, and condition in which garbage, ashes and rubbish are pre-
sented for collection by Villagb forces, shall conform to rules and regulations as
adopted by the Village Board of Trustees
"SECTION 2. If the owner of such real estate shall fail to comply with the re-
quirements above specified, the Village Board of Trustees shall cause the work to
be done and assess the expense, including time of supervising officials, against
the property."
Seconded by James R. Simpson - Approved unanimously. ,
b) Trustee Williams moved the adoption of new ordinance VI- Traffic
Ordinance, reading as follows:
"VI. Traffic Ordinance (New ordinance of April 1, 1957•). An ordinance regulat-
ing traffic upon the public streets of the Village of Cayuga Heights and repealing
all other ordinances and sections of ordinances in conflict herewith. (Repeals VI-
Parking and Traffie'Violations).
11STOPPING, STANDING AND PARKING
"SECTION 1. 'Stoppir{g, standing or parking prohibited. No signs required.
No person shall stand or park a vehicle, except when necessary to avoid conflict
with other traffic or in compliance with the law or the directions of a police
officer or traffic control device, in any of the following places:
1. ' On a side walk.
2. On a cross walk.
3. Within 30 feet upon the approach to any flashing beacon, stop sign,
or'traffic eontrol signal located at side of a roadway.
4. Within 20 feet of the driveway entrance to any fire station and on
the side of the street opposite the entrance to any fire station within 74 feet of
said entrance (when properly posted).

5. Alongside or opposite any street excavation or obstruction, when
stopping, standing, or parking would obstruct traffic.
6. On the roadway side of any vehicle stopped or parked at the edge or
curb of a street.
® 7. Upon any bridge or other elevated structure upon a highway.
8. At any place where official signs prohibit stopping.
"SECTION 2. Parking not to obstruct traffic. No person shall park or stand any
vehicle upon a street, in such a manner or under such conditions as to leave available
less than 10 feet of width of the traveled roadway for £reemovement of vehicular traffic.
"SECTION 3. All night parking prohibited. No person shall park a vehicle within
the right of way lines of any street in this village between the hours of 2:00 A.M.
and 6 A.M. of any day, except physicians on emergency calls or emergency public or
public utility vehicles. Notwithstanding the above provisions, the Police Commissioner
is authorized to grant specific exceptions in cases where unusual topographical condi-
tions make this regulation unreasonable.
"SECTION 4. Parking adjacent to schools.
(a) The Police Commissioner is hereby authorized to erect signs indicating
no parking upon either or both sides of any street within the.right of way lines
adjacent to any school property when such parking would, in his opinion, interfere
with traffic or cteate a hazardous situation.
(b) When official signs are erected indicating no parking upon either side
of a street adjacent to any school property as authorized herein, no person shall park
a vehicle in any such designated place.
"SECTION 5. Parking or standing prohibited on narrow streets.
(a) The Police Commissioner is hereby authorized to erect signs indicating
' no parking or standing upon any street when the width of the traveled roadway does
not exceed 20 feet, or upon one side of a street as indicated by such signs when the
width of the traveled roadway does not exceed 30 feet.
(b) When official signs prohibit parking or standing on narrow streets
as authorized herein, no person shall park or stand a vehicle upon.any such street
in violation of any such sign.
"SECTION 6. Standing or parking on one -way streets. The Police Commissioner is
authorized'to erect signs upon the left hand side of any one -way street to prohibit
the standing or parking of vehicles, and when such signs are in place, no person shall
stand or park a vehicle upon such left hand side in violation of any such sign.
"SECTION 7. Removal of unlawfully parked cars. Whenever a motor vehicle is
parked in violation of the provisions of this ordinance, and the police are unable
to readily locate the owner or operator thereof, for the purpose of removing it, the
police are hereby authorized to cause such motor vehicle to be removed under its own
power, or by towing'to a local garage where it shall be stored until the owner or
operator claims the same and pays the charge for towing and storage, if any.
"SECTION 8. Presumptions. Proof of stopping, standing or parking.on public
streets of a motor vehicle contrary to the provisions of this ordinance, shall be
presumptive evidence that the person in whose name such motor vehicle is registered
is the person who so parked, stopped or left standing such motor vehicle, contrary
to such provision. '
"SECTION 9. There shall be no parking'on either side of the street within the
right of way lines on Highland Road, from The Parkway and Kl.ineiRoad south to the
Village Line.
There shall be no parking on the east side of Highland Road within the right of
way line from The Parkway north to Hanshaw Road and no parking on either side of
Wyckoff Road within the right of way lines from the south line of Ridgewood Road
north.fo'r 250 feet, and'no parking on the east side of Wyckoff Road from the north

line of Overlook Road north to the east line of Cayuga Heights Road, and no parking
on the west side of Wyckoff Road from the north line of Ridgewood Road north to
Overlook Road.
"SECTION 10. Any violation of Section 1 through 9 shall constitute a traffic '
infraction and any person violating the same shall be punishable by a fine not ex-
ceeding fifty dollars (,$50.00) or five days in jail or by both such fine and im-
prisonment.
"SPEED REGULATIONS
"SECTION ll.(a) Speed Limit. The Driver of any vehicle shall not drive or
operate such vehicle on any of the public streets of this Village at a rate_'of
speed gheater.than twenty -five miles per hour.
(b) Any violation of this section shall constitute a traffic infraction
and any person violating the same shall be punishable by a fine'not exceeding $100.00
or six months in jail or by both such fine and imprisonment. .
"THROUGH STREETS AND STOP STREETS
"SECTION 12. The following streets or part's of streets are hereby designated as
through streets:
The Parkway from Highland Road to White Park Road.
East Upland Road from Highland Road to Triphammer Road.
Ranshaw Road from Cayuga Heights Road to East Line of Village.
North Sunset Drive at Devon Road,and at Remington Road
Cayuga Heights Road at Berkshire Road, Remington Road, Devon Road, Ranshaw Road,
Wyckoff Road and Kline Road.
Klinewoods Road at The Parkway.
Triphammer Road at East Upland Road, Sheldon Road, Nidway.Road, Northway Road
and Klinewoods Road.
"SECTION 19. All streets intersecting the through streets designated in Section
12 are declared to be stop streets.
,,SECTION 14. Stop signs shall be erected and maintained in acdordance with this
ordinance on such intersecting streets at their intersections with such declared
through streets.
"SECTION 15. When stop signs are erected as herein provided at or near the
entrance to any intersection, every driver of a vehicle shall stop such vehicle
at such sign or at a clearly marked stop sign before entering the intersection ex-
cept when directed to proceed by a police officer or traffic control signal. After
so stopping such driver shall not proceed until the way is clear.
"SECTION 16'. The Board of Trustees of the Village may by resolution designate the
installation of "slow" or other warning signs at points on Village streets where
dangerous conditions are deemed by said Board to exist and such signs shall be obeyed
by all drivers of vehicles.
"SECTION 17. The Police Commissioner may, in his discretion during times of
emergency or other special conditions, and in the interest of public safety, tempo-
rarily direct, control, restrict, divert, exclude and regulate traffic on the,
streets, either through the police..officers or by means of posting temporary signs ,
or signals.
"SECTION 18. Any violation of Sections 12 through 17 shall constitute a traffic
infraction and any person violating the same shall be punishable by.a fine not ex-
ceeding $50.00 or thirty days in jail or by both such fine and imprisonment.

"EFFECT AND SHORT TITLE
"SECTION 19• This ordinance is intended to be supplementary to the Vehicle
and Traffic Law and other laws of the State of New York and if any part or parts
of this ordinance are held to be invalid because of conflict with such state laws
or otherwise such decision shall not affect the validity of the remaining portions
of this ordinance.
"SECTION 20. Repeal. The former traffic ordinances of the Village of Cayuga
Heights, N.Y., are hereby repealed, and all ordinances,or parts of ordinances in
conflict with or inconsistent with the provisions of this ordinance are hereby
repealed, except that this.repeal shall not affect or prevent the prosecution or
punishment of any person for any act done or committed in violation of any ordinance
hereby repealed prior to the taking effect of this ordinance.
"SECTION 21. Short Title.. This ordinance may be known and cited as the
Traffic Ordinance." !
Seconded by Trustee Simpson -Approved unanimously.
(c) Trustee O'Connor moved to table proposed revision of ordinance X1-
Section 1 - Districts, and to refer it to the Zoning Committee for further consider-
ation, ordinance revision reading as follows:
"XI. ZONING (As published October 15, 1953 and amended April 1, 1957)
"SECTION 1. Districts. For the,purpose of this ordinance the Village of Cayuga
Heights is hereby divided into three districts as follows:
Residence District
Multiple Housing District
Commercial District
The Residence District is all the area of the Village not included in
either the Multiple Housing District or the Commercial District.
The Multiple Housing District is that area bounded on the south by the
Village Line, on the west and north by Kline Road and Oak Hill Road to a point at
the western end of Lot No. 160, thence easterly along the southern boundary of Lot
No. 160, No. 161, No. 162, No. 163 and 168 to the northeast corner of lands of
West View Terrace, Inc.: thence southerly along the east line of lands of West View
Terrace, Inc. 335 feet to the north line of Country Club Road: thence easterly along
the north line of Country Club Road and the prolongation thereof across Triphammer
Road to a point 600 feet from the center line of Triphammer Road, and bounded further
on the east-by a line from such point southerly.to the south Village Line parallel to
the center line of Triphammer Road and 600 feet easterly therefrom."

e) Trustee Sharp moved the adoption of revision of Ordinance XI -
Section 6 - Yard Requirements, reading as follows:
XI. ZONING
SECTION 6. Yard requirements (as published September 15, 1953, with the fol-
lowing amendment of April 1, 1957, changing the last paragraph of this section to
read:)
The front yard in each case shall be measured from the property line of the
street. In case of corner lots, the front yard requirement shall apply to each
street abutting the property." '
Seconded by Trustee O'Connor - Approved unanimously.
f) Trustee.Sharp' moved the adoption of revision of Ordinance XI-
Section 11. Trailer -- Peading as follows:
"SECTION 11. Trailers (amendment of Apr 1, 1957) -- add -to -Title - -fTem orary

add -- 1Temporary structures such as construction shanties, as well as construction
material, must be removed from the premises within ninety days of the time when the
principal building on the premises is ready for occupancy

g) Moved by Trustee Simpson, seconded by Trustee Williams and
VOTED unanimously that.above ordinances as adopted be published'and posted as re-
quired by Village Law Section 95, on April 6, 1957, and that the same take effect
on and after April 20, 1957.

h) Moved by Trustee Williams, seconded by Trustee Sharp it was
VOTED unanimously to refer ordinance XI - Section 1 - Districts to theZoning
Committee for further study.
i) The Clerk was instructed to delay printing a supplement to'the
Village Ordinances for general distribution, pending possible action on further
ordinance revisions.
16. Report on budget hearing - See A - Hearing on 1957-58 proposed budget.
17. It was VOTED RESOLVED that the budget and appended salary and wage
schedules for the fiscal year June 1, 1957 - May 31, 1958 as incorporated in the
minutes of this meeting be. adopted.
18. It was VOTED RESOLVED that the amount of $76,825.94 be levied upon the
taxable property of the Village for the year 1957-58•
19. It was VOTED RESOLVED that the Clerk is hereby authorized and directed
to extend and carry out upon the assessment roll the amount to be levied against
each parcel of real property shown thereon, according to the total levy of
$76,825.94 previously authorized.
20. Time set for regular meetings for 1957-58. Second Tuesday of the month,
unless otherwise determined at the previous•regular meeting.
