Minutes of a Regular Meeting of the Village Board held February 9, 1956 at
7:30 P.M. at the Village Office.
PRESENT: Mayor Henry J. Shirey; Trustees, N. A.Christensen, F. G.'Marcham, T. F.
Sharp, and H. H. Williams. ALSO PRESENT: Engineer Carl Crandall, Treasurer Upchurch,
Attorney Armand Adams and Police Commissioner Lowell T. George.
NOTE : - Meeting of the Village residents was held on Tuesday, February 7, 1956 at
8 P.M. at the Schoolhouse to discuss the Sewer Project. The Mayor introduced Engineer
Carl Crandall who presented the various aspects of the project from the history through
the engineering design and financial status as of the moment.
Mayor Shirey advised the residents of his recent talk with Mayor Ryan of
Ithaca, stating that on asking him what was on his mind, Mayor Ryan told him to ask the
City Attorney who was also present. The Attorney stated the present administration was
anxious to have the•Village consolidate with the City. The Common Council is very
serious and taking a better view of consolidation than before. They would like to have
us come in, with no strings attached, on an amicable and even basis. Mayor Shirey asked ,
Mayor Ryan and the City Attorney for permission to report that statement to the village
residents at the planned meeting on the 7th of February and also asked.if it was going
to make any difference to them or to the Common Council whether we have our sewers in
first or not. He added he felt the City'was going to be just as well off whether or
not we have our sewers; Mayor Ryan said; "That's our thinking, " and nodded his-head
yes. It was agreed no publicity would be attached to this meeting and Mayor Shirey .
thought he had been !'doub]Lgagrossed ", and checked to find out whether the Common
Council or the Mayor had /the statement which appeared in the Journal about "setting
annexation back two generations if sewers were installed ", but they did not. Mayor
Shirey felt the'time to talk about annexation is not now, but that we should get our
sewers in, get.our health problem solved and then sit dorm and talk calmly about
annexation.

1. Minutes of the meetings December 28, 1955 and January 3, 5, 11, 12, 13 and
20, 1956 previously furnished trustees in mimeographed form were approved without
reading.
2. Following bills were approved for payment, see Schedule #10, 10S and 7F.
3, The canvass of the vote on the sewer extension and sewage disposal plant
project was 415 YES - 71 NO - 12 VOID totalling 498 votes.
Considering this vote as favorable the trustees proceeded with consideration
of the next steps on the project and under the guidance of Attorney Armand Adams the
following actions were taken.
(1) Moved by Trustee Williams, 2nd Trustee Sharp and approved unanimously,
that, WHETS, the Board of Health of the County of Tompkins has notified the
Village of Cayuga Heights that it must as soon as possible, in the interests of public
health, provide for public sewer service for all the inhabitants of the village; and-

WHEREAS, the Board has carried on negotiations with the City of Ithaca in an
effort to obtain the extension of the sewer system of the City of Ithaca to serve the
Inhabitants of the Village, but the City of Ithaca has declined to extend such city sewer
system so as to serve the whole of the Village of Cayuga Heights unless the Village became
annexed to the city; and
WHEREAS, the ihhabitants and voters of the Village of Cayuga Heights have by
vote disapproved of such annexation; and
WHEREAS, the Board has carefully considered the matter•and• has -caused studies
and surveys to be made by competent engineers inquiring into the feasibility and cost of
.a village owned sewer system; and
WHEREAS, detailed plans and specifications for a Village sewer system and
sewage disposal and treatment plant have been prepared, and the same have been approved
by the State Department of Public - Fealth; and
WFE;REAS,.the Board has received bids and estimates indicating that the cost of
extension of'the present sewer lines and the construction of a sewage.disposal plant
would cost not to exceed $700,000.00; and
WHEREAS, the inhabitants and eligiblo voters of the Village of Cayuga Heights
have been furnished with a brochure entitled "Sewers and Sewage Disposal for Cayuga
Heights, N.Y. ", which clearly and fairly explained the problem and need for a dewer
system and 'outlined the plans for financing the same, including proposals for issuance
of bonds; and whereas a public meeting for the purposes of discussion of such plans was
held on February 7, 1956; and
WHEREAS, the inhabitants and eligible voters of the Village did by an informal
written ballot on February 9, 1956 express their approval by•a vote of 415 for, and 71
against, of the Village proceeding to construct said sewer system and the issuance of
bonds of the Village in an amount of not to exceed $481,000.00 for the extension of
sewer lines and $269,000.00 for the construction of a sewage treatment plant; and
WHEREAS, this Board deems it in the best interest of the Village of Cayuga
Heights and the inhabitants thereof that the Village proceed immediately to construct
said sewer line extension and sewage treatment plant;
NOW THEREFORE, BE IT RESOLVED;
1. That the Village of Cayuga Heights construct a sewage disposal and
treatment plant and an extension to the present sewer lines, in accordance with the
Plans and Specifications of the Village Engineer, on file in the Village Office;
2. That the plan of operation and the financing of.said construction
be substantially as outlined in the brochure above referred to;
9. That the Mayor, Clerk, Village Engineer and Village Attorney be
instructed and directed to take such steps as may be necessary to immediately unde8-
take the construction of said sewer extensions and sewage treatment plant including the
acquisition of land for the site and easements and rights of way for sewer lines, appli
cations for permits and such other steps as may be necessary to implement the orderly /
undertaking of said construction.
(2) Moved by Trustee Christensen and seconded by Trustee Williams and
approved unanimously that,
WHEREAS, the Board of Trustees has by Resolution adopted concurrently herewith
expressed its intention to proceed with the construction of a sewage treatment plant

and an extension of the sewer lines to provide complete sewer services for the inhabitants
of the Village and vicinity, and has authorized the acquisition of lands and easements for
such purpose:
NOW THEREFORE, BE IT RESOLVED:
1. That the Village purchase of and from the Cayuga Heights Land
Corporation the 14.6 acre tract of land on Remington, Road as shown on the "Property
Map showing Vicinity of Proposed Sewage Disposal Plant" made by Carl Crandall,
Village Engineer, under date of November 12, 1955, for the sum of FIVE THOUSAND
DOLLARS ($5,000.00).
2. That Armand L. Adams be engaged by the Village as its attorney to
certify marketable title tolsaid premises and to negotiate the transfer of a deed to
said premises upon presentation of evidence of such marketable ..title.
(3) Moved by Trustee Marcham, seconded by Trustee Christensen and approved
unanimously,.that
WHEREAS, the Board of Trustees has by Resolution adopted'coneurrently herewith
expressed its intention to proceed with the construction of a sewage treatment plant
and an extension of the sewer lines to provide complete sewer services for the inhabi-
tants of the Village and vicinity, and has authorized the acquisition of lands and
easements for such purpose;
NOW THEREFORE, BE IT RESOLVED:
1.' That the Village purchase of and from Maurice C.Avery the 1.72 acre
parcel of land, more particularly described in a deed to said Avery from the Associated
Real Properties, Inc., dated April 17, 1934.and. recorded in the Tompkins County Clerk's
office in Liber 249 of deeds at page 140, for the sum of FOUR THOUSAND AND FIVE ,
HUNDRED DOLLARS ($4,500.00).
2. That the Village Attorney or acting Village Attorney be
instructed to negotiate the transfer of a deed to said premises,upon presentation
of evidence of marketable title of the same.
(4) Moved by Trustee Williams, seconded by Trustee Sharp and approved
unanimously, that
WHEREAS, the Hoard of Health'of the County of Tompkins has notified the
Village of Cayuga Heights that it must construct and place'in' operation a public sewer
and sewage disposal system as a means of collection and disposal of* sewage and other
domestic wabtes from the'Village as soon as possible; and.
WHEREAS, the Board of Trustees of the Village of Cayuga Heights has adopted
plans for said sewer system and sewage disposal system and said plans have been approved
by the State Water Pollution Control Board and the Department of Public Health of the
State of New York; and
WHEREAS, the Board of Trustees of the Village of Cayuga:Heights desires to
proceed with the construction of said sewer system and sewage. disposal and .treatment
plant immediately in order that the same may be completed and in operation by April
1, 1957; and
WHEREAS, the VillageEngineer has reported to this Board that Leonard H.
Liberman is the owner of certain lands and interest in lands which must be acquired
for such construction, to wit certain lands, easements, interests and rights in land
as more particularly shown on a map entitled "Property Map Showing Vicinity of Proposed
Sewage Disposal Plant for Village of Cayuga Heights, N.Y. ", made by Carl Crandall, C.E.

and Village Engineer under date of November 12, 1955, which. said. lands and interests
are also more particularly described as follows:
ALL THOSE TRACTS OR PARCELS OF LAND or the interest therein of Leonard
B. Liberman, partly.situate.in.the.Village of Cayuga Heights and partly in
the Town of Ithaca adjacent to the Village of Cayuga Heights, Tompkins County,
New York, more particularly bounded and described as follows:
PARCEL NO. ONE
THE FEE title in the premises described as follows:
Beginning at a point in the easterly line . of the former Right of Way of the
former Central New York and Southern Railroad which is S 820.44' E, 31.6 feet from the
northeast corner of premises conveyed to Maurice C. Avery.by deed of Associated Real
Properties, Inc. dated April 17, 1934 and recorded in the Tompkins County Clerk's
Office in Liber 249 of Deeds at page 140; running thence N 70138' W along the easterly
line of the aforesaid former Right of Way, it being also the westerly line of premises
of the Cayuga Heights land Corporation, a distance of 125 feet to a point at or near
the southerly bank of a small stream; thence S 740 40' W, 150 feet to a point; thence
N 720 12' W, 91.1 feet to a point; thence N 160 28' W. 50.9 feet to a point hereinafter
referred to as point "A"; thence S 640 00' W, 42 feet to a point hereinafter referred

SUBJECT TO Existing rights of way, reservations of mineral rights and ease-
ments as now exist, in favor of the New York State Electric and Gas Corporation, the
Remington Salt Company or its successors in interest, the City of Ithaca in connec-
tion with a water main, Maurice C.Avery in connection with an access driveway and the
State of New York and the public in the use of the state highway, included within the
boundaries of the above described premises.

An easement or Right of Way, in common with Leonard B. Liberman, his assigns
and successors in interest, and other persons or corporations legally entitled to use
the same over an existing access driveway westerly and portherly of Parcel No. One, as
hereinafter described:
Beginning at the point in the easterly line of the Right of Way of the East
Shore Drive hereinabove referred to in Parcel No. One.as point "C "; running thence westerly
at right angles to the aforesaid highway, 20 feet to a point; thence N 9032' E parallel
with and 18 feet northwesterly from the boundary of,Parcel No. One above described about
84'feet to a point opposite Point "B "; thence N 640 00' E parallel with and 18 feet
northerly from the boundary of Parcel No: One above described about 53 feet to a point;
thence S 160 28' E about 18 feet to the point referred to in Parcel No. One above
referred to as point "A"; thence S 640.00' W, along the northerly line of Parcel No.One,
42 feet to a point "B" hereinabove referred to; thence S 90 32' W, along a northwesterly

course of Parcel No. one, 65 feet to the point hereinabove referred to as point °C °,
it being the place of beginning.
Said easement or Right of Way being for the purposes of vehicular and pedes -..,
trian access and egress, and utility lines over head or underground; appurtenant to
Parcel No. One herein.and adjoining lands being acquired by the Village of Cayuga
Heights from Maurice C. Avery and Cayuga Land Corporation, and including the right
of paving:or otherwise improving said Right of Way.
PARCEL NO. THREE
An easement and Right of Way over and along the 30 foot wide abandoned
Right of Way of the former Central New York and Southern Railroad, extending. from the
North line of.Parcol'No. One northerly a distance of about 1300 feet to lands of
Hilda A. Smith, said Right of Way-being for the purpose of constructing, maintaining
and operating sewer manholes and underground sewer lines, the bottom-of said line to
be at a depth of not less than three (3) feet below the surface of the ground, in
connection with the sewer system of the Village of Cayuga Heights or extensions thereof,
fee title in said 30 foot strip being retained by Leonard B. Liberman, his successors
and assigns.
PARCEL NO. FOUR
Together with argq and all riparian rights of Leonard B. Liberman, if arty,
in and to that portion of Cayuga Lake abutting the above specified 30 foot width.'$

WHEREAS, the Village Engineer acting for and under the direction of the Board
of Trustees has endeavored unsuccessfully to purchase said property, easements, interests
and rights of property from the said Leonard B. Liberman at a fair price;
NOW THEREFORE BE IT RESOLVED, that this Board finds and determines that the
acquisition of said property, easements, rights and interests of Leonard B. Liberman
as above described, is necessary for the public use and health, and that it" unable to
acquire the same by purchase at a fair price from the said- Leonard B. LibeAan; and
BE IT FURTHER RESOLVED, that the Mayor of this Board be instructed to sign
and verify in the name of the Board of Trustees of the Village of Cayuga Heights, a
petition to the County Court of the County of Tompkins to acquire the property, ease-
ments, rights and interests of Leonard B. Liberman as hereinabove described, by condom-..,.-',
nation, and for the appointment of three Commissioners of Appraisal to ascertain and
determine the compensation to be paid to the said Leonard B. Liberman for said prop-
erty, easements, rights and interests; and the Mayor is hereby granted full power and
authority to perform any and all acts necessary for acquiring said property, easements,'
rights and interests, and to sign all papers in connection with said proceedings in
the name of the Village of Cayuga Heights, with the same force and effect as if done
by the Village of Cayuga Heights, and the Village Clerk is also hereby authorized and
ALL the right and interest of Leonard B. Liberman, his distributees, suc-
cessors and assigns in any and all rights,
including but not limited to, reversions,

Purchase, on.behalf of the Village of.Cayuga Heights, the property; easements, rights
and interests of Leonard B. Liberman as above specified for the sum of Three Thousand
Seven Hundred and Fifty Dollars.($3,756.00), "and to serve or otherwise present the
same to the said.Leonard B'. Liberman; and

the said proceedings on behalf of the,.Board of Trustees and the Village:of:Cayuga
Heights, in accordance with the provisions of the'Condemnation Law of the State of New
York. .
(5), Moved by Trustee.Sharp, seconded by Trustee Williams and approved
unanimously; that
WREREA,S, plans for.the sewage disposal plant require that.the outfall line
cross under the-:tracks of-the Lehigh.Valley_Railroad from.the west boundary of the
Liberman property, to Cayuga Lake, the center line of which is shown on the,plans;:-
RESOLVED, that the Clerk be and.he hereby.,is authorized and directed to
Rake application to the Lehigh Valley Railroad'for a license for such crossing;'and
be it further,resolved' that the.Clerk be authorized and directed to pay.to the rail-
road the fee of $15.00 for preparation of papers and the sum of $12.00'for the first
year's.rental commncing.as of.the first day of March, .1956.
(6) 2roved by Trustee Christensen, seconded by Trustee Williams and approved
unanimously! that:
WHEREAS, the plans for the sewage disposal plant require the extension of a
sewer outfall line into Cayuga Lake for a distance of 1500.feet from the shore and for
this purpose an underwater land grant must be obtained from the State of New York;
RESOLVED] that the Clerk be and he hereby is authorized and directed to
make application to the Attorney General of the State of New York or to such other
officer or department as may, be necessary to obtain the.grant for the sewer outfall
line, the location of the same to be as'ihdicated on the plans for the sewage disposal
plant.
(7) Moved by Trustee Marcham, seconded by Trustee Christensen and approved
unanimously; that
WHEREAS, sealed proposals for the construction of an extension of the
sanitary sewer system were received and publicly opened at the Village Office on
January 13, 1956, in accordance with the advertisement duly published by this Board
and report of all such bids has been made to the Board of Trustees and the same have
been reviewed by the,Village Engineer;
BE IT RESOLVED, that.this Board finds and..determines' that A, Plotzker Co.,
Inc., of Rochester, N.Y. is the lowest responsible bidder, whose proposal'amounting
in the aggregate to $451,547.95 complies with.all the,provisions, required to render
it formal; and.
BE IT FURTHER RESOLVED that the,bid of A.•Plotzker.Co.,'Inc., of Rochester,
N.Y, for the construction of an extension of.the sanitary sewer system for the Village
of Cayuga Heights for a total contract price of.$451,547.95:be And the same hereby is
accepted, and the contract therefor is hereby,awarded to.said bidder; and

BE IT FURTHER RESOLVED that the Mayor be and he hereby io authorized and
directed to execute on behalf of the Village of Cayuga Heights the agreement for such
construction as set forth in the contract documents, as soon as the right of entry of
the Village on all necessary private and state lands and roads is established by
permit, easement, deed or condemnation order as required.
(8) Moved by.Trustee Marcham, seconded by Trustee Christensen and approved
unanimously; that
WHEREAS, sealed bids for the construction of a sewage disposal plant were
received and publicly opened at the Village Office on January 13, 1956, in accordance
with'the advertisement duly published by this Board and report of all such bids has been
made to the Board of Trustees and the same have been reviewed by the Village Engineer;
BE IT RESOLVED, that this Board finds and determines that William E. Bouley
Co., Tne., of Auburn, N.Y. is the lowest responsible bidder, whose proposal amounting
in the agtregate to,$183,318 complies with all the provisions required to render it
formal; and
BE IT FURTHER RESOLVED that the bid of William E.Bouley Co., Inc. of Auburn,
N.Y. for the construction of a sewage disposal plant for the Village of Cayuga
Heights for a total contract price of $183,318. be and the same hereby is accepted, and
the contract therefor is hereby awarded to said bidder; and
BE IT FURTHER RESOLVED that the Mayor be and he hereby is authorized and
directed to execute on behalf of the Village of Cayuga Heights the agreement for
such construction as set.forth in the contract documents, as soon as the right of
entry of the Village on all necessary private and state lands and roads is estab-
lished by permit, easement.; deed or condemnation order as required.
(10) Moved by Trustee4Tilliams, seconded by Trustee Christensen and approved
unanimously
RESOLVED, that pursuant to the general plan for the construction of a sewage,
disposal system, the-Village Engineer be, and he hereby is, authorized and directed
to obtain all necessary. rights of way from property owners which may be required by
the Village for the location and construction of sewer lines and sewer extensions for
the collection and delivery of sewage and domestic wastes to the sewage disposal
plant./
4. Mayor's Report - The Mayor presented a request from the state regarding
the coding of assessment.rolls by ,property classification and
IT WAS VOTED to so classify the property on the Village Roll.
5. Aside from the.sewer project matters previously reported and included in
the resolutions previously adopted, the Engineer reported an application for an
operator for the Treatment Plant; also some conflict with Ceracche on the,installa-
tion of television cable within the Village.highways.
6. The Treasurer presented his report for the period ending January 31, 1956
showing balances.as follows:.
General Fund 42,285.40
Capital Fund —Fire Department 4,841.42
Capital Fund - Sewer 12,101.97
The Treasurerle Report was ordered accepted and filed.
7. The Clerk reported on work with the State Comptrollers Office on the debt
exclusion application for the Sewage Treatment Plant, received'from.the City the
Sewage Agreement for the calendar year.1956, and the preliminary total of the assess-
ment roll of $6,915,360 subject to verification and any reductions by reason.of
Grievance Day changes.
8. The Police Commissioner's Report for.January.showed U, complaints and
arrests for speeding - 5, stop sign - 1 and parking - 8:,,,Also that Officer Fowler
bad attended the police training school held in the.City,of Ithaca.
Trustees considered the disirability of informing,the village residents '
of the police Phone number, .fire phone number and .the,new.fillabe office address,
and authorized the Police Commissioner.to prepare a suitable card with this
information, to be mailed with the tax bills in 'June.

9. There was no report from the Fire Commissioner:
10. IT WAS VOTED RESOLVED, that the Trustees go into a committee of the whole to
make up the 1956 -57 budget.
® The Treasurer presented his budget estimates, considered the receipts and ex-
penditures to date for the current fiscal year, projected estimates for the.1956-57
year and from these the Trustees made up a tentative budget in the amount of.$95,000.
It was calculated that this budget could be carried on a .009 tax rate on the basis
of the anticipated assessment roll of around $6,900,000. and an estimated surplus-from
the current year of $21,000 - $22,000.
11. IT WAS VOTED that the Committee as the whole adjourn to meet again as a.
committee of Trustees.
12. IT WAS VOTED that.the tentative budget as submitted by the Committee.of, the
Whole be presented io the Village Residents for discussion at the 'Annual Meeting on
March 19th.
13. IT WAS VOTED RESOLVED: That according to the provisions of Section 52 of
the Village Law o£. the State of New York, a village election will be held on March 20,
1956 at the Schoolhouse in the Village of Cayuga Heights, the polls to be open between
4 and 8 P.M. at which time a mayor will,be elected for a term of two years in place of .
Mayor Henry J.Shirey and three trustees each for terms of two years in place of Trustee
Theo F. Sharp, James R. Simpson and Theodore P. Wright, to fill the vacancies caused
by the expiring terms of the aforesaid mayor and three trustees on the first.Monday in
April 1956.
14. Trustees set the date of March 19, 1956 at 8 P.M. at the Schoolhouse for the
Annual Meeting of the residents of the Village to make nominations for Mayor and three
trustees, to consider the tentative budget for the 1956-57 fiscal year, hear reports of
the officers of.the Village and.such other business as may properly come before the
meeting.
15. Date set for the next SpecirA Meeting of the Village Board, Tuesday, February
21st, 1956. Also Grievance Day would be held to hear complaints of property.owners on
the 1956 assessment roll from 7 -11 P.M.
16. Date set for the next Regular Meeting of the Village Board, 7:00 P.-M.-
Monday, March 19, 1956.

1. On this date the Board of Trustees, sitting as a Board of Assessors for
four hours from l to 11 P.M. heard grievances and complaints with regard to-the
assessment roll as prepared by them for the year 1956 and as filed with the Village
Clerk prior to February 1, 1956.
