Minutes of a Regular Meeting of the Village Board held on Tuesday, October
9, 1956 at 7:30 P.M. at the Village Office.
PRESENT: Mayor Frederick G. Marcham; Trustees Louise. M. Catheraood, James F.
O!Connor, T. F.Sharp, Harold H. Williams; Engineer Carl Crandall;, Police Commis-

ALSO PRESENT: Orrin J. VanDyk and Professor H. W. Riley
,A) Dr. VanDyk reviewed situation on Route 13 realignment and suggested that
the Board move on the offensive, rather than sit back and find as an accomplished
fact a routing of Route 13 approved.by the State, but not to the liking or benefit
of Cayuga Heights Village. He felt the Riley plan had merit and requested that
Board.hear Professor Riley.. As explained by Professor Riley,.his (Avery - Riley)
plan reroutes Route 13 as follows: Turn off Route 13 north of Dryden at Sweetland
Road (el.1324) follow westerly on or nearly level route, intersecting North Trip-
hammer Road at Burdic� Road, intersecting Route 34 at top of Esty hill, and follow-
ing Route 34 or a new-route between Route 34 and 34A to lake level, and through
city on approved City routing. He calculated mileages to State and Meadow Streets
as follows; Riley plan 18.25 miles; Plan B - 18.25; present Route 13 _ 16.1. His
plan requires one bridge over Fall Creek, two railroad grade crossings, and a
rather complicated and expensive job to get down from Estys if a new road is placed
on hillside between Route 34 and Route 34A. The advantages of his plan are -
(1) Easy terrain - grade quite level (2) Point where road ends is nearest to Cayuga
Lake surface level.(3) Property rights inexpensive, and (4) would be.a long term
solution. Great disadvantage is cost.
Engineer Crandall reviewed history of study of Route 13 realignment, which
was started as a project for an alternate truck route to keep trucks off Mitchell
Street::and Ithaca Road. He felt the Riley Plan, or Plan B, dumping trucks into N.
Cayuga Street would be no better. The Route 13 conjestion is from Varna.west into
the City and is not due to through traffic, therefore it is questionalbe if Riley
Plan or Plan B would appreciably relieve truck hazards on Mitchell Street, Ithaca
Road and East State Street. .
The effect of the tuning fork, a factor in Ithaca traffic, is yet to be
determined.
He felt there were three possibilities in coming down from Estys that
would not be objectionable to the Village - 1) Use present Route 34 from Estys
down past McKinneys, 2.), Follow road bed of old short line railroad, with overpass
over Route 34 near foot of Cayuga Street extension, and 3) Follow shortline rail-
road down to about the.Egg Plant and then drop to Route 34.
Engineer Crandall suggested no Board'action now. He pointed out that a
considerable tract of Village owned land.and the Village sewer extension and
treatment plant would be involved, and he felt that the State Department of Public
Works would be reluctant to consider any route which would involve a controversy
on rights of way.through Village land encumbered with the Sewage Treatment Plant.
Also that the probable rating of area road projects by the State was 1) Trumansburg

cut -off, 2) Safe approach from south into the City and 3) the Route 13 project. He
suggested the whole Route 13 matter be referred to the (proposed) Regional Planning
® Board for study and recommendation. There would be no official specific:adtion.on Route
13 involved in doing so, and the Board is already on record as being committed to no
road within the Village unless it goes along the far west side in the general location
of the old short line railroad road bed. Acting accordingly, the Trustees
VOTED to authorize:;the Mayor to tell officials of the City and Town of Ithaca that
the Village wishes to have the Regional Planning Board, when organized, study the
whole matter of Route 13 realignment outside the City.

graphed form „ as ratified and confirmed, were approved without reading,
2. The following bills were approved for payment. See Schedule #5 & 5S.
3. Mayor - a)Request of Mrs. Catherwood for street light on Highgate Place
was referred to the Clerk to request New York State Electric & Gas Corporation for
investigation and recommendation.
b) Trustees VOTED approval of Mayor's action in the appointment
of Taylor D. Lewis as member of Board of Fire Commissioners for the balance of the '
unexpired termcof A. B. Credle, ending April 1958.
c) Professor Stanley Warren has approached the Mayor with the plan
to give to the Village about 6 acres of land, 2/5 woods, and 315 open land, the
northerly portion of his property at 1006 Hanshaw Road, plus an 8 foot right of way
along west side. There would also be a small piece of the adjoining Cushman proper-
ty involved. Professor Warren's purpose is to provide a restricted place for camping
and recreation activities of scouts and youth groups. The Trustees took a favorable
interest and attitude in the matter, and

VOTED to authorize the Mayor to go ahead with negotiations with Professor /and Ella
Cushman.
4. Attorney not•present - no report.
5. Engineer -
a) Bouley has started sewage treatment plant work, with excavation
complete for building and tank. Less rock than anticipated was encountered. The
out£all pipe installation has not been started but the Engineer is hopeful that it can
be concluded in the several months of good weather remaining this year.
b) T. G. Miller is looking after both plant and sewer inspection.
Plans to ease off on•LewisI services.
c) There has been one complaint of damage said to be caused by
blasting. This was cracks in basement ceiling at the Larkin residence. This is a
matter for the contractor's liability insurance.company.
d) The Corners Community Center has been authorized to connect with
the new sewer on E. Upland Road which empties into the City System through the old
village sewer lines.
6. Treasurer'- In his absence, the Treasurer's report was presented by the
Clerk.
a) The $57,000 Bond Anticipation'Note for Village Hall construction
has been renewed @ 211% for one year with the Tompkins County Trust Company.
b) In order to provide funds for the sewer project, two Bond Antici-
pation Nate: %resolutions were suggested, as follof s:-
1) $200,000 ®2Z'S for one year on Treatment Plant to Tompkins County
Trust Company.
2) $250,000 ® 2•21% for one year on Sewer Extensions to First
.National Bank.

BOND ANTICIPATION NOTE RESOLUTION DATED OCTOBER 9, 1956
A RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF A ,
BOND ANTICIPATION NOTE OF THE VILLAGE OF CAYUGA HEIGHTS,
N.Y. TO PAY PART OF THE COST OF THE CONSTRUCTION OF AN
ADDITION TO THE SANITARY SEWAGE COLLECTION SYSTEM OF
SAID VILLAGE.
WHEREAS, on December 28, 1955, the Board of Trustees of the Village of Cayuga
Heights, N.Y. adopted,a bond resolution authorizing the issuance of $481,000 aerial
bonds of said village to pay the cost of the construction of an addition to the sani-
tary sewagec o]lection system of said village; and
WHEREAS, there are bond. anticipation notes outstanding in the amount of,$200,000
which have been previously issued in anticipation of the sale of the aforesaid bonds;
and it is now desired to provide further temporary,financing thereof by the issuance
of an additional bond anticipation note;
NOW THEREFORE, BE IT
RESOLVED, by the Board of Trustees of the Village of Cayuga Heights, Tompkins
County, New York, as follows:
Section 1. A bond anticipation note in the amount of $250,000 shall be issued
by the Village of Cayuga Heights for the purpose aforesaid in anticipation of the ,
sale of the serial bonds authorized by the resolution adopted on December 28, 1955,
entitled "A Resolution Authorizing the Construction of an Addition to the Sanitary
Collection System of the Village of Cayuga Heights, Tompkins County, New York, at
a Maximum Estimated Cost of $481,000 and Authorizing the Issuance of'$481,000 Serial
Bonds of said Village to Pay the Cost Thereof." The said note is issued.in anticipa-
tion of bonds for an assessable improvement, and it is not a renewal note.
Section 2. Such note shall be dated October 15, 1956, or such later date as the
officers by their execution thereof will determine, and will mature on the 15th day
of October, 1957, will bear interest at a rate of not exceeding 22 per cent per an-
num payable at maturity, will be payable as to both principal and interest in lawful
money of the United States of America at the First National Bank of Ithaca in Ithaca,
New York, will be signed in the name of the Village of Cayuga Heights by the Mayor
and Treasurer and will be sealed with the seal of said village.
Section 3. The said bond anticipation note shall be of substantially the fol-
lowing terms, form and contents, to wit:

The Village of Cayuga Heights in the County.of Tompkins, State of New York, ,
hereby, acknowledges itself indebted and for value received promises to pay to the
First National Bank of Ithaca the sum of $250,000 on the 15th day of October, 1957,
together with the interest thereon from the date hereof at the rate of 212- per cent

per annum, payable at maturity. Both principal of and interest on this note will be
paid in lawful money of the United States of America at First National Bank of Ithaca,
New York.
This note may be called for redemption on any date prior to maturity after giving
at least'90 days notice of the date of redemption to the First National Bank of Ithaca
by mailing written notice to the said bank, and interest shall cease to be paid herein
after such date of redemption.
This note is one of an authorized issue, the aggregate principal amount of whihh
is $481,000. It is issued,pursuant to the provisions of a resolution entitled "A
Resolution Authorizing the Issuance and Sale of a Bond Anticipation Note of the Village
of Cayuga Heights, N.Y. to Pay Part of the Cost of the Construction of an Addition to
the Sanitary Sewage Collection System of said Village ", which resolution was duly adopted
by the Board of Trustees of the Village of Cayuga Heights on the 9th day of October, 1956.
The faith and credit of the Village of Cayuga Heights are hereby irrevocably pledged
for the punctual payment of the principal of and interest on this note according to its
terms.
It is hereby certified and recited that all.conditions, acts and things required
by the Constitution and statutes of the State of New York to exist, to have happened
and to have been performed precedent to and in the issuance of this note,exisi, have
happened and have been performed, and that this note, together with all other indebted -
nexx of said village is within every debt and other limit prescribed by the Constitution
and laws of the State of New York.
IN WITNESS WHEREOF, the Village of Cayuga Heights has caused this note to be
signed by its Mayor and Treasurer and its corporate seal to.be hereunto attached,
® and this note to be dated as of the day of 1956.

Section 4. The faith and credit of the,Village of Cayuga Heights are
hereby pledged for the payment of the principal of and interest on such bond antici-
pation note, and such note shall be paid from the proceeds derived from the sale of
said bonds or may be redeemed as provided by the Local Finance Law of the State of
New York.
Section 5. The Treasurer of said village is hereby authorized to sell
such bond anticipation note at private sale for not less than par and accrued interest
at a rate not exceeding the rate above specified, and the Treasurer is authorized to
deliver such note to the purchaser upon payment of the purchase price and accrued
interest as above specified. The receipt of the Treasurer shall be afull acquittance
to the purchaser, who shall not be obliged to see to the application of the purchase
money.
Section 6. This resolution.shall take effect immediately. ,+

seconded by Trustee O'Connor, to wit:

and appurtenances for the said village; and
WHEREAS, there are bond anticipation notes outstanding in the amount of $50,000
which have been previously issued in anticipation of the sale of the aforesaid bonds;
and it is now desired to provide further temporary financing thereof by the issuance
of an additional bond anticipation note;
NOW THEREFORE, BE IT RESOLVED by the Board of Trustees of the Village of Cayuga
Heights, Tompkins County, New York, as follows:
Section 1. A bond anticipation note in the amount of $200,000 shall be issued
by'the Village of Cayuga Heights for the purpose aforesaid in anticipation of the
sale of the serial bonds authorized ty resolution adopted on December 28, 1955. entitled
"A Resolution Authorizing the Construction of a Sewage Treatment Plant andAppurtenances
for the Village of Cayuga Heights, Tompkins County, New York, at a Maximum Estimated
Cost of $269,000, and Authorizing the Issuance of $269,000Serial Bonds of said Village
to Pay the Cost Thereof." The said note is issued in anticipation of bonds, and it
is not a renewal note.
Section 2. Such note shall be dated October 15, 1956, or such later date as

7. Clerk -
a) A letter has been written to the New York StateDepartment of Health
Water Pollution Control Board inquiring and requesting information and application
forms relative to the possibility of Federal Aid funds up to 30% of the cost of the
sewage treatment plant.
•b) Town of Ithaca Supervisor Harry Gordon has asked the Village to
provide fire protection in 1957 to the (unincorporated) Northeast Water District
and the Forest Home Water District. Figures on valuation and costs were presented
and discussed. The Board was favorable to consideration of the matter, and
VOTED to refer the proposal to the Board of Fire Commissioners for their study and
recommendations, with a report at the next meeting.
8. Police Commissioner -
a) Presented his report for September, which the Trustees
VOTED to accept.
b) Stated he was working on Traffic ordinance revisions.
.9. Fire Commissioner -
None of the Fire Commissioners were present. The Clerk presented
the planting plan sketch for the Village Hall. Suggestions for parking areas and
entrance and exit roads were made to be passed along to the Fire Commissioners
for study. Clerk is obtaining price quotes on the list of trees and shrubs. A
"Planting Bee" was suggested.

with pneumonia.
