MINUTES of a Special Meeting of the Village Board of Trustees held on Feb. 15,
1955 at 8 P. M. at the schoolhouse.
NOTE:
A public hearing of the village residents, convened at 8 P.M. and adjourned at
9:20 P.M.,.was attended by about 100 persons who assembled at the request of the
Trustees to hear proposals of the Board of Fire Commissioners to establish a Village
Fire, Department, and.to vote informally on this matter. Details of the plans were
given by C. I. Sayles, Chairman of the Board of Fire Commissioners. Questions of
the assembly were answered by Prof. Sayles, other officials, of the Village and by
a fire equipment sales representative.
To the question "Shall the Village establish its own fire department in accor-
dance with the outlined plans?" the vote was
YES 72 NO 12
To a question "Shall the details and the amount of paid help be left to the
discretion of the Board of Fire Commissioners?" the vote was.unanimouslp AFFIRMATIVE.
On exhibit were architects plans of the proposed permanent fire station with
apartment and village.o£fice and a Class A - 500 gal /min. fire truck of the
American- LaFrance Company, meeting the fire underwriters specifications.
On motion of Prof, Mackesey, the Board of Fire Commissioners was given a vote
of appreciation for its excellent job in preparing this whole matter for considera-
tion and action by the residents and Village Board.

2. The Mayor reported acceptance of the appointments o£ the nominating:

' Prof. C. H. Guise. He also noted that the Inspectors of Election as appointed are,
Frederick B, Bryant, Chairman; Mrs. Edgar Whiting, Mrs, Loren Scheel and Mrs. Herbert

3• The Engineer reported that he had filed preliminary application with the State
Department of Health regarding an enlargement of the-sanitary sewer system of the
Village, construction of a sewage disposal plant, and discharge of the effluent into
Cayuga Lake.
The Engineer stated that aid from the State to the extent of 2% of the estimated
cost of sewage lines and plant for preparation of engineering plans, might be avail-
able to the Village upon proper application and approval. With an estimated cost of
$350,000 for lines and $250,000 for the plant, this would amount to $12,000. The
Trustees indicated their approval, so upon motion of Trustee Marcham, seconded by
Trustee Wright, the following Resolution was UNANIMSOUSLY APPROVED: -
WHEREAS, the State of New York has indicated, pursuant to Section 31 of the Public
Works Law, that it will contribute up to 2% of the cost of plans of approved municipal
projects within the limits set by such law, and
WHEREAS, the Village of Cayuga Heights wishes to make application for a grant toward
the cost of the preparation of plans for the project listed on attached application
(estimated cost shomn): Now, therefore, be it
RESOLVED, that the Village of Cayuga Heights submit this project for consideration
by the Superintendent of Public Works of the State of New York with the request that
an allocation be granted of tip to 2% of the estimated cost of construction for the
preparation of plans of such project; and be it further
RESOLVED, that when and if the Superintendent approves the project, and when and
if an allocation of up to 2% of the cost of construction for the preparation of the plans
of such approved project is. made, the Village of Cayuga Heights will make available a
sum equal to that allocated by the State of New York.
The Engineer also reported that the County Health Board, by Dr. Broad, had approved
the use by the Village of the Collins dump for receiving village garbage and waste.
Ile wished to check on the accessibility of the Collins dump in the winter, and further
study the advisability of continuing the relation with the City of Ithaca on use of
the city dump for the balance of 1955, as a matter of policy at this particular time.
He has determined that the City charge for 1955 is to be $750. based on 600 loads at
$1.25 per load. The Trustees indicated their approval of the Engineer's plans, and
requested he report at a'future meeting.
4. The Clerk reported that he had obtained from the Town of Ithaca Clerk, a
certified copy of the Town Board's resolution granting the Village permission 'to locate
a sewage plant and lines in the Town of Ithaca. For the record this resolution is
quoted here:
IlAt a meeting of the Town Board of the Town of Ithaca held on Feb. 3, 1955,
the following resolution was adopted:
"Moved by Justice Maxfield that the Town Board of the Town of Ithaca
grant permission to the Village of Cayuga Heights to construct sewer
and sewage disposal plant in the Town of Ithaca, in the general
location as outlined by Engineer C. S. Crandall. Seconded by
Councilman Roe and approved by the following vote:
Ayes - Maxfield- Roe- Ideman- Hartsock. Noes 0."
5. The Trustees discussed the Fire Commissioners plans for a Village Fire Depart-
ment and the public hearing on the subject. The expected budget for the interim and
final plans is included in the minutes. Supplementing these figures are the following
estimated equipment costs:

The Trustees agreed that the Village residents showed strong approval of a
Village Fire Department, and undertook to implement the citizens desires 'with a
series of resolutions under'the guidance of Village Attorney Charles H. Newman.
Accordingly, it was moved by Trustee Whiting, seconded by Trustee Wright and
VOTED UNANIMOUSLY,
A RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF A SERIAL BOND OF THE VILLAGE
OF CAYUGA HEIGHTS, NEW YORK, IN THE AMOUNT OF $15,000 FOR THE PURCHASE OF A FIRE-
FIGHTING VEHICLE AND APPARATUS AND OTHER ACCESSORIES AND EQUIPMENT
BE IT RESOLVED, this 15th day of February, 1955, by the Board of Trustees of the
Village of Cayuga Heights, New York, as follows:,
Section 1. For the object or purpose. of the purchase of a fire - fighting vehicle
and apparatus and other accessories and equipment and to provide funds to defray a
part of the cost thereof, a general obligation serial bond of the Village of Cayuga
Heights, New York, in the amount of $15,000.00, to be of the terms, forms and con-
tents hereinafter provided for, shall be issued pursuant to the provisions of the
Local Finance Law of the State of New York.
Section 2. $16,000.00 is estimated as the maximum cost of the object or purpose
for which such serial bond is to be issued. .
Section 3. The plan for the financing of such object or purpose consists of
the issuance of a serial bond of said village in the principal sum of $15,000 and the
payment of the balance of $1,000 in cash from current funds.
Section 4. It is hereb.v determined that the object or purpose for which such
serial bond is to be issued falls within subparagraph 27 of subdivision a of Section
' 11.00 of the Local Finance Law and that the period of probable usefulness of such
object or purpose is ten years.
Section 5.. The proposed maturity of the serial bond hereby authorized will not
be in excess of five years.
Section 6. In accordance with the requirements of Section 107.00 of the Local
Finance Law, there will be provided by the village prior to the issuance of such
bond from current funds by payment, in cash a sum of money sufficient to pay more
than five per cent of the estimated cost of such vehicle, apparatus, accessories
and equipment, to wit, the sum of $1,000.
Section 7. The said serial bond shall be in the amount of $15,000. and shall
be payable as follows: $3,000 of the principal sum on the first day of July in each
years 1955, 1956, 1957, 1958 and 1959; and it shall bear interest on the amount
outstanding at a rate of two and one -half (212$) per cent per annum, payable annually
on the first day of July. The said bond shall be signed in the name of the village
by the village treasurer, be sealed with the corporate seal of the said village and
attested by the village clerk, and both the principal and interest shall be payable
in lawful money of the United States of America at the Tompkins County-Trust Company
of Ithaca, New York.
Section 8. Said serial bond shall be issued in substantially the following form
to wit:
"No. 1 VILLAGE OF CAYUGA HEIGHTS $15,000.00
SERIAL BOND OF 1955
The Village of Cayuga Heights, a municipal corporation in the County of Tompkins
and State of New York, hereby acknowledges itself indebted and for value received
promises to pay to the bearer of this bond

on the first day of July, 1955, the sum of $3,000.00
on the first day of July, 1956, the sum of $3,000.00
on the first day of July, 1957, the sum of $3,000.00
on the first day of July, 1958, the sum of $3,000.00
on the first day of July, 1959, the sum of $3,000.00 '
and to pay interest on the outstanding balance of all such sums at the rate of
two and one -half per cent (2z %) per annum annually on the first day of July in each
year from the date of this bond until each and all of said.installments of principal
shall have been fully paid, upon presentation thereof for notation of such payments
thereon. The principal of and the interest on this bond shall be-paid in lawful
money of the United States of America,:at the Tompkins County Trust Company in the
City of Ithaca, New York.
This bond is not convertible into a registered bond.
This bond is the only bond of an authorized issue in the principal amount of
$15,000 and is issued pursuant to a bond resolution entitled "A Resolution Authoriz-
ing the Issuance and Sale of a Serial Bond.of the Village of Cayuga Heights, New York,
in the Amount of $15,000 for the Purchase of a Fire - fighting Vehicle and Apparatus
and Other Accessories and Equipment ", duly adopted by the Board of Trustees of the
Village of Cayuga Heights on February 15, 1955•
The faith and credit of the Village of Cayuga Heights are hereby irrevocably
pledged for the punctual payment of the principal of and the interest on this bond
according to its terms. .
It is hereby certified and recited that all conditions, acts and things required
by the Constitution and statutes of the State of New York to exist, to have happened
and to have been performed precedent to and in the issuance of this bond exist, '
have happened and have been performed, and that this bond, together with all other
indebtedness of the said village of Cayuga Heights, is within every debt and other
limit prescribed by the Constitution and laws of the State of New York.
IN WITNESS WHEREOF, the Village of Cayuga Heights, Tompkins County, New York,
has caused this bond to be signed by its treasurer, attested by its clerk, and its
corporate seal to be hereunto affixed and this bond to be dated the day of

Section 9. The treasurer is hereby authorized and directed to execute such
bond on behalf of the village and sell the same at private sale in the manner
required by law. When said bond shall have been duly sold, the same shall be delivered
by the treasurer to the purchaser upon payment by him of the purchase price, includ-
ing accrued interest, if any, and the receipt of the treasurer shall be acquittance
to the purchaser, who shall not be obliged to see to the application of the purchase
money.
Section 10. The faith and credit of said village are hereby pledged to-the
payment of the principal of said bond and the interest thereon when due. An amount
sufficient to pay the principal and interest on said bond as the sums become due in
each year shall be included in the annual budget of the village for each year until
the same shall have been fully paid, and the said bond shall not be renewed.

.Section 11. This resolution shall take effect immediately.
Moved by L. Reid, seconded by S. S. Atwood, it was VOTED UNANIMAUSLY
RESOLVED that the Board of Fire Commissioners be and hereby is authorized to
put Plan I (see Feb. 8 Proposal of Fire Commissioners) in effect as soon as possible,
including purchase of equipment and other actions. required by Plan I.
Moved by E. A. Whiting, seconded by F. G. Marcham and VOTED UNANIMOUSLY
RESOLVED that the Board o£ Fire Commissioners immediately undertake the per-
formance of their duties as required by Village Law, and among, other things form a
Fire Department, to be known as the Cayuga Heights Fire Department.
