MINUTES of a special meeting of the Board of Trustees of the
Village of Cayuga Heights held on Tuesday, July 28, 1953, at
7:30 P.M. in the schoolhouse. .
PUBLIC HEARING on the gnended zoning ordinance at 8 P.M.

1. The minutes of the meetings of July 7th, 13th, and 17th
were read and approved.
2. The Trustees recessed at 8 P.M. to attend the public
hearing at which 32 persons besides trustees and officers,were
present. Mayor Shirey requested Prof. Mackesey to present a
summary of the amended zoning ordinance with explanations. Prof.
Mackesey stated that the.aim of his.commit'tee in drafting the
ordinance was to draw up minimum but reasonable regulations to
make this community a better place in which to live. The Village
was divided into three districts; residential, multiple housing,
and commercial, and Prof. Mackesey explained the restrictions
for each. Discussion centered around the commercial and multiple

housing districts, and a question was raised as to what a
residential club was.
Prof. Freeman moved that the sense of this meeting was that
another hearing be held after Labor Day. The Chairman declared
him out of order, and Prof. Freeman.requested a vote on the
ruling of the Chair. The vote was 15 to 5 in favor of the Chair.
Concern was expressed regarding. possible expansion of,
commer &ial activities, lest they become a, nuisance, and it was
pointed out that certain uses would be permitted only on approval
of the Board of Trustees or following a public hearing. Prof.

IT WAS VOTED that the amended zoning ordinance as attached
herewith to these minutes be adopted, effective Aug. 15, 1953•
6. Mayor,Shirey presented a bill from Charles Newman for
$152 and from the Corners Community Center for 052.32 for services
and expenses incurred in connection with the Village annexation
project. He stated that Engineer Crandall had recommended that
these bills be paid from Village funds without levying an
additional Water District assessment upon the area annexed.
IT WAS VOTED that these bills be paid out of the general funds
of the Village.
7. The report of the Engineer regarding "Stop" signs at the
intersection of Midday & Northway Roads and at Berkshire &
Cayuga Heights Roads was read recommending the use of "slow" or
"dangerous intersection" signs instead of "stop" signs at these
Mackesey pointed out that the terms "restaurant" and "theatre"
were broad in scope and therefore the Board should impose
conditions-so the building will be suitable.
The 12,% area restriction and the 12 feet between property line
and building restriction were each put to a vote which indicated
that the majority present were in.favor of these figures.
The hearing was adjourned.at 9:28 P.M.
3. The Board of Trustees re- convened to carry on its regular
business.
4. The following bills were approved for payment:

5. It was reported that at the public hearing there were
comments both pro and con regarding the proposed amended ordinance
and

intersections, since "stop° signs could not be used without
amending the Parking and Traffic Violation Ordinance'to_ designate
two of these streets as through streets. Engineer Crandall
reported that there "are around 15 stop signs in the new part of
the Village put`in,by the.Town,Board, and.stated that he felt it
would be illegal to -arrest anyone for speeding..at these points
becauee they are not covered in the Village ordinance.. He said
he is making an inventory of all these signs, in'the new Village
after which the Board can decide which :shall be "slow "; "dangerous"
or "stop" and the ordinance can be amended all at ane.time.
IT WAS VOTED to place the matter of "stop,!': °signs on the table
until the Engineer completes his inventory.
8. Mayor Shirey reported that Lindley.Kent had accepted the
appointment as'Police Justice and had filed his oath,of office
with' the Clerk.
g. Mayor Shirey read a letter from Robert R. Colbert
explaining the set-up of the Cornell Residential ,Club an d
requesting the Village Board to notify him that do violation of
the zoning ordinance would occur if the Club accepted tenants
on a short term basis. Mr. Colbert explained that the Club would
serve a useful purpose if apartments were available to Cornell
alumni and Trustees on such occasions as football week -ends,
although he expressed his hope that most of the apartments could
be rented on a long term basis.
IT WAS VOTED that Mr. Colbert be told that the Board'is
sympathetic with his porject and the building meets a_.need; but
the ordinanoe says no motel or;similar facility catering'to
transients is permitted,.and that the Board would be inclined to
frown on any appreciable number of occupancies for less than a.
week.

It was decided that Mr. Colbert be also told that the Village
Trustees will be glad to visit him premises and get the figures
on construction costs.
10. The Treasurer reported a present balance of $359342.29•
11. Engineer Crandall reported that a zoning map should be
prepared and copies attached to the zoning ordinance when.it is
printed.
IT WAS VOTED that the Engineer prepare such a map and that
the map be presented along with the zoning ordinance.
The Engineer recommended that the printing of the ordinances
be deferred until after the stop signs are settled and the traffic
ordinance amended if necessary.
The Engineer reported that the water main on Highgate Road
is now being installed.
12. At the request of the Police Commissioner
IT WAS VOTED that the Police Commissioner be authorized to
order 25 1125 miles per hour" speed limit signs.
13. The Clerk submitted his resignation effective as soon
as a replacement could be found.
